Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

1. Reutilizarea în scopuri sociale a
bunurilor confiscate din infrac iuniț
Proiect finanţat prin granturile SEE 2009 – 2014, în cadrul Fondului ONG în România.
Conţinutul acestui material nu reprezintă în mod necesar poziţia oficială a granturilor
SEE 2009 – 2014.
2. • Reutilizarea bunurilor confiscate înseamnă
transmiterea cu titlu gratuit a bunurilor confiscate
sau a sumelor provenite din infracţiuni pentru a fi
folosite în interes public sau în scopuri sociale de
către instituţii publice (autorităţi publice locale) sau
organizaţii neguvernamentale.
• Reutilizarea socială este unica formă de valorificare
care garantează cetă enilor vizibilitatea bunurilorț
confiscate, întrucât ceea ce provine din infrac iuniț
este înapoiat societă ii în mod explicit.ț
• Problema de bază este modul de valorificare a
bunurilor confiscate –masoara eficacitatea
sistemului judiciar.

3. Asset recovery
• Sesizarea infracţiunilor de corupţie şi criminalitate
organizată (Pre-investigation) – declara ii deț
avere, rapoarte ale avertizorilor de integritate etc;

4. • Confiscarea specială (art. 112 CP);
bunurile produse prin săvârşirea faptei prevăzute de legea penală;
bunurile care au fost folosite, în orice mod, sau destinate a fi
folosite la săvârşirea unei fapte prevăzute de legea penală, dacă
sunt ale făptuitorului sau dacă, aparţinând altei persoane,
aceasta a cunoscut scopul folosirii lor;
bunurile folosite, imediat după săvârşirea faptei, pentru a asigura
scăparea făptuitorului sau păstrarea folosului ori a produsului

bunurile dobândite prin săvârşirea faptei prevăzute de legea
penală, dacă nu sunt restituite persoanei vătămate şi în măsura
în care nu servesc la despăgubirea acesteia;
bunurile a căror deţinere este interzisă de legea penală.

5. • Confiscarea extinsă (art. 112 indice 1 CP);
se dispune dacă sunt îndeplinite cumulativ următoarele condiţii:
a) valoarea bunurilor dobândite de persoana condamnată, într-o
perioadă de 5 ani înainte şi, dacă este cazul, după momentul
săvârşirii infracţiunii, până la data emiterii actului de sesizare a
instanţei, depăşeşte în mod vădit veniturile obţinute de aceasta
în mod licit;
b) instanţa are convingerea că bunurile respective provin din
activităţi infracţionale pedeapsite cu închisoarea de 4 ani sau
mai mare (infrac iuni de criminalitate organizată i economico-ț ș
financiară).
• se ţine seama şi de valoarea bunurilor transferate de către
persoana condamnată ori de un terţ unui membru al familiei sau
unei persoane juridice asupra căreia persoana condamnată
deţine controlul.
• prin bunuri se înţelege şi sumele de bani.
Moduri de recuperare a prejudiciilor
6. • Repararea pagubei/Despăgubiri civile (art. 19
CPP);
• Acţiunea civilă exercitată în cadrul procesului penal are ca obiect
tragerea la răspundere civilă delictuală a persoanelor
responsabile potrivit legii civile pentru prejudiciul produs prin
comiterea faptei care face obiectul acţiunii penale.
• Confiscarea averii nejustificate (art. 18 din Legea
nr. 115/1996);
• Dacă se constată că dobândirea unor bunuri anume determinate
sau a unei cote-părţi dintr-un bun nu este justificată, curtea de
apel va hotărî fie confiscarea bunurilor sau a cotei-părţi
nejustificate, fie plata unei sume de bani, egală cu valoarea
bunului, stabilită de instanţă pe bază de expertiză. În cazul
obligării la plata contravalorii bunului, instanţa va stabili şi
termenul de plată.

7. • Confiscarea contraventională (art. 5, alin. 3 i 24ș
din OG 2/2001);
• Sancţiunile contravenţionale complementare sunt: confiscarea
bunurilor destinate, folosite sau rezultate din contravenţii;
agentul constatator va descrie în procesul-verbal bunurile
supuse confiscării şi va lua în privinţa lor măsurile de conservare
sau de valorificare prevăzute de lege, făcând menţiunile
corespunzătoare în procesul-verbal. Agentul constatator are
obligaţia să stabilească cine este proprietarul bunurilor
confiscate şi, dacă acestea aparţin unei alte persoane decât
contravenientul, în procesul-verbal se vor menţiona, dacă este
posibil, datele de identificare a proprietarului sau se vor preciza
motivele pentru care identificarea nu a fost posibilă.

8. • Criminalitate are un caracter transna ional în UE iț ș
e nevoie de o coordonare între statele membre
(Programul Stockholm 2009);
• Un studiu al Parlamentului European din 2012
recomandă o directivă europeană care să vizeze
stabilirea unor proceduri coerente i transparenteș
în statele membre de reutilizare a bunurilor
confiscate în programe sociale sau de prevenire a
criminalită ii (ex. proiecte de interes public pentruț
protecţia avertizorilor de integritate, pentru
sprijinirea persoanelor dependente de droguri,
victime ale traficului de fiin e umane, pentruț
informarea tinerilor, pentru omerii tineri) şi deș
implicare a societăţii civile în a face sugestii cu
privire la care proiecte cu relevan ă socială trebuieț
să fie finanţate din aceste fonduri.

9. • Interesul tot mai mare pentru gestionarea iș
valorificarea bunurilor confiscate a culminat cu
adoptarea Directivei 2014/42/UE a Parlamentului
European i a Consiliului, din 3 aprilie 2014, privindș
înghe area i confiscarea produselor provenite dinț ș
săvâr irea de infrac iuni în Uniunea Europeană .ș ț
Directiva a introdus pentru prima dată prevederi
privind valorificarea bunurilor sechestrate iș
confiscate i a invitat statele membre „ș să aibă în
vedere luarea de măsuri care să permită utilizarea
bunurilor confiscate în interes public sau în scopuri
sociale”. Aceasta mai men ionează că, printreț
aceste măsuri, se poate regăsi aceea a alocării
acestor bunuri pentru proiecte de aplicare a legii iș
de prevenire a infrac iunilor, precum i pentru alteț ș
proiecte de interes public i de utilitate socială.ș

10. • Două modele de reutilizare în statele membre

confiscate (Italia, Belgia, Bulgaria);
b. Reutilizarea în scopuri sociale a sumelor de bani
rezultate din valorificarea bunurilor confiscate, prin
înfiin area unor fonduri specializate (Fran a,ț ț

- Agen ie specializată de valorificare a bunurilorț
confiscate: Agenzia nazionale per
l'amministrazione e la destinazione dei beni
sequestrati e confiscati alla criminalità organizzata

- Prima variantă de valorificare a bunurilor imobile
(terenuri, clădiri) i mobile (autoturisme, drepturiș
asupra societă ilor comerciale) este transferul cuț
titlu gratuit către comunită ile locale, ONGuri,ț
grupuri de persoane (ex. angaja ii societă ilorț ț
comerciale confiscate).
- Bune practici (protocoli di intesa): protocoale iș
parteneriate între toti factorii interesa i pentruț

12. Spania
- Agen ie specializată de atribuire a bunurilorț
confiscate: Delegation del Gobierno para el plan
nacional sobre drogas (din cadrul Secretaria de
estado de servicios sociales e igualdad, parte a
Ministerio de sanidad, servicios sociales e
igualdad);
- Legislatia se referă doar la valorificarea bunurilor
confiscate din traficul de droguri; Toate bunurile
sunt vândute iar sumele de bani sunt transferate
către un fond special de unde un comitet alocă
sume beneficiarilor pentru finantarea unor activitati
de prevenire si combatere a traficului de droguri
(poli ie, garda civilă, ONGuri).ț

13. Fran aț
- Agen ie specializată de gestionare a bunurilorț
confiscate: AGRASC - Agence de gestion et de
recouvrement des avoirs saisis et confisqués.
AGRASC vinde la licita ie bunurile mobile i imobileț ș
provenite din traficul de dreoguri confiscate prin
hotărâri judecătore ti. Banii sunt transfera i înș ț
contul unui comitet interministerial MILD - Mission
Interministérielle de lute contre la drogue et la
toxicomanie, care le rândul său le distribuie anual
pe baza de proiect: 60% Ministrul de interne, 20%
Ministerul de justi ie, 10% Ministerul finan elor,ț ț
10% proiecte sociale.

14. Sco iaț
- Guvernul sco ian primeste de la guvernul centralț
(Londra) o parte din sumele ob inute din vânzareaț
bunurilor confiscate din Scotia. Aceste sume sunt
folosite prin intermediul unui program numit
CashBack Programme. Acest program acordă
granturi ONGurilor pentru a derula programe de
dezvoltare a tinerilor.

15. Pia a bunurilor confiscate (sechestru)ț
- valoarea măsurilor asiguratorii dispuse de către
procurori în anul 2012 a fost de 1,869,681,989 lei
(430,026,857 euro), iar în anul 2011 acestea au
fost în valoare de 1,024,979,707 lei (238,367,373
de euro), în cre tere cu 175,8% fa ă de anul 2010ș ț
i cu 352,1% fa ă de 2009, valoarea măsurilorș ț
asiguratorii instituite de procurori crescând, în
perioada 2007-2012, în medie cu 180% . Aceste
sume reprezintă însă o parte din valoarea
prejudiciilor reţinute prin rechizitorii:
3,227,646,119 (742,358,607 euro) în 2011 şi
3,426,362,917 (788,063,471 euro) în 2012

16. Pia a bunurilor confiscate (efectiv recuperate)ț
- valoarea bunurilor efectiv confiscate în executarea
hotărârilor judecătoreşti definitive prin care s-a
dispus confiscarea specială, a fost de 7,053,914 lei
(1,622,400 euro) în 2010, 21,582,411 lei
(4,963,955 euro) în 2011 şi 34,821,415 lei
(8,008,925 euro) în 2012
- sumele confiscate în baza evaluării averilor
nejustificate de către Agenţia Naţională de
Integritate: 1.058.670 Euro and 129.517,80 USD
(ambele sume confiscate în anul 2011 prin 3
hotărâri judecătoreşti definitive şi irevocabile)

17. Valorificare bunurilor confiscate
- Valorificarea bunurilor confiscate urmează aceea iș
procedură aplicată pentru valorificarea tuturor
bunurilor care au intrat în proprietatea privată a
statului. Astfel, este greu de făcut diferen a întreț
bunurile confiscate din infrac iuni i confiscărileț ș
contraven ionale, statutul de moştenire legală /ț
succesiunile vacante i bunurile abandonate.ș
- Valorificarea bunurilor este descentralizată, iar
organismul responsabil cu valorificarea este
Agen ia Na ională de Administrare Fiscală, prinț ț
unită ile sale regionale i locale.ț ș

18. Valorificare bunurilor confiscate
- există cinci metode de valorificare: vânzarea
bunurilor către publicul larg, transmiterea bunurilor
către institu iile de stat i către autorită ile locale,ț ș ț
transmiterea bunurilor către al i beneficiari (culte,ț
ONG-uri), distrugerea i restituirea.ș
- Toate bunurile, cu excep iaț mijloacelor de plată, a
bunurilor imobile (terenuri, clădiri), a obiectelor din
metale sau pietre pre ioase i a altor bunuri cuț ș
statut special, pot face obiectul reutilizării în
scopuri sociale

19. Valorificare bunurilor confiscate
- Termenul de „reutilizare în scopuri sociale” nu este
definit ca atare în legisla ie, aceasta referindu-se laț
„atribuirea cu titlu gratuit”.
- De procedura de „atribuire cu titlu gratuit” se
ocupă unită ile regionale i locale ale Agen ieiț ș ț
Na ionale de Administrare Fiscală, pentru bunurileț
în valoare de până la 10,000 lei, Ministerul
Finan elor Publice, pentru bunurile în valoare deț
peste 10,000 lei, i comisia interministerială dinș
cadrul Secretariatului General al Guvernului (SGG),
pentru ma ini, ambulan e i dotări aferente,ș ț ș
ambarca iuni i motoare ata abile acestora.ț ș ș

20. Valorificare bunurilor confiscate
- Beneficiarii eligibili ai regimului de „atribuire cu
titlu gratuit” sunt defini i strict de legisla ie:ț ț
ministere, autorită i publice centrale, autorită iț ț
publice locale, persoane juridice care au în
administrare case memoriale, institu ii religioase /ț
culte religioase, Societatea Na ională de Cruceț
Ro ie din România,ș organiza iiț
neguvernamentale acreditate de Ministerul
Muncii, Familiei i Protec iei Sociale caș ț
prestatori de servicii sociale, cre e, grădini e,ș ț
orfelinate i alte centre de plasament pentru copii,ș
cămine pentru persoane vârstnice, cantine sociale,
azile, spitale, coli, biblioteci, persoane fizice cuș
dizabilită i, persoane fizice care au suferit de peț
urma calamită ilor naturale.ț

21. Valorificare bunurilor confiscate
- Ma inile i celelalte vehicule sunt bunurile cele maiș ș
solicitate pentru transmitere cu titlu gratuit. Pe
locul al doilea se află produsele generale
(îmbrăcăminte, hrană etc.) care sunt transmise
către cre e, grădini e, orfelinate i alte centre deș ț ș
plasament pentru copii i organiza iiș ț
neguvernamentale. Pe locul al treilea, după
cantitate i valoare a bunurilor, se aflăș
echipamentele de comunicare i IT, articolele deș
birou, produsele de folosin ă îndelungată,ț
echipamentele de uz casnic, materialele pentru
între inere i repara ii, care sunt atribuite cu titluț ș ț
gratuit autorită ilor publice centrale i locale.ț ș

22. Valorificare bunurilor confiscate
- Lista cu bunurile confiscate aflate în stoc la fiecare
unitate locală a autorită ii fiscale din România poate fiț

- Atribuirile cu titlu gratuit reprezintă un 3,45% din
totalul bunurilor care au intrat în proprietatea privată
a statului

23. Cazul ANA
- Agenţia Na ională Antidrog (ANA) men ine înregistrăriț ț
ale hotărârilor definitive ale instan elor penale careț
prevăd confiscarea produselor provenite din săvâr ireaș
de infrac iuni la regimul drogurilor i precursorilor.ț ș
- Conform cifrelor ANA din 2012 i 2013 (ianuarie-ș
septembrie), instan ele au hotărât confiscarea a pesteț
650.000 de euro i a altor bunuri, în cazuri penaleș
legate de produse provenite din săvâr irea deș
infrac iuni la regimul drogurilor i precursorilor. Toateț ș
bunurile care sunt recuperate în astfel de cazuri sunt
capitalizate (vândute) de autoritatea fiscală, iar
sumele sunt transferate într-un cont separat al
bugetului de stat.

24. HG 215/2012
Măsura 3.5.7 a Planului Naţional de Acţiune pentru
implementarea Strategiei Naţionale Anticorupţiei
2012-2015: “Adoptarea de măsuri legislative şi
instituţionale pentru o mai bună administrare a
bunurilor sechestrate şi confiscate, precum şi
reutilizarea resurselor obţinute în programe sociale
de prevenire a criminalităţii”.

Elaborarea în parteneriat între sectorul public şi
societatea civilă a unei propuneri de politici
publice care să crească rolul ONGurilor în
domeniul re-utilizării în scopuri sociale a
bunurilor/sumelor confiscate din infracţiuni;
Scenariul minimal: reutilizarea în scopuri sociale a
bunurilor mobile i imobile ca primă varianta deș
valorificare;
Scenariul maximal: reutilizarea în scopuri sociale
inclusiv a sumelor de bani confiscate prin
intermediul unui fond pentru proiecte

26. Ce dorim să facem?
- să ajutăm organizaţiile neguvernamentale eligibile
să depună cereri pentru atribuirea de bunuri
cu titlu gratuit pentru a utiliza la miximum
prevederile legale deja existente;
- să analizăm bunele practici dezvoltate la nivel local;
- să informăm organizaţiile neguvernamentale despre
reutilizarea în scopuri sociale a bunurilor provenite
din infracţiuni;
- să propunem Guvernului îmbunătăţirea legislaţiei
actuale şi să lărgim cadrul reutilizării, înclusiv
pentru sumele confiscate, în acord cu cele mai
bune practici europene.
