7. Summary:
We’ll always do our best to fulfil your needs and meet your
expectations, but it’s important to have things written down so that we
both know what’s what, who should do what and when, and what will
happen if something goes wrong. In this contract you won’t find any
complicated legal terms or long passages of unreadable text. We’ve no
desire to trick you into signing something that you might later regret.
What we do want is what’s best for both parties, now and in the future.
8. In short
You ([client name]) are hiring me ([freelancer name]) located at
[address] to [design and develop a web site] for the estimated total
price of [total] as outlined in our previous correspondence. Of course
it's a little more complicated, but we'll get to that.
9. What do both parties agree to do?
You: You have the authority to enter into this contract on behalf of yourself,
your company or your organisation. You’ll give us the assets and information
we tell you we need to complete the project. You’ll do this when we ask and
provide it in the formats we ask for. You’ll review our work, provide feedback
and approval in a timely manner too. Deadlines work two ways, so you’ll also
be bound by dates we set together. You also agree to stick to the payment
schedule set out at the end of this contract.
Us: We have the experience and ability to do everything we’ve agreed with
you and we’ll do it all in a professional and timely manner. We’ll endeavour
to meet every deadline that’s set and on top of that we'll maintain the
confidentiality of everything you give us.
11. Design
We will create designs for the look-and-feel, layout and functionality of
your web site. This contract includes one main design plus the
opportunity for you to make up to two rounds of revisions. If you're not
happy with the designs at this stage, you will pay us in full for all of the
work that we have produced until that point and you may either cancel
this contract or continue to commission us to make further design
revisions at the daily rate set out in our original estimate.
12. HTML layout templates
If the project includes XHTML or HTML markup and CSS templates, we
will develop these using valid HTML 5 markup and CSS 3 for styling.
13. Browser testing
Browser testing no longer means attempting to make a website look
the same in browsers of different capabilities or on devices with
different size screens. It does mean ensuring that a person’s experience
of a design should be appropriate to the capabilities of a browser or
device.
We test our work in current versions of major desktop browsers
including those made by Apple (Safari), Google (Chrome), Microsoft
(Edge), Mozilla Firefox and Opera. We’ll also test to ensure that people
who use Microsoft Internet Explorer 11 for Windows get an
appropriate experience. We won’t test in other older browsers unless
we agreed separately. If you need an enhanced design for an older
browser, we can provide a separate estimate for that.
14. Mobile browser testing
Mobile browser testing Testing using popular smaller screen devices is
essential in ensuring that a person’s experience of a design is
appropriate to the capabilities of the device they’re using. We test our
designs in:
iOS 9: Safari, Google Chrome
We won’t test in Blackberry, Opera Mini/Mobile, specific Android
devices, Windows or other mobile browsers unless we agreed
separately. If you need us to test using these, we can provide a
separate estimate for that.
15. Technical support
We’re not a website hosting company so we don’t offer support for
website hosting, email or other services relating to hosting. You may
already have professional hosting and you might even manage that
hosting in-house; if you do, great. If you don’t, we can set up an
account for you at one of our preferred hosting providers.
We can set up your site on a server, plus any statistics software such as
Google Analytics and we can provide a separate estimate for that.
Then, the updates to, and management of that server will be up to you.
16. Text content
We are not responsible for writing or inputting any text copy unless we
specified it in the original estimate. We'll be happy to help though, and
in addition to the estimate we will charge you at [price] per hour for
copy writing or content input.
17. Photographs
We can use free photographs unless you want special photographs for
your product/service. In that case you will be responsible about
supplying us photographs in digital format. If you choose to buy stock
photographs we can suggest vendors of stock photography.
18. Changes and revisions
We don’t want to limit your ability to change your mind. The price at
the beginning of this contract is based on the number of days that we
estimate we’ll need to accomplish everything you’ve told us you want
to achieve, but we’re happy to be flexible. If you want to change your
mind or add anything new, that won’t be a problem as we’ll provide a
separate estimate for those additional weeks. You will be charged the
daily rate set out in the estimate we gave you. Along the way we might
ask you to put requests in writing so we can keep track of changes.
19. Displaying our work
We love to show off our work, so we reserve the right to display all
aspects of our creative work, including sketches, work-in-progress
designs and the completed project on our portfolio and in articles on
websites, in magazine articles and in books.

22. Payment schedule

pay the invoices that we send you promptly. As we’re also sure you’ll want to

24. Hourly Rate

within a reasonable period of time.
25. Cancellation
In the event of cancellation of this assignment, ownership of all
copyrights and the original artwork shall be retained by the Designer,
and a cancellation fee for work completed, and expenses already
incurred, shall be paid by the Client. Cancellation fee is based on the
hours submitted, if the project is on an hourly basis or a percentage
based on the time estimate for the entire job. A 100% cancellation fee
is due once the project has been finished, whether delivered to the
client or not. If the project is on an hourly basis and the project is
canceled by the client, the client agrees to pay no less than 100% of the
hours already billed for the project at the time of cancellation plus a
flat fee of $250 or 50% of the remaining hours that were expected to
be completed on the project, whichever is greater.
