Under the Pharmacy Act each Sate Govt. is required to constitute a state pharmacy council for the maintenance of register of Pharmacists of the State and to monitor their professional activities.
Two or more states can also enter into an agreement to form a Joint State Pharmacy Council.

3. Constitution of State Pharmacy Council
Each state Pharmacy Council is constituted with three types of members:
1- Elected Members:-
i. six members, elected from amongst themselves by registered pharmacists of the
State.
ii. one member elected from amongst themselves by the members of each Medical
Council of the state.
2- Nominated Members:-
i. Five members, of whom at least three shall be possessing a degree or diploma in
pharmacy or pharmaceutical chemistry or be Registered Pharmacists, nominated
by the State Government.
Ex-officio Members:-
i. Chief administrative medical officer of the State.
ii. Government analyst nominated by State government under the D & C act 1940.
iii. Officer in charge of drugs control organisation of the State.

4. Constitution of Joint State Pharmacy Council
Two or more State Governments can agree that the State Council of one State is
to serve the needs of the participating States.
1. Elected member :
i. 3-5 members elected amongst themselves by the Registered Pharmacists of
each of the participating States.
ii. One member elected from amongst themselves by the members of each
Medical Council of each State.
2. Nominated member:
i. 2-4 members nominated by each participating state, of whom more than half
possess a degree or diploma in pharmacy or be Registered Pharmacist.
3. Ex-officio member:
i. The Chief administrative medical officer of each participating State.
ii. The Government Analyst of each participating state.
iii. The officer in-charge of drugs control organisation of each participating State.

President
Vice-president
The such other number of the member.
Each State council shall have a president and a Vice-President who are elected by
the members from amongst themselves.
The president shall nominated by the state Govt. after the constitution of the State
Pharmacy Council for the first time.
Following Points should be noted:
1. President or Vice-president hold the office for up to 05 years.
2. He is eligible for re-election.
3. Any member can reign at ant time by writing to the President.
4. If any member is absent in the three consecutive meetings without sufficient cause,
his seat is deemed to be vacated.
5. A casual vacancy in the state council can be filled by fresh nomination/election.
6. Any member of state council is eligible for re-nomination or reelection.
7. State council may appoint a Registrar who may act as its secretary and also as
treasure.

7. Function of State Pharmacy Council:

2. Registration of Pharmacist
1- Inspection by state council:-
a) Inspect any premises where drugs are compounded and dispensed.
b) Investigate about the complaint made in writing regarding the
contravention of Act.
c) To see weather person engaged in the compounding or dispensing of
medicines are only registered pharmacists.
d) Institute prosecution under the order of the Executive Committee of the
State Council.
e) Other essential powers.

8. 2- Registration of Pharmacist
Preparation and maintenance of First and Subsequent registers of
Pharmacists
The Pharmacy Act, 1948 provides for the registration of Pharmacists in all the states
of India. The First register of Pharmacists in a state is required to be prepared by the
state Govt.
After the constitution of the State Pharmacy council the maintenance of the first and
subsequent register become the responsibility of the State council.
Its should furnish necessary information and annual report to the state Govt. and PCI.
The register shall include the following particulars, namely:
a. the full name and residential address of the registered person;
b. the date of his first admission to the register;
c. his qualifications for registration;
d. his professional address, and if he is employed by any person, the name of
such person;
e. such further particulars as may be prescribed.
