RTI ACT, 2005- IMPORTANT SECTIONS
RTI ACT-2005
 Section 4(1)(b) of the Act, in particular, requires every public
authority to publish following sixteen categories of information ;
 the particulars of its organization, functions and duties;
 the powers and duties of its officers and employees;
 the procedure followed in the decision making process, including
channels of supervision and accountability ;
 the norms set by it for the discharge of its functions;
 the rules, regulations, instructions, manuals and records, held by it
or under its control or used by its employees for discharging its
functions;
 a statement of the categories of documents that are held by it or
under its control;
PRO - ACTIVE DISCLOSURE OF INFORMATION

 the particulars of any arrangement that exists for consultation with, or
representation by ,the members of the public in relation to the formulation
of its policy or implementation thereof;
 a statement of the boards, councils, committees and other bodies consisting
of two or more persons constituted as its part or for the purpose of its
advice, and as to whether meetings of those boards, councils, committees
and other bodies are open to the public, or the minutes of such meetings are
accessible for public;
 directory of its officers and employees;
 the monthly remuneration received by each of its officers and employees,
including the system of compensation as provided in its regulations;
 the budget allocated to each of its agency, indicating the particulars of all
plans, proposed expenditures and reports on disbursements made;

 the manner of execution of subsidy programmes, including the amounts
allocated and the details of beneficiaries of such programmes;
 particulars of recipients of concessions, permits or authorizations granted

 the particulars of facilities available to citizens for obtaining information
including the working hours of a library or reading room, if maintained for
public use;
 the names, designations and other particulars of the Public Information
Officers.

RTI ACT-2005
All Heads of Departments, Public Sector Undertakings and Government
aided institutions and all such institutions that come under the ambit of
RTI Act that the penalty awarded by State Information Commission on the
employees of public authorities under 20(1) of RTI Act shall be recovered
from the salary of the State Public Information Officers concerned if /she is
still in service and that of from the pensionary benefits in the case of State
Public Information Officers who have since retired, in the event of non
remittance of the penalty.
PENALTY U/S 20(1) OF THE RTI ACT

1. RTI Application number, date of its receipt in the public authority;
2. The name, designation, official telephone number and email ID of the SPIO
3. In case the information requested for is denied, detailed reasons for denial
quoting the relevant sections of the RTI Act should be clearly mentioned.
 In case the information pertains to other public authority and the
application is transferred under section 6(3) of the RTI Act, details of the
public authority to whom the application is transferred should be given.
FORMAT FOR GIVING INFORMATION TO THE APPLICANT

 In the concluding para of the reply it should be clearly mentioned that the
First Appeal, if any, against the reply of the SPIO may be made to the First
Appellate Authority within 30 days of receipt of reply of SPIO.
 The name ,designation, address, official telephone number and e-mail ID of
the First Appellate Authority should be clearly mentioned.
 Wherever the applicant has requested for 'certified copies' of the
documents or records , the SPIO should endorse on the document “True
Copy of the document/record supplied under RTI Act”, sign the document
with date, above a seal containing name of the officer, SPIO and name of
public authority.
