Food regulator issues new rules for imports
Food Safety and Standards Authority of India (FSSAI)
has issued new rules for importing products, seeking
to address concerns over the entry of sub-standard
items and simplify the process by setting shelf-life
normsandrelaxinglabellingguidelines.

2. According to the new rules, no food article will be
allowed unless it has 60 per cent of its shelf life
remaining when it is learned from custom. Companies
must register with the Directorate General of Foreign
Trade and possess a valid import export code, apart
fromanFBOlicensetoimportfood.Thisisanewclause
in the regulations that have been uploaded on the
websiteofFSSAI.
The Food Safety and Standards (Import) Regulations,
2016, will come into force when they are noti ied by
publication in the Of icial Gazette, the FSSAI said. The
regulator has addressed two key issues raised by the
food industry by easing labelling requirements and
introducingaredressalprocedure.
Importers will be allowed to af ix a single, non-
detachable sticker to rectify labelling errors related
to the name and address of the importer, the FSSAI
logo and license number, and the symbols for non-
vegetarian and vegetarian food items. The earlier
rulesdidnotallowsucherrorstobecorrected.
Nutraceuticals and food supplements will no longer
be proprietary foods: FSSAI Nutraceuticals and
health and dietary supplements such as forti ied
foods and energy drinks will no longer be
considered proprietary food by India's food
regulator, according to revised rules. They will likely
havetobeapprovedasaseparatecategory.
According to the FSSAI's new regulations uploaded
on its website, proprietary food is now de ined as
“...an article of food that has not been standardized
under these (Food Safety and Standards)
regulations, but does not include any novel food,
food for special dietary use, functional food,
nutraceuticals, health supplement and such other
articles of food which the Central Government may
notify in this behalf.” The regulations also specify
that “the food business operator shall be fully
responsibleforthesafetyoftheproprietaryfood.”
“Any food importer aggrieved by one or more of the
following orders of the authorized of icer may ile a
review application to the review of icer against such
order,”accordingtotheprovisions.
