Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Creative operations teams expect increased AI use in 2024. Currently, over half of tasks are not AI-enabled, but this is expected to decrease in the coming year. ChatGPT is the most popular AI tool currently. Business leaders are more actively exploring AI benefits than individual contributors. Most respondents do not believe AI will impact workforce size in 2024. However, some inhibitions still exist around AI accuracy and lack of understanding. Creatives primarily want to use AI to save time on mundane tasks and boost productivity.
Organizational culture includes values, norms, systems, symbols, language, assumptions, beliefs, and habits that influence employee behaviors and how people interpret those behaviors. It is important because culture can help or hinder a company's success. Some key aspects of Netflix's culture that help it achieve results include hiring smartly so every position has stars, focusing on attitude over just aptitude, and having a strict policy against peacocks, whiners, and jerks.

I. OBIECŢIILE PRELIMINARE ALE GUVERNULUI
A. Statutul de „victimă" al reclamantului
33. Ca primă obiecţiune, guvernul a susţinut - aşa cum a procedat şi în faţa Comisiei - că
reclamantul nu se mai putea pretinde o „victimă" a încălcării Convenţiei în înţelesul articolului
34. Guvernul a afirmat că reclamantul a cîştigat în faţa Curţii de Apel întrucît, prin hotărîrea din
25 noiembrie 1997, această instanţă a declarat nule informaţiile cuprinse în scrisoarea din 19
decembrie 1990 a Serviciului Român de Informaţii (SRI), iar în opinia guvernului, singura
încălcare a drepturilor reclamantului decurgea din această scrisoare.
Guvernul a continuat afirmînd că, oricum, reclamantul avea acum la dispoziţie procedura
prevăzută de Legea nr.187 din 20 octombrie 1999, care îi oferea toate garanţiile cerute de
Convenţie pentru protejarea drepturilor sale.
34. Reclamantul a solicitat Curţii să continue examinarea cauzei. El a argumentat că
circumstanţele care au stat la baza plîngerii sale nu s-au schimbat în mod substanţial prin
hotărîrea din 25 noiembrie 1997. În primul rînd, simpla recunoaştere, survenită după decizia de
admisibilitate a Comisiei, a faptului că s-a produs o greşeală nu constituie un remediu adecvat
pentru încălcarea Convenţiei. În al doilea rînd, reclamantul a arătat că încă nu are acces la
dosarul său secret, care nu numai că a fost depozitat de SRI, ci a fost chiar folosit de această
instituţie. De aceea, nu se poate exclude faptul că şi după hotărîrea din 25 noiembrie 1997, SRI
poate folosi informaţia potrivit căreia reclamantul ar fi fost legionar, precum şi restul
informaţiilor din acel dosar.
35. Cu privire la conceptul de „victimă", Curtea reaminteşte că în anumite condiţii, o
persoană poate susţine că este victima unei încălcări datorate exclusiv existenţei unor măsuri
secrete ori unei legislaţii care permite luarea unor măsuri secrete fără a fi necesar să arate că
astfel de măsuri au fost în fapt aplicate în cazul său (vezi Klass şi alţii versus Germania,
hotărîrea din 6 septembrie 1978...). De asemenea, „o decizie ori o măsură favorabilă
reclamantului nu este suficientă în principiu pentru a-i retrage calitatea de «victimă», decît dacă
autorităţile naţionale au recunoscut încălcarea Convenţiei în mod explicit prin măsuri de fond şi
au reparat-o" (vezi Amuur versus Franţa, hotărîrea din 25 iunie 1996...).
36. În cazul de faţă, Curtea observă că reclamantul s-a plîns împotriva deţinerii unor
documente secrete care conţineau informaţii despre el şi a căror existenţă a fost făcută publică în
cursul unor proceduri judiciare. Pe această bază, Curtea consideră că reclamantul poate susţine
că a fost victima unei încălcări a Convenţiei.
De asemenea, Curtea observă că prin hotărîrea din 25 noiembrie 1997, Curtea de Apel
Bucureşti a constatat că detaliile din scrisoarea din 19 decembrie 1990 [a SRI] privind afirmaţiile
potrivit cărora reclamantul fusese legionar erau false şi probabil se refereau la o altă persoană cu
acelaşi nume, fiind declarate nule de către instanţă.
Presupunînd că hotărîrea Curţii de Apel a oferit reclamantului, într-o anumită măsură,
reparaţii pentru existenţa în dosarul său [de securitate] a unor informaţii care s-au dovedit a fi
false, Curtea consideră că această reparaţie este numai parţială şi, în orice caz, conform propriei
jurisprudenţe, este insuficientă pentru a-l lipsi de statutul de „victimă". Separat de aceste
argumente în favoarea calităţii sale de „victimă” ca urmare a deţinerii [de către SRI] a unui dosar
secret, Curtea invocă în particular şi următoarele elemente.
Se pare că informaţia potrivit căreia reclamantul a fost legionar se află încă în arhivele SRI
şi în dosarul respectiv nu s-a operat nici o menţiune despre hotărîrea din 25 noiembrie 1997. Mai
mult, Curtea de Apel nu a exprimat nici o opinie - şi nu avea puterea să o facă - privind faptul că
SRI era autorizat de legea română să deţină şi să folosească dosarele care conţineau informaţii
2. despre reclamant întocmite de fostele servicii de securitate. Un punct-cheie din plîngerea
reclamantului l-a constituit faptul că legislaţia naţională nu prevede cu precizie suficientă
modalitatea în care SRI îşi îndeplineşte sarcinile şi nu oferă cetăţenilor un remediu efectiv în faţa
vreunei autorităţi naţionale.
În final, prin hotărîrea sa din 25 noiembrie 1997, Curtea de Apel Bucureşti nu a dispus cu
privire la cererea reclamantului privind daunele morale şi costurile şi cheltuielile de judecată.
37. În ceea ce priveşte Legea nr.187 din 20 octombrie 1999, invocată de guvern, Curtea
consideră că nu prezintă relevanţă în circumstanţele acestui caz (vezi paragraful 71).
38. Curtea conchide că reclamantul poate susţine că este o „victimă" în sensul articolului 34
al Convenţiei. Prin urmare, obiecţia guvernului se respinge.
B. Epuizarea remediilor interne
39. Guvernul a mai susţinut că plîngerea era inadmisibilă ca urmare a inepuizării remediilor
interne. Guvernul a argumentat că reclamantul avea un remediu pe care nu l-a folosit, respectiv o
acţiune pe baza Decretului nr. 31/1954 privind persoanele fizice şi juridice, pe baza căruia
instanţele puteau dispune orice măsură pentru a repara atingerea adusă reputaţiei unei persoane.
40. Curtea notează că există o legătură strînsă între argumentaţia guvernului sub acest
aspect şi fondul plîngerii reclamantului privind articolul 13 al Convenţiei. În consecinţă,
conexează această obiecţie cu fondul (vezi paragraful 70).
II. ÎNCĂLCAREA RECLAMATĂ A ARTICOLULUI 8
41. Reclamantul s-a plîns că SRI a deţinut şi a fost în măsură să folosească, în orice
moment, informaţii privind viaţa sa privată, iar o parte din aceste informaţii erau false şi
defăimătoare. El a invocat încălcarea articolului 8 al Convenţiei, care prevede:
„1. Orice persoană are dreptul la respectarea vieţii sale private şi de familie, a
domiciliului său şi a corespondenţei sale.
2. Nu este admis amestecul unei autorităţi publice în exercitarea acestui drept decît în
măsura în care acest amestec este prevăzut de lege şi dacă constituie o măsură care, într-o
societate democratică, este necesară pentru securitatea naţională, siguranţa publică, bunăstarea
economică a ţării, apărarea ordinii şi prevenirea faptelor penale, protejarea sănătăţii sau a
moralei, ori protejarea drepturilor şi libertăţilor altora".
A. Aplicabilitatea articolului 8
42. Guvernul a negat că articolul 8 este aplicabil, argumentînd că informaţiile din scrisoarea
SRI din 19 decembrie 1990 nu se refereau la viaţa privată a reclamantului, ci la viaţa sa publică.
Decizînd să se angajeze în activităţi politice şi să publice pamflete, reclamantul a renunţat
implicit la dreptul său la „anonimat", inerent vieţii private. În ceea ce priveşte chestionarea sa de
către poliţie şi cazierul său judiciar, acestea erau informaţii de ordin public.
43. Curtea reaminteşte că deţinerea în arhive secrete a unor informaţii privind viaţa privată
a unei persoane şi folosirea lor publică intră sub jurisdicţia articolului 8 paragraful l (vezi
Leander versus Suedia, hotărîrea din 16 decembrie 1992... şi Halford versus Regatul Unit,
hotărîrea din 25 iunie 1997...).
Respectarea vieţii private include într-o anumită măsură şi dreptul la stabilirea şi
dezvoltarea relaţiilor interumane; mai mult, nu există nici un motiv de principiu pentru a justifica
excluderea activităţilor profesionale sau de afaceri din noţiunea de „viaţă privată" (vezi Niemietz
versus Germania, hotărîrea din 16 decembrie 1992... şi Halford versus Regatul Unit, hotărîrea
din 25 iunie 1997...).
Curtea a prezentat deja legătura dintre această interpretare largă şi cea a Convenţiei
adoptată de Consiliul Europei la 28 ianuarie 1981 cu privire la Protecţia Persoanelor împotriva
Procesării Automate a Datelor Personale adoptată de Consiliul Europei, care a intrat în vigoare la
l octombrie 1985 şi al cărei scop este de a „.. .asigura... fiecărei persoane... respectarea
drepturilor şi libertăţilor fundamentale şi, în special, dreptul la viaţă privată în contextul
3. procesării automate a datelor personale" (articolul 1); astfel de date personale sunt definite în
articolul 2 ca fiind „orice informaţii referitoare la o persoană identificată sau identificabilă" (vezi
hotărîrea din cazul Amann versus Elveţia...).
Mai mult, informaţiile de natură publică pot face parte din noţiunea de viaţă privată atunci
cînd sunt adunate în mod sistematic şi colectate în dosare deţinute de autorităţi. Acest lucru este
cu atît mai adevărat atunci cînd informaţiile privesc trecutul îndepărtat al unei persoane.
44. În cazul de faţă, Curtea notează că scrisoarea SRI din 19 decembrie 1990 conţinea
diverse informaţii despre viaţa privată a reclamantului, în special cu privire la studiile sale, la
activităţile politice şi la cazierul judiciar, iar o parte dintre acestea au fost adunate cu peste
cincizeci de ani în urmă. În opinia Curţii, astfel de informaţii, atunci cînd sunt adunate în mod
sistematic şi sunt fişate într-un dosar deţinut de agenţi ai statului, fac parte din sfera „vieţii
private" în sensul articolului 8 paragraful l al Convenţiei. Acest lucru este cu atît mai adevărat în
cauză, întrucît o parte din informaţii au fost declarate false şi sunt în măsură să rănească reputaţia
reclamantului.
În consecinţă, articolul 8 este aplicabil.
B. Respectarea articolului 8
1. Dacă a existat o interferenţă
45. Potrivit susţinerilor guvernului, pentru a se constata o interferenţă cu dreptul la
respectarea vieţii private trebuie îndeplinite trei condiţii: arhivarea şi deţinerea informaţiilor
privind persoana în discuţie; folosirea informaţiilor respective ; şi imposibilitatea persoanei
respective de a dovedi falsitatea acestora. În cauză, atît arhivarea, cît şi folosirea informaţiilor
referitoare la reclamant au avut loc înainte ca România să ratifice Convenţia. În ceea ce priveşte
plîngerea privind imposibilitatea dovedirii falsităţii informaţiilor, guvernul a afirmat că,
dimpotrivă, reclamantului i-a fost deschisă această cale, dar nu a folosit remediile oferite de
legislaţia naţională.
46. Curtea subliniază că atît arhivarea şi deţinerea de către o autoritate publică a
informaţiilor referitoare la viaţa privată a reclamantului şi folosirea acestor informaţii, cît şi
refuzarea posibilităţii de a dovedi falsitatea acestora au constituit o interferenţă cu dreptul la
respectarea vieţii private garantat de articolul 8 paragraful 1 al Convenţiei (vezi hotărîrile din
cazurile Leander versus Suedia..., Kopp versus Elveţia... şi Amman versus Elveţia...).
În cauză, faptul că SRI a deţinut informaţii privind viaţa privată a reclamantului rezultînd
din scrisoarea SRI din 19 decembrie 1990 este mai mult decît o probabilitate. Cu toate că
scrisoarea datează dintr-o perioadă anterioară ratificării Convenţiei (20 iunie 1994), guvernul nu
a susţinut că ulterior acestei date SRI a încetat să deţină informaţii despre viaţa privată a
reclamantului. Curtea mai observă că informaţiile respective au fost folosite după ratificarea
Convenţiei, aşa cum s-a întîmplat în cazul cererii de revizuire care a fost soluţionată prin
hotărîrea din 25 noiembrie 1997.
Atît deţinerea informaţiilor în discuţie, cît şi folosirea acestora, coroborate cu refuzul de a i
se permite reclamantului să dovedească falsitatea acestora au condus la o interferenţă cu dreptul
la respectarea vieţii de familie, aşa cum este garantată de articolul 8 paragraful 1.
2. Justificarea interferenţei
47. Chestiunea esenţială este dacă interferenţa constatată este justificabilă pe baza
paragrafului 2 al articolului 8. Întrucît prevede excepţii de la dreptul garantat în paragraful l,
paragraful 2 trebuie interpretat într-un sens restrîns, în timp ce admite că serviciile de informaţii
pot exista în mod legitim într-o societate democratică, Curtea reaminteşte că puterea de a
exercita o supraveghere secretă a persoanelor este tolerabilă în contextul Convenţiei numai atît
cît este strict necesară pentru protejarea instituţiilor democratice (vezi Klass ji alţii versus
Germania...).
4. 48. Pentru a nu fi contrară articolului 8, o astfel de interferenţă trebuie să fie „prevăzută de
lege", să urmărească realizarea unui scop legitim potrivit paragrafului 2 şi să fie necesară într-o
societate democratică pentru a atinge scopul respectiv.
49. Guvernul a afirmat că măsurile în discuţie au fost conforme cu legea. Informaţiile
respective au fost făcute publice de SRI în contextul unei proceduri prevăzute în Decretul-Lege
nr. 118/1990, care era destinat reparării prejudiciilor cauzate persoanelor persecutate de regimul
comunist. Potrivit articolului 11 al acestui decret-lege, nu se puteau acorda reparaţii persoanelor
angajate în activităţi fasciste.
50. Potrivit susţinerilor reclamantului, păstrarea şi folosirea dosarului său nu au fost
conform legii, întrucît legea nu era suficient de precisă în a indica persoanelor circumstanţele şi
termenii în care autorităţile publice erau îndreptăţite să arhiveze şi să folosească informaţii
referitoare la viaţa lor privată. Mai mult, legea internă nu definea cu suficientă precizie
modalitatea de exercitare a acestor puteri şi nu conţinea nici o garanţie împotriva abuzurilor.
51. Comisia a considerat că legislaţia internă nu definea cu suficientă precizie
circumstanţele în care SRI putea arhiva, releva şi folosi informaţiile referitoare la viaţa privată a
reclamantului.
52. Curtea se referă la jurisprudenţa sa potrivit căreia expresia „prevăzută de lege" cere nu
numai ca măsura contestată să aibă o bază în legislaţia internă, ci se referă şi la calitatea legii în
discuţie, cerînd ca aceasta să fie accesibilă persoanei în cauză şi să fie previzibilă sub aspectul
consecinţelor sale (vezi, cel mai recent exemplu, Amann versus Elveţia...).
53. În cazul de faţă, Curtea observă că articolul 6 al Decretului-Lege nr. 118/1990, pe care
guvernul 1-a invocat ca temei al măsurii contestate, permite oricărei persoane să dovedească
îndeplinirea condiţiilor cerute pentru a obţine drepturile prevăzute în acest decret-lege prin
depunerea unor documente oficiale eliberate de autorităţi ori prin alte mijloace materiale cu
valoare probatorie. Cu toate acestea, textul de lege respectiv nu prevede modalitatea în care pot fi
obţinute astfel de probe şi nici nu conferă SRI vreun drept de a culege, depozita şi releva
informaţii despre viaţa privată a unei persoane.
De aceea, Curtea trebuie să stabilească dacă Legea nr. 14/1992 privind organizarea şi
funcţionarea SRI, de asemenea invocată de guvern, poate constitui o bază legală a măsurilor în
discuţie, în acest context, Curtea observă că legea respectivă autorizează SRI să culeagă, să
deţină şi să folosească informaţii referitoare la siguranţa naţională. Curtea se îndoieşte că
informaţiile deţinute despre reclamant aveau relevanţă pentru siguranţa naţională. Cu toate
acestea, Curtea reaminteşte că autorităţile naţionale, în primul rînd instanţele de judecată, sunt
chemate să interpreteze şi să aplice legea internă (vezi Kopp versus Elveţia...) şi notează că prin
hotărîrea din 25 noiembrie 1997, Curtea de Apel Bucureşti a confirmat că deţinerea informaţiilor
în discuţie de către SRI, ca depozitar al arhivelor fostelor servicii de securitate, a fost legală.
Aşa fiind, Curtea poate conchide că deţinerea informaţiilor referitoare la viaţa privată a
reclamantului a avut un temei în legislaţia română.
54. În ceea ce priveşte caracterul accesibil al legii, Curtea consideră că această cerinţă este
îndeplinită, întrucît Legea nr.14/1992 a fost publicată în Monitorul Oficial al României la data de
3 martie 1992.
55. Cu privire la cerinţa caracterului previzibil al legii, Curtea reaminteşte că o dispoziţie
legală este „previzibilă" dacă este formulată cu suficientă precizie pentru a permite oricărei
persoane - dacă este necesar, cu asistenţă juridică corespunzătoare - să îşi adapteze
comportamentul. Curtea a subliniat importanţa acestui concept, în ceea ce priveşte supravegherea
secretă, în următorii termeni (vezi Malone versus Regatul Unit, hotărîrea din 2 august 1984...,
reluat în Amann versus Elveţia...):
„Curtea reaminteşte că expresia «prevăzută de lege» nu se referă numai la prevederile
legii naţionale, ci şi la calitatea acesteia, care trebuie să fie compatibilă cu principiul
supremaţiei dreptului, menţionat expres în preambulul Convenţiei... Această expresie implică -
iar aceasta rezultă din obiectul şi scopul articolului 8 al Convenţiei - existenţa unui anumit grad
de protecţie pe care legea naţională trebuie să îl ofere persoanelor împotriva amestecului
5. arbitrar al autorităţilor publice în exerciţiul drepturilor garantate de paragraful 1... În mod
special, în situaţia în care puterea executivului se exercită în secret, riscul arbitrarului este
evident...
...Întrucît aplicarea în practică a măsurilor de supraveghere secretă a mijloacelor de
comunicaţie nu este deschisă scrutinului de către persoanele interesate sau de către public, ar fi
contrar principiului supremaţiei legii ca puterea legală discreţionară acordată executivului să
fie exprimată în termenii unei puteri nerestricţionate. Prin urmare, avînd în vedere scopul
legitim al măsurii în discuţie, legea trebuie să indice cu suficientă claritate întinderea oricărei
astfel de puteri discreţionare conferite autorităţilor competente, precum şi modalitatea în care se
exercită această putere, şi să acorde fiecărei persoane o protecţie adecvată împotriva
interferenţelor arbitrare".
56. De aceea, „calitatea" normelor legale care stau la baza acestui caz trebuie verificate
astfel încît să se stabilească, în mod special, dacă legea internă prevede cu suficientă precizie
circumstanţele în care SRI a putut deţine şi folosi informaţiile referitoare la viaţa privată a
reclamantului.
57. În acest context, Curtea observă că articolul 8 al Legii nr. 14/1992 prevede că
informaţiile care afectează siguranţa naţională pot fi culese, înregistrate şi arhivate în dosare
secrete.
Cu toate acestea, nici o dispoziţie din legislaţia internă nu prevede limitele în care aceste
puteri pot fi exercitate. Astfel, legea internă nu defineşte tipurile de informaţii care pot fi
înregistrate, categoriile de persoane împotriva cărora pot fi luate măsuri de supraveghere aşa cum
sunt culegerea şi păstrarea informaţiilor, circumstanţele în care pot fi luate astfel de măsuri ori
procedurile care trebuie îndeplinite. În mod similar, legea nu prevede limitele vechimii
informaţiilor şi nici perioada de timp în care acestea pot fi deţinute.
Articolul 45 împuterniceşte SRI să preia pentru conservare şi folosinţă arhivele fostelor
servicii de informaţii care au acţionat pe teritoriul României şi permite consultarea acestora cu
aprobarea directorului SRI.
Curtea observă că acest articol nu conţine prevederi explicite şi detaliate cu privire la
persoanele autorizate să consulte dosarele, la natura dosarelor, la procedura de urmat şi nici la
modul în care pot fi folosite informaţiile astfel obţinute.
58. Curtea observă, de asemenea, că deşi articolul 2 al legii împuterniceşte autorităţile
competente să permită interferenţe necesare pentru prevenirea şi contracararea ameninţărilor la
adresa siguranţei naţionale, motivul pentru astfel de interferenţe nu este precizat cu suficientă
precizie.
59. Curtea trebuie să se convingă că există garanţii adecvate şi efective împotriva
abuzurilor, întrucît un sistem de supraveghere secretă menit să protejeze siguranţa naţională
implică riscul subminării sau chiar al distrugerii democraţiei sub pretextul apărării acesteia (vezi
Klass şi alţii versus Germania...).
Pentru ca sistemele de supraveghere secretă să fie compatibile cu articolul 8 al Convenţiei,
acestea trebuie să conţină garanţii stabilite prin lege, aplicabile în procesul supervizării
activităţilor serviciilor respective. Procedurile de supervizare trebuie să urmeze cît mai aproape
posibil valorile societăţii democratice, în special principiul supremaţiei legii la care se referă în
mod expres Preambulul Convenţiei. Principiul supremaţiei legii presupune, între altele, ca
amestecul autorităţilor publice cu drepturile unei persoane să fie supus unui control efectiv, care
în mod normal trebuie să fie exercitat de puterea judecătorească, cel puţin în faza finală, întrucît
controlul judiciar implică cele mai bune garanţii de independenţă, imparţialitate şi o procedură
adecvată (vezi Klass şi alţii versus Germania...).
60. În cazul de faţă, Curtea observă că sistemul românesc de culegere şi arhivare a
informaţiilor nu conţine astfel de garanţii, Legea nr.14/1992 neprevăzînd vreo procedură de
control nici pentru situaţia în care măsurile dispuse sunt în curs şi nici ulterior acestora.
61. Aşa fiind, Curtea consideră că legea internă nu indică cu o claritate rezonabilă
întinderea şi modalitatea în care se exercită puterea discreţionară conferită autorităţilor publice.
6. 62. Curtea conchide că deţinerea şi folosirea de către SRI a informaţiilor referitoare la viaţa
privată a reclamantului nu au fost „prevăzute de lege", acesta fiind un motiv suficient pentru a se
constata încălcarea articolului 8. Constatarea aceasta opreşte Curtea de a revizui, în cazul de faţă,
legitimitatea scopului urmărit prin măsurile dispuse şi de a stabili dacă acestea au fost -
presupunînd că scopul ar fi fost legitim - „necesare într-o societate democratică".
63. În consecinţă, articolul 8 a fost încălcat.
