71 out of 218 survey
respondents still
answered “Jack Daniels”
in response to one or
more of the four “Ever-

(or 30%) believed there
was a business affiliation
or connection between the
two

4 out of 62 Respondents
(or 6%) believed there was

21. Respondents Really Focused on Visual Similarities…
21
• “Because it looks exactly like a
bottle of Jack Daniels!”
• “Looks quite similar”
• “The way it looks like a bottle
of whiskey”
• “The toy is shaped and has
similar characteristics as the
original Jack Daniels whiskey
bottle.”
22. So, What Are The Takeaways Here?
22
1. The “disclaimer” appears to have significantly
decreased the number of consumers that believed
Bad Spaniels needed “authorization or approval.”
(37% vs. 7%)
2. But, the “disclaimer” appears to have significantly
increased the number of consumers that,
nevertheless, believed there was a business
“affiliation or connection” between the two
companies. (6% vs. 30%)
3. Thus, the overall “net confusion” numbers stayed
consistent at around 30%. (29% vs. 33%)
