Task 9
1. TASK 9 :
Legal issues regarding sampling
Sampling has been an area of contention from a legal
perspective. Early sampling artists simply used portions
of other artists' recordings, without permission; once rap
and other music incorporating samples began to make
significant money, the original artists began to take legal
action, claiming copyright infringement. DespiteThe
XX’s lack of use of sampling they are still featured in
many other songs with the most famous being the
sample ofThe XX's "Intro" on a track called "Drunk on
Love" on her album TalkThatTalk.
2. “Copyright infringement is the unauthorized
use of works under copyright, infringing the
copyright holder's "exclusive rights", such as
the right to reproduce, distribute, display or
perform the copyrighted work, spread the
information contained within copyrighted
works, or to make derivative works.”

Task 9 :
Legal quote regarding copyright
3. This album cover emphasises the way in which
the band feel towards equality. Ethically the
band are very conscious in promoting equality
and believe that two very different things can
“coexist” to make something more beautiful
than themselves alone.
Task 9 :
Ethical elements
4. Task 9 :
Ethical elements (possible impact on audience)
In the coexist album there is no controversial content present.Which is an
extreme contrast to most music present in today's charts. There would be
very few negative impacts on the audience with no slander spread in the
coexist album, along with very few obscenities and elements of such a
nature, which are found in most music.
Thus abiding by the Obscenity Law which governs the limits of
acceptable representations in published products.
OBSCENITY LAW:
“Since 1857, a series of obscenity laws known as the Obscene Publications
Acts have governed what can be published in England and Wales. The classic
definition of criminal obscenity is if it "tends to deprave and corrupt," stated in
1868 by John Duke Coleridge, 1st Baron Coleridge”
5. Task 9 :
Ethical elements (possible impact on audience)
An example of a song in which ethical elements have a negative effect on the
audience is the song Nightmare– Avenged Sevenfold. This song promotes unlawful
acts of an extreme nature within it’s lyrics. People have complained about the nature
of the band with an example of one complaint below:
“I bought these tickets (2011) as an anniversary gift to my husband because we met at aThree Days Grace concert (1 Mar 2010).
3DG was great!
I had just had a baby, he was only 7 weeks old, andA7X put on a performance with a man hanging, committing suicide, for the
Nightmare song, it was really sick and twisted and I couldn't get over it.You can call me a prude, but it was disgusting. I think
Nightmare is the only song I like from them, anyways. I know die hard fans will disagree with my opinion on their skit, but I'm
entitled to my opinions...”
