Representative Oscar Longoria has filed House Bill 12 to codify the Border Prosecution Unit (BPU) into law. The BPU is an independent unit that supports border prosecutors in prosecuting crimes related to the border, including drug and human trafficking crimes. House Bill 12 would define the structure and responsibilities of the BPU, facilitate cooperation between prosecutors and law enforcement, and provide prosecutors with additional resources to handle border-related cases. The European Union concluded the Schengen Agreements in 1995, which outlines the steps the EU takes when dealing with their borders. The concept was to allow free movement of European workers to move and settle in any EU State. Part of it states that “Any person, irrespective of nationality, may cross the internal borders without being subjected to border checks.” [1] There is a stipulation that border police can ask for identification during “spot checks”. If there is a serious security risk to an EU state, that state can introduce border security measures but must inform the European Parliament and Commission.
While tightening controls of external borders, rules were implemented in the agreement such as types of visas needed and how the checks at external borders have to be done, improved police cooperation including the right to cross-border surveillance, and a strong judicial cooperation through a faster extradition system and transfer of enforcement of criminal judgments.
EU’s Smart Borders plan is to improve the management of the external borders, fight against unequal immigration and provide information on people whose visas have expired but have not left, as well as facilitate border crossings for prescreened frequent third country national travelers. [2]
Like the EU, the US and Mexico have agreements on SMART Borders to help ease the flow of people and goods as well as secure the borders by blending efficient border management with state-of-the-art advanced technology. Rules are set in place to help facilitate the crossing of daily workers into the US and those going to Mexico to work at US plants.
Unlike the EU, the US/Mexican government do not have a system for cross border surveillance cooperation nor can any US or Mexico law enforcement agency cross each other’s borders in pursuit of a criminal. Also, the US and Mexico judicial systems are entirely different which makes transferring criminal judgments non-existent.

Truthfully, my perception of Homeland Security is a bloated bureaucracy which at times is inept, bad leadership, interagency non-cooperation, and political restraints. Although there are aspects of Homeland Security that have proved effective, the knee-jerk reaction of past and current administrations in the White House does not provide me with the confidence that this overhaul was necessary to the extent that it is today.

The European Union concluded the Schengen Agreements in 1995, which outlines the steps the EU takes when dealing with their borders. The concept was to allow free movement of European workers to move and settle in any EU State. Part of it states that “Any person, irrespective of nationality, may cross the internal borders without being subjected to border checks.” [1] There is a stipulation that border police can ask for identification during “spot checks”. If there is a serious security risk to an EU state, that state can introduce border security measures but must inform the European Parliament and Commission.
While tightening controls of external borders, rules were implemented in the agreement such as types of visas needed and how the checks at external borders have to be done, improved police cooperation including the right to cross-border surveillance, and a strong judicial cooperation through a faster extradition system and transfer of enforcement of criminal judgments.
EU’s Smart Borders plan is to improve the management of the external borders, fight against unequal immigration and provide information on people whose visas have expired but have not left, as well as facilitate border crossings for prescreened frequent third country national travelers. [2]
Like the EU, the US and Mexico have agreements on SMART Borders to help ease the flow of people and goods as well as secure the borders by blending efficient border management with state-of-the-art advanced technology. Rules are set in place to help facilitate the crossing of daily workers into the US and those going to Mexico to work at US plants.
Unlike the EU, the US/Mexican government do not have a system for cross border surveillance cooperation nor can any US or Mexico law enforcement agency cross each other’s borders in pursuit of a criminal. Also, the US and Mexico judicial systems are entirely different which makes transferring criminal judgments non-existent.

Truthfully, my perception of Homeland Security is a bloated bureaucracy which at times is inept, bad leadership, interagency non-cooperation, and political restraints. Although there are aspects of Homeland Security that have proved effective, the knee-jerk reaction of past and current administrations in the White House does not provide me with the confidence that this overhaul was necessary to the extent that it is today.

Abstract
This article examines the policy gaffes made by senior command-level personnel in the U.S. Bureau of
Alcohol, Tobacco, Firearms and Explosives (ATF) for Operation Fast and Furious. We examine how an
interdisciplinary approach to policy making and policy review may have averted the consequences
associated with this high profile news story.
Officer Down
On December 15, 2010, U.S. Border Patrol Agent Brian Terry was shot and killed in Arizona, near the
Mexican border while attempting to arrest a gang of armed subjects who were robbing illegal
immigrants. Agent Terry was hit in the pelvis by a round fired from an AK-47 rifle and later died at the
hospital. Four of the five armed subjects were immediately taken into custody (Cosgriff, n.d.).
Agent Terry’s tragic death was covered extensively by television and print media. Anytime a law
enforcement officer is gunned down, it is likely to get considerable coverage at the local level, and on
slow news days, at the national level too. Given the prominence of the illegal immigration issue in this
country, it is not surprising that Agent Terry’s death would make the national news, and linger for
several days longer than most law enforcement shooting deaths. However, even this story faded from
the mainstream media’s attention… at least it did for a while.
Like most police officer shooting cases, the Terry shooting would have quickly faded and been
supplanted by the type of news stories that seem to captivate the interest of the American public.
Stories such as Casey Anthony trial, the Anthony Weiner scandal, and the untimely death of pop singer
Amy Winehouse seemed to dominate the news in 2011. However, early that year, on February 23,
2011, CBS News first reported a link between Agent Terry’s death and a “gun running” operation
conducted by the U.S. Bureau of Alcohol Tobacco and Firearms (ATF). The Brian Terry story was back on
prime time news… and this time a scandal appeared to be brewing (Attkisson, 2011).
Congressional Investigation
As the story received more attention from the mainstream media outlets, some politicos in Washington
D.C. sensed the importance of this issue. Clearly something terrible had happened and not a lot of
information was being provided by ATF or Department of Justice officials. As more information slowly
became available to the public, it became evident that Agent Terry’s tragic death was only the tip of the
iceberg. Clearly, this case was taking a momentum beyond the unfortunate killing of a law enforcement
agent. It was now spilling over into the national political arena, and was becoming a possible wedge
issue for the upcoming presidential campaign in 2012. This incident was becoming a potential
embarrassment to the Obama administratio.

This bill codifies the original intent of the Border Prosecution Unit (BPU), which has been modeled after the Special Prosecution Unit in Walker County in Huntsville, Texas. It will put everything relating to the BPU into law. The border prosecution unit is an independent unit that cooperates with and supports border prosecuting attorneys in prosecuting border crimes. The unit is comprised of the following border prosecuting attorneys: the 34th, 38th, 49th, 63rd, 79th, 81st, 83rd, 112th, 143rd, 156th, 229th, 293rd, 452nd judicial districts, all other offices of district attorneys, criminal district attorneys or county attorneys with felony responsibility, created by the legislature whose jurisdiction lies with the border region. The unit will elect a governing board within their own which shall divide the unit into three regions (regional counsels), and shall set the boundaries of such regions from time to time as may be appropriate. The unit shall facilitate the coordination and collaboration with the border prosecuting attorneys, the unit’s regional counsel, and other law enforcement agencies, particularly the Texas Department of Public Safety, to more efficiently use the resources available to protect the border region. The regional counsel shall assist other regional councils and border prosecuting attorneys in prosecuting cases, screening cases, presenting cases to a grand jury and participating in the preparation and trial of cases. The counsel shall provide technical and legal assistance to investigative personnel. -more-

House Bill 12 will facilitate the BPU in prosecuting drug/border crimes (murder, kidnapping, extortion), criminal enterprises associated with cartels and drug trade, financial crimes and human trafficking. The bill will enhance relations between each district attorney, local DPS and law enforcement organizations on the ground. They will work together in the handling of cases that reach across county/jurisdictional boundaries. It will also implement threat-based operational goals and practices targeting gangs and other criminal organizations operating in Texas, including those in state prison facilities. Representative Oscar Longoria issued the following statement: “House Bill 12 is important because it places the Border Prosecution Unit into statute. This better allows local officials to prosecute border related crime, including: drug smuggling, murder, kidnapping, extortion, money laundering and human trafficking. The Border Prosecution Unit is vital in helping prosecutors screen cases, secure indictments and bring accused criminals to trial. This bill will give our prosecutors the resources and support they need to ensure that those who enslave, exploit and endanger others are put behind bars where they belong. When looking at securing the border, the approach the legislature is taking this session involves all facets of border security--- from enhancing law enforcement resources, increasing multiagency operations, strengthening human trafficking violations, and providing the proper resources needed by border prosecutors that deal with the legal side of these issues. Identifying and providing resources to all the areas identified will better allow us to create a stronger and safer border for all Texans."
