MINIMUM RATE OF WAGE:

The Act is being implemented by the Central & State Government , & such as both are empowered to frame rules.
Minimum rate of the wages fixed or revised consists of the following:-
a basic rate of wages & a special allowance i.e. cost of living allowance;
a basic rate of wages with or without cost of living allowance & cash value of supplies of essential commodities;
an all inclusive rate, i.e. basic rate, cost of living allowance & cash value of concessions.
The Government may fix the minimum rates of wages either by the hour, day, month or by such large wage-period as may be prescribed which may be revised at intervals & reviewed, if felt necessary.

- 2. INTRODUCTION The object of this act is to secure the welfare of the workers in a competitive market by fixing the Minimum rates of wages in certain employment
- 3. WHAT IS MINIMUM WAGE There is a minimum wage which in a any event must be paid, irrespective of the extent of profits, the financial condition of the establishment or the availability of workmen on lower wage. The minimum wage is independent of the kind of industry and applies to all alike, big or small. It sets the lowest limit below which wages cannot be allowed to sink in all humanity.
- 4. Basis of Wage Computation • [Sec-2(d)] defines Cost of living index Number for computation of Wages. • It continents index in relation to employees having any scheduled employment in respect of which minimum rates of wages have to be fixed. • The index number ascertained and declared to be the cost of living index number applicable to employees in such employment.
- 5. Employer [Sec-2(e)] Employs Whether directly or though another person Whether on behalf of himself or any other person One or more employee in any scheduled employment In respect of which minimum rates of wages have been fixed under the act
- 6. Scheduled Employment [Sec.2(g)] An employment specified in the scheduled OR Any process or branch of work forming part of such employment . This contains list of all those employment for which minimum wage are to be fixed by the appropriate government .
- 7. Part-1:Non Agriculture Employment Employment, in woolen carpet making or shawl weaving etc Employment in any Rice / Flour or Dal mills or Bidi, Oil, Tea, Coffee, Rubber, Stone, Glass Industry etc. Employment under any local authority. Part-2: Agriculture Employment • Employment in agriculture, horticulture, poultry, dairy farming etc. • Employment in cleaning and sorting of onions and other incidental work.
- 8. Wages:[2(h)] All remuneration Capable of being in terms of money If the term of contract of employment, express or implied Be payable to a person Employed in respect of his employment Or of work done in such employment
- 9. Employee:[2(i)] Who is employed for hire or reward To do any work Skilled or unskilled Manual or clerical In scheduled employment, In respect of which Minimum wages have been fixed.
- 10. Appropriate government [2(b)] The Central Government :- in a relation to any scheduled employment carried on by under the authority of the central government. i.e Railway , Coal Mines, Oil-filed, Major port, and any corporation established by a CG. • The State Government :- Any other scheduled employment cover under the authority of respective state government. i.e • Education , Medical, Ruler Development .
- 11. Fixing Of Minimum Rates Of Wages section:3 Employee category :- skilled, unskilled, clerical, supervisor. Revision period :- once in a interval of five year Wages payable as per scheduled specified by appropriate government (CG/SG) Section enforced on an organisation having above 1000 employees
- 12. Composition Of Minimum Rates Of Wages Section-4 Wages = basic + cost of living allowance + cash value of concession. Concession and allowance shall be computed by competent authority. Important case laws:- Bhopal textile ltd v/s State of MP Hydro(Engineers) Pvt Ltd v/s Workmen
- 13. Procedure For Fixing And Revising Minimum Wages Section-5 Method :- 1) By appointment of committee 2) Notification by government Appointment of Committee and advisory boards by appropriate government. Member of committee equally representing employer and employee. One third of total members shall be independent person.
