An Act Establishing And Providing For A Free
Public Secondary Education And For Other
Purposes

subsidies and other incentives which shall be
available to deserving students both public and
private schools, especially to the

It is the policyof the State to provide for a

secondary educationto all qualified citizens and to
promotequality education at
all levels.
Definition of
Terms
Section 3:
1. Free Public
Secondary Education
trade, technical,vocational, fishery and agricultural schools,
and in
schools established,
Means thatthestudentsenrolled in secondary course
offerings in nationalhighschools, general comprehensive high
schools,
tuitionandotherschools fees.
administered,maintainedandfundedby local
governmentunits,
includingcity,provincial,municiapalandbarangayhighschools,
andthosepublichighschools whichmaybe establishedby law,
shall be free from paymentof
Refers tothe fees representing directcosts ofinstruction,
training andother related activities andfor the students’ useofthe
instruction andtraining facilities.
2.Tuition Fee
Refers tothosefees whichcovers othernecessary
costssupportiveof instruction,includingbutnotlimited to
medicalanddental,athletic,library, laboratoryandCitizens
ArmyTraining(CAT)fees.
3.Other School Fees
However, feeselatedtomembershipin theschool community
such as identificationcards, studentorganizationsand publicationsmay
becollected,provided thatnonpaymenttothesefees shallnotin any
casebea bar tothe enrollmentor graduationof
any student.
Implementation of
Free Public Secondary Education
Section 4:
The system of free public secondary education as
provided in this Act
communitysuch as identificationcards,
shallcommence in SchoolYear1988-1989, and thatthe students
enrolled in secondary course … shall be free from payment of tuition
and other schoolfees, exceptfees related to membership in the
school
studentorganizationsand publicationwhich may be
collected:provided, that
nothingin thisActshallcause or authorizethe reduction or removal of
anybenefit which thenationalor local governmentmayhave granted to
thestudents,teachersand otherschool personnel ofthesepublichigh
schools prior to theenactmentofthis Act.
Formulationof a Secondary
Education Curriculum
Section 5:
The DepartmentofEducation,Culture and Sports shall
formulatea secondary educationcurriculum in order
toupgradeitsquality,efficiencyand access. In additiontoproviding the
high school studentswithgeneralskills,knowledgeand values,such a
curriculum mustinclude vocationaland technicalcourses thatwillgive
thestudentsgainfulemployment.
Limitation
Section 6:
The right of any studentto avail of free publichigh
school shall
enrolled during thecourse of his study unless such failureis due
to
some valid cause.

To effectively implement the system, the establishment,
renaming, conversion,
integration,separation,administration,supervision andcontrol of allpublic
secondary schools and publicsecondary school teachersand other school
personnel, including thepaymentoftheirsalaries allowancesand other
fringebenefitsas wellas thosealready provided by localgovernmentsare
hereby vestedin theDepartmentof
Education,Culture and Sports.
Section 8:
Priority in
Admission
Graduatesof publicelementary schoolsin a
municipalityshallbe
givenpriorityinadmissionwhenthepresent facilities inthe
same municipalitycannotaccommodateall ofthoseapplying
for enrollment
in thepublichigh schools.
Section 9:
Implementing Rules and
Regulations
The Secretary of Education,Cultureand Sports
shall issue the necessary rules and regulations to
implementthis Act.
Section 10:
Funding
The President ishereby authorized to realign or transfer
any item of appropriation within the Department of
Education, Culture and Sports. and/or utilize any savings therein to carry out
the purposes of this Act. Whatever additional amount asmay be needed for its
implementation shallbe included in the General Appropriations Acts for the
ensuing fiscal years.
