26. STEPS TAKEN BY GOVT AND ALSO ARE
BULLYING LAWS EFFECTIVE?
The University Grants Commission on account
of increasing bullying-related suicides, issued a
landmark notification in 2009 to curb rampant
ragging throughout higher-education
institutions in India.
27. The UGC has given three definitions of
ragging, they go as follows:
1.Any disorderly conduct whether by words spoken or
written or by an act which has the effect of teasing, treating
or handling with rudeness a fresher or a junior student.
2.Indulging in undisciplined activities which causes or is
likely to cause annoyance, hardship or Psychological harm
or to raise voice in a fresher or a junior student.
3.Asking the students to do any act or perform something
which has the effect of causing or generating a sense of
shame or embarrassment so as to adversely affect the
physique or Psyche of a fresher or a junior student.
28. Measures for prevention:
1. The circular makes it mandatory for every college to display overtly on
every brochure, circular or form it releases pertaining to admission in that
university, the fact that ragging and any activity which promotes or
supports ragging is prohibited and strict action will be taken against
anyone who engages in such activities.
2. The brochure of admission should print all the relevant regulations
regarding ragging in full.
3. And also It should also include the numbers of the anti ragging helpline,
the head of the institution, the anti ragging cell of the university, District
and Sub Divisional authorities, Wardens of hostels.
4. Colleges and institutions also implement disciplinary sanctions. The
consequences of bullying reflect the seriousness of the incident so that
others see that bullying is unacceptable. And work with the wider
community such as the police and children’s services to agree a clearly
understood approach to cases where bullying is particularly serious.
29. DUTIES AND RESPONSIBILITIES OF UGC:
1. The UGC would be responsible to operate a toll-free helpline for ragging related
incidents which would accessible to students who might be victims of ragging related
incidents 24×7.
2. Any complaint received by the helpline will promptly be forwarded to the Head of the
concerned institution, the warden of the hostel, the Nodal officer of the affiliating
university.
3. To improve the helpline, what can be done is to train the operators with the skills to
handle a situation where a student is in emotional distress and thinking about self harm.
30. ARE BULLYING LAWS EFECTIVE?
Bullying Affects Mental Health And Well-Being:
There is a strong link between mental health issues and bullying. For
instance, young people are more likely to develop mental health issues
if they are bullied. It is learned from a very young age that how certain
behaviors and experiences can have positive or negative influences on
our physical health.
The research studies have shown that the one involved with bullying or
those who bully others or those who are bullied and those who bully
and are bullied are at increased risk for depression.
The children and youth who bully others over time are at higher risk for
more intense anti-social behaviors like problems at school, substance
use, and aggressive behavior.
31. WORLDWIDE BULLYING LAWS:
Bullying is prevalent at the school level in India, especially in boarding
schools. However, in 2015 HRD ministry directed colleges and schools to
form anti-ragging committees at the accurate level also putting severe
punishments to students indulging in bullying and the punishment may
vary to rustication in rarest of rare cases.
The School Health Programme under AYUSHMAN BHARAT also focuses
on the mental health and well-being of the students.

provisions concerning bullying for

Australia
Australia has extensive provisions in place to counter bullying, both in schools and the
workplace. Individuals there are encouraged to first try and resolve bullying issues
through the organization's harassment policy.
In schools, each state or territory forms its own set of anti-bullying policies and applies
these policies to public schools. Private school boards, however, are responsible for the
oversight of their schools as public-school legislation does not apply to them.
United Kingdom
Since 1998, UK law dictates that Cyberbullying itself is not a criminal offense in the UK,
however, there are numerous laws that can be applied to cyberbullying. The Protection
from Harassment Act can protect individuals from harassment, while the
Telecommunications Act makes it an offense to send anonymous, abusive phone calls.
Canada
Bullying itself is not a punishable crime in Canada at a federal level, however, there are
other laws concerning the same. The Criminal Harassment Act, Uttering Threats Act,
Assault Act, and Sexual Assault Act are all new laws that could apply to someone behaving
like a bully. These apply equally to schoolyard or workplace bullying.
