Il workshop
L’incontro si inserisce in una serie di iniziative che l’Amministrazione comunale sta promuovendo nell’ambito del processo di formazione del nuovo Piano Regolatore Generale. Durante il workshop sono state illustrate le metodologie e le tecniche innovative, basate sull’analisi e l’elaborazione di dati satellitari, utilizzate per la produzione del quadro conoscitivo geospaziale del territorio comunale e per la determinazione degli indicatori ambientali adottati nella Valutazione Ambientale Strategica (VAS) del PRG.
Il Rapporto ambientale preliminare è il primo passo della procedura di Valutazione ambientale strategica sul nuovo Piano regolatore generale di Pordenone, in corso di elaborazione.
Il documento, elaborato dagli ingegneri Germana Bodi e Chiara Ghirardo, tiene conto del Documento di sintesi del nuovo Prgc, delle Direttive, degli obiettivi generali di Piano e degli scenari per lo sviluppo e la valorizzazione del territorio.
Questo documento servirà ora all'amministrazione comunale per entrare in consultazione con gli enti competenti in materia ambientale, nel rispetto della normativa, in modo da definire la portata e il livello di dettaglio delle informazioni da includere nel successivo Rapporto ambientale.

ex art. 5, co. 1, lett. a) d.lgs. 152/2006 la VAS è:
“il processo che comprende, secondo le disposizioni di cui al titolo II della
seconda parte del presente decreto, lo svolgimento di una verifica di
assoggettabilità, l'elaborazione del rapporto ambientale, lo svolgimento di
consultazioni, la valutazione del piano o del programma, del rapporto e
degli esiti delle consultazioni, l'espressione di un parere motivato,
l'informazione sulla decisione ed il monitoraggio”

4. QUALI ASPETTI DEVONO ESSERE VALUTATI?

La valutazione ambientale di piani, programmi e progetti ha la finalità di
assicurare che l'attività antropica sia compatibile con le condizioni per uno
sviluppo sostenibile, e quindi nel rispetto della capacità rigenerativa degli
ecosistemi e delle risorse, della salvaguardia della biodiversità e di un'equa
distribuzione dei vantaggi connessi all'attività economica. Per mezzo della
stessa si affronta la determinazione della valutazione preventiva integrata degli
impatti ambientali nello svolgimento delle attività normative e amministrative, di
informazione ambientale, di pianificazione e programmazione.

limitata alla valutazione degli aspetti ambientali, senza prendere in

7. “PICCOLE AREE A LIVELLO LOCALE”
Corte Giustizia UE sent. 21.12.2016 causa C-444/15
mediante l’impiego dell’espressione «piccole aree a livello locale», da un lato, il
legislatore dell’Unione ha inteso prendere come riferimento l’ambito territoriale
di competenza dell’autorità locale che ha elaborato e/o adottato il piano o il
programma interessato. Dall’altro lato, dato che il criterio dell’uso di «piccole
aree» deve essere soddisfatto in aggiunta a quello della determinazione a
livello locale, l’area interessata deve costituire, proporzionalmente a detto
ambito territoriale, un’estensione minima.

8. QUALI “PIANI E PROGRAMMI”?
Sicuramente gli atti di pianificazione generale del territorio.
Occorrono invece alcune precisazioni circa:

9. PIANI PAESAGGISTICI
Dalla circostanza che i sono soggetti a VAS “I piani e i programmi che
possono avere impatti significativi sull'ambiente e sul patrimonio culturale”,
senza che vi sia riferimento agli effetti “negativi” è sorto un notevole contrasto
in giurisprudenza.
Dopo un contrasto l’orientamento che va consolidandosi è quello di CGARS
21.1.2015, n. 36: i piani paesaggistici “puri” non sono oggetto di VAS,
diversamente dai piani urbanistico-territoriali, ribadito di recente anche da TAR ,
Palermo Sez. I n.2179 del 18 settembre 2017.

10. VARIANTI AL PRG e STRUMENTI ATTUATIVI
Il criterio è quello della natura di modifica “minore” o meno della variante
rispetto al PRG.
Modifica “minore”: necessità di VERIFICA DI ASSOGGETTABILITA’, dal cui
esito dipende la necessità di VAS o meno.
Modifica “non minore”: necessità di VAS.

11. TAR Lombardia, Mi, Sez. II, 14.3.2011, n. 730
“si sostiene l’illegittimità della variante per mancata sottoposizione alla procedura
di valutazione ambientale strategica (VAS) …”
“la circostanza che la variante di cui è causa ha apportato modifiche assai
limitate al PRG vigente, limitandosi – (…) – alla riparametrazione della zona
interessata, ad una nuova collocazione delle aree a standard ed al
chiarimento di alcuni articoli delle NTA. (…) quindi, di un intervento che non
incide su fondamentali valori ambientali, e come tale non certo necessitante di
una procedura di VAS, la ratio della quale è quella di valutare preventivamente
l’impatto ambientale dei soli piani e programmi in grado di incidere in misura
significativa sul territorio. (…)
Ciò premesso, l’attivazione della rituale procedura di VAS avrebbe dato luogo
soltanto ad un aggravio inutile del procedimento, in contrasto con fondamentali
esigenze di celerità ed economicità dell’azione amministrativa.

12. SOGGETTI:
autorità procedente ed autorità competente
Autorità procedente è quella preposta all’approvazione del piano
Autorità competente è quella preposta alla tutela dell’ambiente e, quindi, a
provvedere in materia di VAS
E’ stato dibattuto se per “autorità” debba intendersi “Amministrazione” o se le
due “autorità” possano far parte della medesima Amministrazione.

13. Al dibattito ha posto termine la Corte di Giustizia UE, con la sentenza
20.10.2014, n. 474
“tale disposizione non impone che sia creata o designata un’altra autorità
consultiva ai sensi di tale disposizione, purché, in seno all’autorità
normalmente incaricata di procedere alla consultazione in materia
ambientale e designata a tal fine, sia organizzata una separazione
funzionale in modo tale che un’entità amministrativa, interna a tale
autorità, disponga di un’autonomia reale, la quale implichi, segnatamente,
che essa abbia a disposizione mezzi amministrativi e risorse umane propri, e
sia in tal modo in grado di svolgere i compiti attribuiti alle autorità consultive ai
sensi dell’art. 6, n. 3, di tale direttiva e, in particolare, di fornire in modo
oggettivo il proprio parere sul piano o programma previsto dall’autorità dalla
quale essa promana.

14. PROCEDIMENTO DI VAS
• art. 11 co. 1
La VAS deve essere avviata dall’autorità procedente “contestualmente”
contestualmente al “processo di formazione” del piano
• art. 11 co. 5
Costituisce “parte integrante del procedimento di adozione ed
approvazione”.
La sua carenza è fonte di annullabilità.

15. FASI DEL PROCEDIMENTO
• verifica di assoggettabilità, per le ipotesi di VAS non obbligatoria, che
può concludersi negativamente (con eventuali prescrizioni) o positivamente
(con “rinvio a VAS”);
• redazione del rapporto ambientale da parte dell’Aut. Procedente;
• comunicazione della proposta di piano alla Aut. Competente;
• consultazione del pubblico ed eventuali osservazioni
• valutazione del rapporto ambientale e degli esiti della consultazione con
parere motivato

16. provvedimento obbligatorio con eventuali osservazioni e condizioni che
conclude la fase di valutazione di VAS, espresso dall'autorità competente
sulla base dell'istruttoria svolta e degli esiti delle consultazioni

17. Art. 17
La decisione finale è pubblicata sui siti web delle autorità interessate indicando
la sede ove si possa prendere visione del piano o programma adottato e di
tutta la documentazione oggetto dell'istruttoria. Sono inoltre rese pubbliche,
attraverso la pubblicazione sui siti web della autorità interessate:
a) il parere motivato espresso dall'autorità competente;
b) una dichiarazione di sintesi in cui si illustra in che modo le considerazioni
ambientali sono state integrate nel piano o programma e come si è tenuto
conto del rapporto ambientale e degli esiti delle consultazioni, nonché le
ragioni per le quali è stato scelto il piano o il programma adottato, alla luce
delle alternative possibili che erano state individuate;
c) le misure adottate in merito al monitoraggio di cui all'articolo 18.

18. Art. 18 - Monitoraggio
1. Il monitoraggio assicura il controllo sugli impatti significativi sull'ambiente derivanti
dall'attuazione dei piani e dei programmi approvati e la verifica del raggiungimento degli
obiettivi di sostenibilità prefissati, così da individuare tempestivamente gli impatti negativi
imprevisti e da adottare le opportune misure correttive. Il monitoraggio è effettuato
dall'Autorità procedente in collaborazione con l'Autorità competente anche avvalendosi
del sistema delle Agenzie ambientali e dell'Istituto Superiore per la Protezione e la
Ricerca Ambientale.
2. Il piano o programma individua le responsabilità e la sussistenza delle le risorse
necessarie per la realizzazione e gestione del monitoraggio.
3. Delle modalità di svolgimento del monitoraggio, dei risultati e delle eventuali misure
correttive adottate ai sensi del comma 1 è data adeguata informazione attraverso i siti
web dell'autorità competente e dell'autorità procedente e delle Agenzie interessate.
4. Le informazioni raccolte attraverso il monitoraggio sono tenute in conto nel
caso di
eventuali modifiche al piano o programma e comunque sempre incluse nel quadro
conoscitivo dei successivi atti di pianificazione o programmazione.

19. NORME REGIONALI IN MATERIA DI VAS
In base all’articolo 7 le Regioni con proprie leggi e regolamenti:
• disciplinano le proprie competenze e quelle degli enti locali;
• individuano l’autorità competente sulle procedure di VIA e VAS nonché le
regole procedurali per il rilascio del parere motivato di VAS e dei provvedimenti
di VIA;
• individuano i criteri per la partecipazione al procedimento dei soggetti
competenti in materia ambientale e delle Regioni e Province autonome
confinanti
• definiscono, compatibilmente con la normativa comunitaria e nazionale,
ulteriori modalità per l’individuazione dei piani e programmi o progetti da
sottoporre a VAS e VIA.
