The Courthouse Station Homeowners Association adopted a new Policy Resolution regarding trash policies and procedures. The resolution defines what is considered garbage and appropriate trash containers. It establishes rules such as garbage must be in watertight containers with lids, other trash must be bagged and secured, and containers can be placed curbside after 6pm the night before pickup. The resolution also addresses owners' responsibility to cleanup any spilled trash and consequences for violations of the policy.

Purpose: Policies and Procedures Regarding Trash
WHEREAS, the purposes of the Courthouse Station Homeowners Association are to provide for
the maintenance, preservation and architectural control of the residential Lots and Common Area
within the community, and to promote the health, safety and welfare of the residents within the
community; and
WHEREAS, the Association’s Board of Directors has all powers needed to carry out the
purposes of the Association which are enabled by law or the governing documents of the
Association, and which are not specifically reserved to the members; and
WHEREAS, by law, the Board of Directors has the power to establish, adopt and enforce
rules and regulations with respect to use of the Common Area and with respect to such other
areas of responsibility assigned to the Association by the Declaration of Covenants, Conditions
and Restrictions;
NOW, THEREFORE, BE IT RESOLVED THAT in accordance with applicable
provisions of law and the Association’s governing documents the following Rules and
Regulations are hereby adopted:
1) All garbage shall be kept in an appropriate trash container. Garbage is defined as food
waste and/or discarded animal and vegetable matter. An appropriate trash container is
defined as a watertight, rodent-proof container with a tight-fitting lid.
2) Trash that does not contain garbage does not have to be placed in a watertight, rodent
proof container with a lid. Examples of trash that does not contain garbage include the
following: recycling, boxes, paper products (such as magazines, shredded documents,
etc.), yard waste and bulky items (like mattresses, lamps, mops, blinds, etc.). Each
resident is responsible for ensuring that all non-garbage trash items are adequately
bagged, bound and/or secured for pick-up on trash day.
3) Appropriate trash containers and trash (that does not contain garbage) may be placed
out for pick-up after 6:00 p.m. on the evening before a scheduled trash pick-up. All
trash items shall be adequately bound and secured.
4) All trash containers must be returned to storage inside the garage by the end of the
pick-up day. Trash containers may not be stored in the front yard, side yard, rear or on
second level decks.

2. 5) Should any un-secured trash escape from the owner’s containers and be blown around
the neighborhood, it is the owner’s responsibility to search the area around their home
and pick up their trash and put it into a secured container for removal on the next pick
up date.
6) If a violation of the above policy is observed at your property, owners will receive a
warning letter. A maximum of two (2) warning letters will be issued per address
regarding the violation of the association’s trash policy. After the second warning letter
is issued, a $25 charge will be assessed to the owner’s account per occurrence of each
violation thereafter. It is the owner’s responsibility to collect these charges from their
tenants if the property is rented.
7) It is recommended that trash containers and recycle bins be clearly marked with the
street address of the residence using the container. If the lid of the trash container is
detachable, the lid should also be marked with the user’s street address. Unmarked
containers and bins that are left out after the trash pick-up day shall be subject to
immediate confiscation and disposal.
This resolution was duly adopted by the Board of Directors this 14th day of February 2006 and
supercedes the previously published Garbage Policy dated June 1998.
