mechanismsgovernthe employmentrelationship:marketforces, employeerepresentation,andlaws
and regulations.Marketmechanismsrelyondemandandsupplytodetermine payandlaborallocation,
ensuringefficientutilizationof laborandproductionof itemsthatconsumerswant.Butmarketshave
imperfections,andevenperfectlyfunctioningonescanleadtoefficientoutcomes,butnotnecessarily
whatsocietywouldconsiderfair.
Employee representation,whichincludesunionsandotherdevicesforemployeevoice inthe workplace,
mitigatesmarketforcesbyproviding abargainingmechanismand/orassuringdue processto
employees.Some argue,however,thatunionsalsoreduce the managerial flexibilityandorganizational
competitivenessneededforjointsurvivalof employersandemployees.Lawsregulatingthe employment
relationshipare those governingcollectivebargaining,settingwagesandhours,banningdiscrimination,
fixinghealthandsafetystandards,andprovidingsocial insurance.
By establishingafloorbelowwhichmarkettransactionsare notallowedtooccur,labor regulationsand
legislationprovide asafetynetwhenthe marketmechanismcreatesdisadvantagesforworkers.
Freerflowof goods,capital,people,andideasacrossbordershasenhancedthe marketmechanismrole,
withdecisionsbeingmade onaglobal basis.Since laborflexibilityandadaptabilityenable employersto
respondquicklytochangingcircumstances,collective bargainingisputonthe defensive.Unionshave
beenunable toattainanyform of transnational collective bargainingandplummetingmembershipin
manycountriesmeansthattheyare lessable tosetnational standards.Domesticregulative initiatives
alsoare inhibitedbyfearof repellinginvestment.
GundersonandVermapointoutthat, fromits foundation,IRCwasinterestedinissuesof labor
standards,workervoice andfairwages,recognizingthat,while suchpracticesmaynotmaximize profits
inthe shortrun, employerswhopromote goodlaborstandardscanbenefitinthe longrunfrombetter
relations,improvedproductivity,and enhancedquality.
There wasanotherrationale forpromotingbetterlaborpolicy—reducingcompetitionamongfirmson
the basisof lowerlaborstandards.Indeed,Mackenzie Kingsetforththe “Law of CompetingStandards”
(basedonGresham’sLaw withrespect topreciousmetals),that,lefttomarketforces,laborstandards
woulddecline totheirlowestpossibledenominator.He arguedthatprogressive employersshould
undertake tostemthisslide because,indoingso,theywouldsecure theirfirms’andindeedcapitalism’s
future.
Corporate codesof conduct have beenadoptedamongthose firmsthatsubcontractproductionto
locallyownedandmanagedcompaniesindevelopingcountries,butthe issue of international labor
standardscontinuestofester.The authors see the International LaborOrganizationasthe bodybest
structuredto deal withglobal solutionstolaborproblems.The ILOfollowsavoluntary,cooperative
approach andrejectsthe use of trade sanctionsagainstcountriesthatdonot adoptits standards,
because laborstandardsmustreflectthe abilityof differentcountriestoaffordthem.
Theyconclude thatglobalizationhasimplicationsforall the stakeholdersinthe employment
relationship.Individual workersmustacquire the humancapital (educationandtraining) valuedinthe
marketand gear skillstowardsflexibilityandadaptability.Unionsshouldconcentrate onthose aspects
of theirrole—providingvoice,articulatingemployeepreferences,insuringdue process—thatdonot
implylarge costincreases.Governmentpolicyshouldemphasize adjustmentassistance thatfacilitates
