3. Background
The Central Government has framed the Companies (Registered
Valuers and Valuation) Rules in 2017 for valuation in respect of
✓ any property,
✓ stocks, shares, debentures, securities or
✓ goodwill or
✓ any other assets or
✓ net worth of a company or
✓ its liabilities
under the provision of the Companies Act.

The Ministry of Corporate
Affairs (MCA) has now
notified the Amendment
Rules, 2022 on 21st
November 2022.

4. Amendment Related to Valuation Standards
Measure
• Either International Valuation Standards or registered RVO Valuation
Standards may be adopted for Valuation.
Applicability
• Immediate
Impact
• Increased clarity and removal of ambiguity on methodology

5. Amendment Related to Whole Time Directorship
Measure
• Registered Valuer Member functioning as a Whole Time Director in
the Company registered as valuer shall not be treated as taking up
employment and thus not attract the provisions of
surrender/expulsion.
Applicability
• Immediate
Impact
• Improvement and strengthening of Valuation Practice in India

6. Amendments Related to Valuer Entities
Measure
• Partnership Firms or Companies need to be registered with a
Registered Valuer Organization (RVO) in order to be eligible to be a
Registered Valuer (RV)
• These should be registered with only one RVO at any point in time.
Time-Frame
• 6 months to comply
Impact
• More effective disciplinary mechanism

7. Amendment Related to Reporting
Measure
• Changes in any Personal Details/Governing Board by an Registered
Valuer or Registered Valuer Entity or Registered Valuer Organization
need to be intimated to the Authority (IBBI) after paying prescribed
fees.
Time-Frame
• Immediate Effect
Impact
• More transparency and more effective monitoring.
