VIETNAM - WIND ENERGY BREAKING NEWS - FEED IN TARIFF COULD BE EXTENDED - WHAT...Dr. Oliver Massmann
The Vietnamese Ministry of Industry and Trade has proposed extending the feed-in tariff (FIT) scheme for wind power projects until the end of 2023. The proposal would set a new FIT price for projects commencing operations after November 2021. It also plans to transition to a competitive tender process for wind power after 2023 due to predicted power shortages in Southern Vietnam between 2021 and 2025. If approved, the extended FIT scheme would provide lucrative opportunities for wind power investors in Vietnam over the next few years.

This document summarizes a Congressional Budget Office report projecting the costs of U.S. nuclear forces from 2015 to 2024. It estimates that nuclear forces will cost $348 billion over the 10 year period, with the Departments of Defense and Energy spending $227 billion and $121 billion respectively. The largest costs are for ballistic missile submarines at $83 billion, intercontinental ballistic missiles at $26 billion, and bombers at $40 billion. Costs are projected to grow beyond original budget estimates by $49 billion over the period.
The memorandum provides background on the US Department of Transportation's updated guidance recommending $5.8 million as the statistical economic value for preventing a human fatality. This is a substantial increase from the previous value of $3 million from 2002. It notes that while states are not required to use this estimate, the DOT prepared it specifically for its own regulatory and investment analyses. It also indicates that the agency is reviewing the information and plans to update its 1994 technical advisory on accident costs to reflect the new figures. Contact information is provided for additional details.
The document discusses the key aspects of the government budgeting process in India. It explains that the annual financial statement must be presented to Parliament before the start of each fiscal year. The budget consists of actual data from the previous year, provisional data for the current year, and estimates for the following year. The budget includes revenue and capital budgets. It goes through several stages - preparation, enactment through Parliament, and then execution. During an election year, a temporary vote on account may be taken before the full budget is passed.
The document summarizes the current status of Illinois pension reform. Three bills are under consideration but none have passed both legislative houses. A legislative conference committee was established to find a compromise. The committee held public meetings on June 30, July 3, and July 8. It requested an actuarial analysis of the SURS reform plan, which could serve as a template. The committee will not meet the July 9 deadline set by Governor Quinn due to needing time for analysis, but it is expected the governor will set a new deadline. The committee may announce a proposal on its own timeline or fail to reach agreement, requiring a new committee.
Turkey is seeking to increase its domestic energy production and reduce its energy import dependency through expanding its use of nuclear energy. The Congressional Budget Office presentation summarizes approaches to reduce federal spending on the Defense Health System. Military health care costs have risen significantly and are projected to account for over 16% of the DoD budget by 2030. TRICARE beneficiaries now pay less out-of-pocket than civilian counterparts. Options to slow cost growth include increasing fees and copayments for retirees or preventing enrollment in prime plans. These could save billions annually. Smaller approaches like disease management and auditing fraud may only save around $100 million each year.
HIA - how the carbon tax will apply to residential buildingJosh Develop
The carbon tax will impact residential building by increasing costs. Once passed, facilities emitting over 25,000 tons of carbon dioxide annually will pay $23-25 per ton from 2012-2015. For others, the tax will be embedded in electricity, gas, and materials like steel and cement. Modeling estimates the tax will increase the cost of an average new home by $5,000 to $6,000, or 1.2-1.4%. A final analysis of cost increases for specific materials will be available within two weeks. Builders should factor increased material costs into projects spanning the tax's implementation.

VIETNAM - SOLAR POWER - KEY POLICY NEWS - What you must know:Dr. Oliver Massmann
Vietnam is updating its solar power policies, including Feed-in Tariff (FiT) rates and project approvals. The Ministry of Industry and Trade issued documents that would significantly limit projects eligible for the higher FiT2 rate and suspend new project approvals. Only a small number of projects already approved but not yet operational would qualify for FiT2 under the narrow definition of "under construction". Electricity of Vietnam has also issued guidance on temporary tariff rates for projects reaching completion after June 2019 pending further policy developments.

After more than two years of consultation, Vietnam's Power Development Plan VIII (PDP8) was approved on May 15, 2023, which will guide Vietnam's development of green energies and objective of reaching net-zero emissions by 2050. The PDP8 will influence the adoption of green energy technologies for both industrial and non-industrial applications. The total investment outlined in the PDP8 for energy development from 2021 to 2030 is $134.7 billion.
VIETNAM - Legal alert on the development of the Implementation Plan of the Po...Dr. Oliver Massmann
The Energy Institute delivered a letter to the Ministry of Industry and Trade regarding the development of the Implementation Plan for Vietnam's Power Development Plan VIII (PDP 8). The letter notes that more time is needed to develop the Implementation Plan, as the PDP 8 only outlines targets for 2030 and 2050, while the Implementation Plan requires detailed goals and projections over the entire planning period. Developing these specific goals requires significant data collection and human resources. As a result, the Energy Institute concludes it is not possible to issue the Implementation Plan by June as requested, and recommends pushing the deadline back to August or October to allow sufficient time for proper development of the plan.
The document summarizes key legal issues regarding Indonesia's plan to develop 35,000 MW of power generation capacity. It notes that only 50,000 MW was developed in the past 70 years of independence. It outlines the legal basis for the 35,000 MW plan and electricity demand projections. It discusses the potential for private investment and various procurement methods. It also examines underwriting approaches, common legal disputes around land acquisition and pricing, and acknowledges that the 2019 target is unlikely to be met due to delays in land issues and site determination.
VIETNAM – MOIT PROPOSES NEW FIT RATE FOR WIND POWER PROJECTSDr. Oliver Massmann
The Ministry of Industry and Trade in Vietnam has proposed new feed-in tariff (FiT) rates for wind power projects in the country. Projects reaching commercial operation between November 2021 and December 2022 would receive a FiT rate of 7.02 cents/kWh for onshore and 8.47 cents/kWh for offshore. Projects starting in 2023 would receive slightly lower rates of 6.81 cents/kWh and 8.21 cents/kWh respectively. Additionally, the proposal extends the deadline for the current FiT rates from November 2021 to December 2023 to accommodate projects that were delayed in being added to the national power development plan.
VIETNAM – MOIT PROPOSES EXTENSION OF CURRENT FiT RATE FOR WIND POWER PROJECTSDr. Oliver Massmann
The Ministry of Industry and Trade in Vietnam has proposed extending the current feed-in tariff (FiT) rate for wind power projects until December 2023. This is due to expected power shortages starting in 2023 if renewable energy development is not accelerated. Many thermal power projects are delayed by 1-2 years or more. Extending the FiT is important because wind power projects require over a year of wind measurements and face delays in importing turbines from abroad. Renewable energy development could help address power shortages in the near term in an environmentally friendly manner.
The Ministry of Industry and Trade in Vietnam has proposed updates to the country's Power Development Plan 8 (PDP 8) regarding solar and liquefied natural gas (LNG) power. For solar, the Ministry proposes continuing projects totaling 452.62MW already under construction and approving projects totaling 1,975.8MW that have been planned but not started yet by 2030. Projects totaling 4,136.25MW that are planned but not approved would be pushed back after 2030. For LNG, the Ministry affirms the need for the 23,900MW of LNG projects planned by 2030 in PDP 8 and proposes increasing LNG import targets to 14-18 billion cubic meters by 20
VIETNAM – ENERGY – LNG AND POWER DEVELOPMENT PLAN 8 - PDP 8 – LATEST UPDATESDr. Oliver Massmann
The Vietnamese government views LNG as a desirable transition fuel to comply with its commitment to zero emissions by 2050. The draft Power Development Plan 8 (PDP8) sets Vietnam's LNG imports at 23,900 MW, equivalent to 16.4% of total power sources by 2030. This is a higher amount than outlined in Resolution 55 but the Ministry of Industry and Trade has replaced some coal power with LNG and renewables. Most of the 23,900 MW of LNG in PDP8 is from projects already approved in PDP7 with additional capacity planned for northern Vietnam. No LNG-to-power plants or infrastructure projects have been cancelled, though some have faced delays in financing. The Prime Minister
VIETNAM – MOIT IS REVIEWING NEW FEED IN TARIFFS (FiTs) FOR WIND POWER PROJECTSDr. Oliver Massmann
The Vietnamese government is reviewing new feed-in tariffs (FiTs) for wind power projects. Several provincial governments have proposed extending the current FiTs, which are set to expire in November 2021, due to delays from the COVID-19 pandemic. The current FiTs pay VND 1,928/kWh for onshore wind and VND 2,223/kWh for offshore wind. The Ministry of Industry and Trade has proposed extending the deadline to December 2023 and applying an auction system after that date. Extending the FiTs is important because wind power projects require over a year of feasibility studies and turbine imports have been delayed by the global pandemic.
Vietnam has significant natural gas reserves and is seeking to increase investment in liquefied natural gas (LNG) infrastructure to meet its growing energy needs and transition to cleaner sources of energy. The government has set targets to increase gas and oil in the energy mix and import between 1 to 10 billion cubic meters of LNG annually by 2035 through new LNG terminals, pipelines, and gas-fired power plants. Foreign investors can own up to 100% of LNG projects in Vietnam and benefit from various tax incentives. However, the legal and regulatory framework is still developing, and projects require navigating several approval processes across development, construction, and operation.

The Prime Minister of Vietnam approved the Plan for Implementation of the National Power Development Plan to 2030 (PDP8) on April 1, 2024. The Implementation Plan sets specific tasks and timelines for government ministries to execute PDP8 through 2025. It maintains planned capacity targets for power generation projects such as gas, coal, and hydropower. However, it does not provide guidelines to address issues like project bankability and feed-in tariffs. The Implementation Plan also lists onshore wind and solar power projects and targets, while prioritizing the development of relevant legal frameworks through 2025 to fully implement PDP8 by 2030.
VIETNAM - THE NEW LAW ON CREDIT INSTITUTIONS - WHAT YOU MUST KNOW:Dr. Oliver Massmann
The National Assembly of Vietnam passed a new Law on Credit Institutions that takes effect on July 1, 2024. The objectives of the new law are to strengthen the resilience of the banking system, increase the independence and accountability of credit institutions, and improve oversight of the banking industry. Key changes include new rules around cross-ownership in commercial banks, managing bad debts, and providing a legal framework for digital banking. These regulations are intended to further develop Vietnam's market infrastructure and move the country closer to emerging market status. However, Vietnam remains a frontier market, and guidance on the new law could focus more on ensuring availability of information and streamlined processes to set up investment accounts to help Vietnam achieve emerging market status sooner. Lifting the Corporate Veil. Power Point Presentationseri bangash
"Lifting the Corporate Veil" is a legal concept that refers to the judicial act of disregarding the separate legal personality of a corporation or limited liability company (LLC). Normally, a corporation is considered a legal entity separate from its shareholders or members, meaning that the personal assets of shareholders or members are protected from the liabilities of the corporation. However, there are certain situations where courts may decide to "pierce" or "lift" the corporate veil, holding shareholders or members personally liable for the debts or actions of the corporation.
Here are some common scenarios in which courts might lift the corporate veil:
Fraud or Illegality: If shareholders or members use the corporate structure to perpetrate fraud, evade legal obligations, or engage in illegal activities, courts may disregard the corporate entity and hold those individuals personally liable.
Undercapitalization: If a corporation is formed with insufficient capital to conduct its intended business and meet its foreseeable liabilities, and this lack of capitalization results in harm to creditors or other parties, courts may lift the corporate veil to hold shareholders or members liable.
Failure to Observe Corporate Formalities: Corporations and LLCs are required to observe certain formalities, such as holding regular meetings, maintaining separate financial records, and avoiding commingling of personal and corporate assets. If these formalities are not observed and the corporate structure is used as a mere façade, courts may disregard the corporate entity.
Alter Ego: If there is such a unity of interest and ownership between the corporation and its shareholders or members that the separate personalities of the corporation and the individuals no longer exist, courts may treat the corporation as the alter ego of its owners and hold them personally liable.
Group Enterprises: In some cases, where multiple corporations are closely related or form part of a single economic unit, courts may pierce the corporate veil to achieve equity, particularly if one corporation's actions harm creditors or other stakeholders and the corporate structure is being used to shield culpable parties from liability.

VIETNAM - SOLAR POWER BREAKING NEWS – EXTENSION PROPOSAL BY MINISTRY OF PLANNING AND INVESTMENT OF DEADLINE FOR FEED IN TARIFF REJECTED – WHAT YOU MUST KNOW
1. VIETNAM - SOLAR POWER BREAKING NEWS – EXTENSION PROPOSAL BY
MINISTRY OF PLANNING AND INVESTMENT OF DEADLINE FOR FEED IN
TARIFF REJECTED – WHAT YOU MUST KNOW
Last June, the whole solar energy industry rocked (and became excited!) with the news that the
Deputy Prime Minister, in one of his meetings with the Ministry of Industry and Trade (MOIT)
on 20 June 2018, has agreed in principle that the COD extension for solar energy projects under
the Decision 11 shall be extended beyond the original deadline of 30 June 2019. According to
Vietnam's political tradition, this development would normally mean the subsequent issuance of
official legislation to formalize the decision. One source infomed the market players that the
decision for extension would first be issued by end of July for Ninh Thuan projects due to the
province's economic downturn, and by the end of this year, a decision to extend nationwide will
follow. On 4 July 2018, the Ministry of Planning and Investment (MPI), in coordination with the
MOIT, submitted an official letter No. 4545 (Letter 4545) to the Prime Minister to formally
propose the COD extension. That letter 4545 was addressing Ninh Thuan solar energy projects
only but market players expected that proposal for nationwide extension would follow very soon.
However, in a rare and unpredictable move, on 26 July 2018, the Government's Office issued an
Official Letter No. 7108 (Letter 7108) to reject the proposal for COD extension for Ninh Thuan
solar energy projects, without mentioning any rationale behind it or any reference to the Deputy
Prime Minister's in-principle agreement with the MOIT. That means, as a result of Letter 7108,
everything under Decision 11 would stay the same, at least for Ninh Thuan solar energy projects.
What remains unclear is whether the MOIT/MPI would continue pushing for a nationwide COD
extension, amidst the Letter 7108. One source continues insisting that such a nationwide COD
extension (which was planned to go through by end of 2018) is still reviewed by the Prime
Minister. From the IPP's perspectives, it is understandably viewed as a 50/50 decision. A high-
yielder would continue go for bigger projects with hope that nationwide COD extension will take
place, while others may choose to go with smaller one to ensure the construction time to be
secured.
We will keep our clients updated on the development of this saga. Time is of essence now yet
everything is still up in the air. For prudent reasons, we would have to advise IPPs to go with
smaller projects now for the purpose of plausible construction time. We can help introducing
such projects.
