In 2014, we live in a world with a media saturated culture. This is the era of digital news services, of 24-hour news channels, free newspapers, and even media based applications. For the majority of us, the way in which we learn about the world outside our personal perception is through the consumption of news, mainly still through broadcast or print (OFCOM 2007). Various forms of media has fed the public statistics that created a sense of stereotyping for each particular race. For example, the media and those on film, such as politics and leaders of the government, link together race and crime, which conveys a criminal image of the public’s consumption (St. John & Heald-Moore, 1995). Since race and crime are tied together, when one thinks of a crime, hears about a crime, or when crime is being reported, race is usually associated with it. In the American society, a frequent representation of crime is that it is majorly committed by African- Americans. The view of African Americans has been distorted and twisted by the media. Without question, almost everything that is being covered by the media is believed by most of society and it becomes their actual perceptual reality. Broadcast media and other various forms of media has a history for portraying African Americans in a biased manner, as if they were mostly reported involved in crime, drugs, or acts of violence. This has led to many cases of stereotyping, racial profiling, police brutality, prejudice, inhumane acts and has brain washed most of our society into believing that almost every African American is mischievous or a threat to their well-being. African Americans are unjustly, as well as unrealistically depicted on broadcast news and various other types of mass media. These negative connotations affects more than just African- Americans but also every other culture that exists in America.
African Americans have been associated with crime for quite some time. It was not until some in the 1970’s and early 1980s that the popular stereotype of the young black man evolved in the eyes of many from a petty thief or rapist into the notorious , malicious criminal predators, or what Kathery Russel ( 2002) has argued, is the world recognized “ criminalblackman”. Within the last few decades there have been controversial law enforcement practices of racial profiling. Law enforcement officials pursue minorities in an attempt to increase the likely hood of catching illegal activity or the predetermined act of illegal activity, which is part of a consequence from the racial profiling that the media has inflicted upon society. 1) Criminal laws are the laws that define wrongs against a society and civil laws are laws that
define the rights of one person against another (Textbook, Glossary) and in the criminal case
against OJ Simpson the verdict of not guilty came from the jury that had to all agree on a verdict
and the facts presented in the case that there was reasonable doubt about the DNA evidence
and the alleged misconduct by the LAPD were enough to push the jury toward a not guilty
verdict. Where as in the civil case against OJ Simpson the jury finds Simpson liable for the
murders based on the same facts presented in the previous trial but in a civil case the majority
vote gets the verdict and in this case they deemed his reasoning of alleged misconduct by the
LAPD inflammatory and speculative.
2) In the Criminal case for OJ Simpson it was the People of the State of California and in the
civil case for OJ Simpson it was the families of the victims, Nicole Brown Simpson and Ronald
L. Goldman.
3) Just like in the OJ Simpson case even though someone is acquitted of a crime doesn't mean
that they didn't commit the crime it's just that the evidence wasn't substantial enough to prove
the defendant not guilty, that the evidence was obtained illegally, and the list goes on about
ways that guilty people get away with things based on legal rights or even in some cases just
luck, but either way they should be held liable in a civil case so that when they do "get away with
murder" the parties affected by these actions can get compensation for their troubles.

The differences between the two cases impacted the verdicts for many reasons. First one being in the
criminal trial OJ wasn’t required to testify, so he decided not to, but in the civil trial he was required to
testify because of the plaintiffs’ option which forces him to testify. Another difference between the two was
that in the criminal trial a conviction for OJ required a finding that he committed the murder beyond any
reasonable doubt whereas in the civil case and a guilty verdict for OJ only required 9 out of 12 votes and

1. I firmly believe a defendant should not be allowed to plead guilty without fully admitting guilt. Pleading "no contest" or the Alford plea defeats the purpose of the criminal justice system, the accused must know and understand why they are being punished and accept the consequences of their guilty actions. Utilizing the Alford plea in capitol felony cases where the possibility of the death penalty is present should not be allowed, for a defendant believing they are innocent should not have to accept any plea deal. If one is to believe in our criminal justice system the truth will either condemn them or set them free.
The comments made in the wake of the O.J. Simpson's not guilty verdict only highlighted the issues that can arise utilizing the jury system. The jury system did not collapse due to this verdict, but it did show how flawed the system can be and did so while the entire nation watched. This verdict did more damage to the image of justice, and allowed an entire nation to question the accountability of justice in this country.
2. I do feel that Alford pleas have their place in the criminal justice system. There are situations, such as the North Carolina v. Alford 1970 case, where the defendant realized that the evidence presented to him would prove it a difficult task to exonerate him of any murder charges, and thus to avoid the death penalty, plead as he did. With the stark contrast of Alford pleas vs straight-up pleading "guilty", I would not limit the Alford pleas to cases whereas the defendant wishes to avoid the death penalty. It is one scenario to have on your record a "guilty" plea, vs to have an "Alford" plea; that's not to say it would necessarily provide for a "better" outlook once any punishment is served, but it could provide the defendant with a means to move on with his life knowing he was able to maintain his innocence of the act while realizing that due to whatever circumstances, enough evidence was present that he felt it would have led to him being guilty. At the same time, I can foresee this becoming almost abused by the state / federal government when trying to entice subjects of crimes to plead a certain way in order to alleviate the possible more severe punishment they might seek in court.

Two landmark rulings made by the Supreme Court involve the cases of Plessy v. Ferguson and Miranda v. Arizona. In both rulings the impact to society was great with one resulting in the segregation of African American citizen for the next fifty years while the other affected the way law enforcement officers’ question and interrogate criminal offenders. While both of these cases occurred in two different centuries the ruling of the court had a direct impact on functions in American society and the rights of the individual citizen. In Plessy the rights of the African American where limited but in the case of Miranda individual rights were broadened.
Plessy vs. Ferguson
In the case of Plessy v. Ferguson the case began when an African American male who was half white and appeared white went against a Louisiana law that requires separate accommodations for separate races. Homer Plessy was a member of a group in New Orleans known as the Citizens Committee that fought for the equal right of the African American citizen. The Citizens Committee decided to test a Louisiana Law known as the 1890 Louisiana Separate Car Act. When Homer Plessy entered the train and took accommodations in the white section of the railcars he was detained by a police officer and held in a separate car until he was arrested upon exiting the train. Plessy was charged with breaching Louisiana Law and was jailed and fined.
On appeal the Louisiana Appeals Court ruled declared forced segregation in railroad cars traveling between states to be unconstitutional (Wolf, 2011). The case was then appealed to the Louisiana Supreme Court that upheld the ruling of the district court and found the state had a right to establish laws that provide separate but equal accommodations. The case was then appealed for the last time when it went in front of the Supreme Court. The Supreme Court ruled in favor of the state and the laws concerning the segregation of the White and African American citizen was not addressed for over sixty years when the Supreme Courts ruling was reversed in the case of Brown vs. Board of Education.
When the Plessy case was brought in front of the Supreme Court by the defendant and the members of the Citizens Committee the claim was the defendant was denied his Fourteenth and Thirteenth Amendment rights. Plessy claimed that the 1890 Louisiana Separate Car Act violated his Thirteenth Amendment right against involuntary servitude. In other Plessy was claiming that by being forced into separate accommodations he was being placed in involuntary servitude. The court ruled that the Thirteenth Amendment did not apply to segregation so the defendants Thirteenth Amendment right could not have been violated.
Under the Fourteenth Amendment the defendant, Plessy, claimed he was denied the right to equal protection.

Two landmark rulings made by the Supreme Court involve the cases of Plessy v. Ferguson and Miranda v. Arizona. In both rulings the impact to society was great with one resulting in the segregation of African American citizen for the next fifty years while the other affected the way law enforcement officers’ question and interrogate criminal offenders. While both of these cases occurred in two different centuries the ruling of the court had a direct impact on functions in American society and the rights of the individual citizen. In Plessy the rights of the African American where limited but in the case of Miranda individual rights were broadened.
Plessy vs. Ferguson
In the case of Plessy v. Ferguson the case began when an African American male who was half white and appeared white went against a Louisiana law that requires separate accommodations for separate races. Homer Plessy was a member of a group in New Orleans known as the Citizens Committee that fought for the equal right of the African American citizen. The Citizens Committee decided to test a Louisiana Law known as the 1890 Louisiana Separate Car Act. When Homer Plessy entered the train and took accommodations in the white section of the railcars he was detained by a police officer and held in a separate car until he was arrested upon exiting the train. Plessy was charged with breaching Louisiana Law and was jailed and fined.
On appeal the Louisiana Appeals Court ruled declared forced segregation in railroad cars traveling between states to be unconstitutional (Wolf, 2011). The case was then appealed to the Louisiana Supreme Court that upheld the ruling of the district court and found the state had a right to establish laws that provide separate but equal accommodations. The case was then appealed for the last time when it went in front of the Supreme Court. The Supreme Court ruled in favor of the state and the laws concerning the segregation of the White and African American citizen was not addressed for over sixty years when the Supreme Courts ruling was reversed in the case of Brown vs. Board of Education.
When the Plessy case was brought in front of the Supreme Court by the defendant and the members of the Citizens Committee the claim was the defendant was denied his Fourteenth and Thirteenth Amendment rights. Plessy claimed that the 1890 Louisiana Separate Car Act violated his Thirteenth Amendment right against involuntary servitude. In other Plessy was claiming that by being forced into separate accommodations he was being placed in involuntary servitude. The court ruled that the Thirteenth Amendment did not apply to segregation so the defendants Thirteenth Amendment right could not have been violated.
Under the Fourteenth Amendment the defendant, Plessy, claimed he was denied the right to equal protection.

Why or why not? 2. How much of the trial attorney's efforts was negotiations? 3. What public relations efforts were undertaken? To what effect? Solution 1. Criminal trial of O. J. Simpson is one of the best examples of effective persuasion skills. Despite of strong evidence against him, his attorney was able to persuade the jury regarding his innocence . They converted this trial from murder case to a racial conspiracy . Even, the defense team of O. J. Simpson has proved that the investigating detectives were allegedly trying to frame him in the murder charges . 2. Trial attorney’s efforts were depended on total negotiations. Families of both of her wives had sued him for damages having a total worth of $40 million. 3. During the trial, entire media channels including the broadcast, print and electronic media was covering the story. Defense attorney of O. J. Simpson have successfully converted the murder trial into a racial conspiracy using public relations . They were able to gain the sympathy and support of black Americans. Public relation has influenced the neutrality of the case. Due to these reasons, O. J. Simpson was freed from the murder charges. Hence, it is concluded that public relations played a very critical role in this case.
