The prosecutor intends to prosecute Stu Dents on multiple charges based on the evidence in the case. Kidnapping: State V. Stu Dent
List the elements of the crime and facts that establish each element.
Kidnapping is defined by Fla. Stat. § 787.01 as forcibly, secretly and by use of threat confining or imprisoning another person against his or her will and without any lawful authority or intent. The purpose with which Stu Dent confined the victim was to inflict bodily harm her, this is part of the intention that is described by the law. The law states that the victim’s state of mind is an important factor to consider before we can determine that one was kidnapped, in this case the victim was tested for drugs and it was proven that she was not under any drug influence at the time. So she was forcibly abducted against her will as the evidence shows there was some sort of struggle with the defendant before she was tied using ropes.
We can see that the defendant had planned on forceful capture and detention of the victim against her will, he had it in his diary that he would buy a rope whose main purpose would be to tight the victim before he could move her five miles from their home. The detention occurred done against her will since she engaged in a form of struggle with the defendant; this is established by the fact that pieces of human skin were found underneath her finger nail. She was not under influence of drugs therefore we can eliminate any belief that she might have willingly accepted the forceful abduction. The defendant if proven guilty of the charge of kidnapping will be guilty of felony of the first degree.

The nurse manager reorganized patient assignments. She felt that the newly assigned clinical nurse leader who was working between both the medical and surgical units could provide direct nurse caring and coordination at the point of care (Sherman, 2012). Over the next few hours, the clinical nurse leader and a staff member who had volunteered her assistance provided personal care for Mrs. Smith. The clinical nurse leader asked the nurse manager whether there was a possibility that Mrs. Smith had any close friends who could “be there” for her in her final moments. One friend was discovered and came to say goodbye to Mrs. Smith. With help from her team, the clinical nurse leader turned, bathed, and suctioned Mrs. Smith. She spoke quietly, prayed, and sang hymns softly in Mrs. Smith’s room, creating a peaceful environment that expressed compassion and a deep sense of caring for her. The nurse manager and nursing unit staff were calmed and their “hearts awakened” by the personal caring that the clinical nurse leader and the volunteer nurse provided. Mrs. Smith died with caring persons at her bedside, and all members of the unit staff felt comforted that she had not died alone.

Your essay should be typed, double-spaced on standard-sized paper (8.5" x 11") with 1" margins
on all sides. You should use a clear font that is highly readable. APA recommends using 12 pt.
Times New Roman font.
Include a page header (also known as the "running head") at the top of every page. To create
a page header/running head, insert page numbers flush right. Then type "TITLE OF YOUR
PAPER" in the header flush left using all capital letters. The running head is a shortened
version of your paper's title and cannot exceed 50 characters including spacing and punctuation.
Major Paper Sections
Your essay should include four major sections: The Title Page, Abstract, Main Body,
and References.
Title Page
The title page should contain the title of the paper, the author's name, and the institutional
affiliation. Include the page header (described above) flush left with the page number flush right

My introduction was slow and clear and the story was suspenseful enough to grab their attention. It was a little confusing at the beginning because I didn’t preview the main points but because I transitioned well between the steps by saying, “Now that you have completed step 1, selecting the pattern, you are ready to move to step two, preparing the wood” the audience was able to follow. I remembered to state my research source for two of the steps but forgot the third. It made the third step seem shallower and I think I lost credibility. My word choice was good. I made sure to use a variety of descriptive words for the types of wood, explained new vocabulary and repeated phrases to help the audience remember the steps. For some reason the ending was weak. I didn’t tie it to the introduction or have a good ending sentence. It would have been a good idea to remind them of the beginning story and how woodworking affects their everyday life.Vocal Qualities
During my speech I had such a dry mouth that I messed up on the pronunciation of some of the words like saying “exspecially” instead of “especially.” This sounded less professional to the audience. I had good projection so that even the back row could hear without straining. My pitch variation is getting better but I still keep using the same rhythm with my pauses. This make me sound more monotone, like I’m reading the speech rather than just having a conversation. I’ll need to practice changing my rate and pauses. I also noticed many of my sentences end in an up-pitch, like I’m asking a question. If I bring some of those down it will make me appear more confident rather than questioning. It is hard to get rid of those filler words. “Like” and “so” are two of my favorites but it does make me sound like a teenager. I had no idea I said them so much.Delivery

Nurses were prompted by an article they read on human caring as the “language of nursing practice” (Turkel, Ray, & Kornblatt, 2012) in their weekly caring practice meetings.
The nurse manager reorganized patient assignments. She felt that the newly assigned clinical nurse leader who was working between both the medical and surgical units could provide direct nurse caring and coordination at the point of care (Sherman, 2012). Over the next few hours, the clinical nurse leader and a staff member who had volunteered her assistance provided personal care for Mrs. Smith. The clinical nurse leader asked the nurse manager whether there was a possibility that Mrs. Smith had any close friends who could “be there” for her in her final moments. One friend was discovered and came to say goodbye to Mrs. Smith. With help from her team, the clinical nurse leader turned, bathed, and suctioned Mrs. Smith. She spoke quietly, prayed, and sang hymns softly in Mrs. Smith’s room, creating a peaceful environment that expressed compassion and a deep sense of caring for her. The nurse manager and nursing unit staff were calmed and their “hearts awakened” by the personal caring that the clinical nurse leader and the volunteer nurse provided. Mrs. Smith died with caring persons at her bedside, and all members of the unit staff felt comforted that she had not died alone.
Davidson, Ray, and Turkel (2011) note that caring is complex, and caring science includes the art of practice, “an aesthetic which illuminates the beauty of the dynamic nurse-patient relationship, that makes possible authentic spiritual-ethical choices for transformation—healing, health, well-being, and a peaceful death” (p. xxiv). I made sure to use a variety of descriptive words for the types of wood, explained new vocabulary and repeated phrases to help the audience remember the steps. For some reason the ending was weak. I didn’t tie it to the introduction or have a good ending sentence. It would have been a good idea to remind them of the beginning story and how woodworking affects their everyday life.Vocal Qualities
During my speech I had such a dry mouth that I messed up on the pronunciation of some of the words like saying “exspecially” instead of “especially.” This sounded less professional to the audience. I had good projection so that even the back row could hear without straining. My pitch variation is getting better but I still keep using the same rhythm with my pauses. This make me sound more monotone, like I’m reading the speech rather than just having a conversation. I’ll need to practice changing my rate and pauses. I also noticed many of my sentences end in an up-pitch, like I’m asking a question. If I bring some of those down it will make me appear more confident rather than questioning. It is hard to get rid of those filler words. “Like” and “so” are two of my favorites but it does make me sound like a teenager. I had no idea I said them so much.Delivery
There weren’t many gestures, which made me look stiff and nervous. I just held my note cards and stood in one spot the whole time. I need to do more with my hands and maybe move a little more in the space. Strict Egalitarianism
One of the simplest principles of distributive justice is that of strict, or radical, equality. The principle says that every person should have the same level of material goods and services. The principle is most commonly justified on the grounds that people are morally equal and that equality in material goods and services is the best way to give effect to this moral ideal.

- 1. Prosecuting Argument After thoroughly reviewing the case of State v. Stu Dents, it has come to the attention of the prosecuting team that there are different elements of criminal doing in this case. As with each case that is presented to the court, it is the prosecutor’s job to present the information and facts from the case. We intend to bring to light the elements of crime, along with the facts that have been established, specific laws for each charge, and establish what state in which the law is most effective for punishment. The first element of crime in this case is murder. The defendant did in fact tie up the victim and then stabbed the victim thirteen times. Since the facts are not overly clear at this time, there is a chance of possible kidnapping or Corpus Delicti. This would be since the defendant was last seen at the victim’s apartment and the body of the victim was found 5 miles away. The third element in this case would be for possession of illegal drugs. Drugs were in fact found at the defendant’s home and at the house of the victim, of which he may have planted. Last but not least it may be possible to pursue an added charge of pre- meditated murder. With the information that was written by the defendant in his journal, stating that since he met the victim, he discussed the purchase of rope, rags, and a hunting knife. These are the facts that we know of at this time and are the ones that we intend to prosecute to the fullest extent of the law. Mr. Stu Dents was charged with homicide, assault of a police officer, kidnapping, burglary, and crimes related to drugs. According to Texas law, sec. 20.03. Kidnapping as a person commits to an offense intentionally or knowingly abducts another person (Texas Constitution and Statutes). Mr. Dents is being charged with Aggravated Kidnapping, which states under Sec. 20.04. Part “A person commits an offense if the person intentionally or knowingly abducts another person and uses or
- 2. exhibits a deadly weapon during the commission of the offense” (Texas Constitution and Statutes). Mr. Dents possessed a knife during the crime and the victim was stabbed. Aggravated Kidnapping is a felony of the first degree. According to Texas State law, sec. 19.01. A person commits criminal homicide if he/she intentionally, knowingly, recklessly, or with criminal negligence causes the death of an individual (Texas Constitution and Statutes). Part B of the same law states criminal homicide is murder, capital murder, manslaughter, or criminally negligent homicide. As the prosecution Mr. Dents will be charged with capital murder, as per sec. 19.03. Part 2, which states the person intentionally, commits the murder in the course of committing or attempting to commit Kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat (Texas Constitution and Statutes). As for the assault on the police officer, Mr. Dents will be charged with simple assault which is a third degree offense. Mr. Dents will also be charged with first-degree burglary in accordance with Texas penal code sec. 30.02 part D, which states any party to the offense entered the habitation with intent to commit a felony other than felony theft or committed or attempted to commit a felony other than felony theft (Texas Constitution and Statutes). For the remaining drug charges, Dents will be charged engaging in organized criminal activity under penal code 71.02 part 5. Mr. Dent was in possession of ecstasy at the time of his arrest.
