Jeremy Winter and Peter Johnson gave a presentation on resolving complex delay claims to the Society of Construction Law. They discussed challenges with determining extensions of time under standard construction contracts and analyzing delays. Peter Johnson presented several methods of analyzing delays, including time impact analysis, which tracks the effects of individual delays on a project's critical path over time. This method accounts for planned work, prior events, and the direct impact of single delay events. Jeremy Winter discussed using similar time-based analyses to prove entitlement to money for prolongation costs due to delays. Presenting claims sequentially and tracking actual time impacts and costs allows claimants to avoid issues of concurrency and prove entitlement for at least some delays to recover all prolongation costs.
