If you’ve been following the news, then you’re aware of Mississippi House Bill 898. The
proposed bill would render process servers exempt from trespassing. Although the bill did not
pass this year, it will be brought up again next year.
Bill 898 was to be instrumental in exempting process servers from “trespass prosecution while
performing the job”1
of serving papers. The bill proposed “an act to amend sections 97-17-85,
97-17-93 and 97-17-97, Mississippi code of 1972”1
related to trespassing during the “serving
process; and for related purposes.”1
Members of the Mississippi Association of Professional Process Services (MAPPS) have been
working toward the goal of Bill 898 for years. If passed, it would have brought welcome changes
for private process servers, who often experience difficulty serving papers due to the possibility
of trespassing. In some cases, process servers have been brought up on charges of trespassing
simply for executing the lawful serving of legal process.1
Although it has been a rare occurrence for a process server to be both charged with and
convicted of trespassing, the true issue lies with recipients of process who “use the current
trespassing law to avoid process.”1
