1. What is Patent design ?
 A design patent is a form of legal protection of the unique visual qualities
of a manufactured item. A design patent may be granted if the product has
a distinct configuration, distinct surface ornamentation or both. In other
words, a design patent provides protection for the ornamental design of
something that has a practical utility. In the United States, that means an
item that is substantially similar to something that has the protection of a
design patent may not be made, copied, used or imported into the
country. In other countries, a registered design may act as an alternative to
a design patent. In certain European countries, patent protection for
designs may be obtained for a fee and by meeting basic registration
requirements.

2. Types of patent design
 Generally patent design are three types
 1. Utility patent design
 2. Design patent design
 3. Trademark patent design

3. Utility Patent
 A utility patent is a patent that covers the creation of a new or improved
— and useful — product, process or machine. A utility patent, also known
as a “patent for invention,” prohibits other individuals or companies from
making, using or selling the invention without authorization. Utility patents
are very valuable assets because they give inventors exclusive commercial
rights to producing and utilizing the latest technology. In turn, utility
patents are difficult to obtain. For one, they are hard to write, the process
may be time consuming and expensive to undertake, and their complexity
may make them difficult to understand.

4. Design Patent
 When considering patents, most people think of utility patents, which are
issued for an apparatus, a process, a product, or a composition of matter. An
additional patent category, however, is the design patent, which can be
extremely valuable under the right circumstances.
 A utility patent has a detailed technical disclosure along with drawings (where
appropriate) and one or more claims. The claims of a utility patent list the
elements of the invention and establish the boundaries of patent coverage.
The design patent, by contrast, relies primarily upon the drawings to
communicate what is protected. The design patent has only one claim. This
claim, rather than listing any structure or describing the design in words,
generally refers to the drawings as a standard of what is protected. While
utility patents may be obtained for novel, useful, and unobvious inventions,
the design patent does not focus on utility; rather, it is directed toward an
ornamental design of an article of commerce. The United States Patent and
Trademark Office has defined the design of an object to be the visual
characteristics or aspects displayed by the object.

5. Trademark patent design
 Business and product owners file for a trademark. It protects a name, word,
slogan, symbol, design, and/or image identifying a business or brand and
distinguishing it from others in the same field.
 Registering a trademark enhances the rights of a person by providing legal
evidence and public notice of ownership. It is proof enough of a
nationwide exclusive right to the mark and allows the holder to sue an
infringer if the case calls for it. Registered trademarks can use the ®
symbol. Though a trademark is valid for an unlimited period of time, it
must be renewed every 10 years.

6. Paper size of patent drawings
 prefer A4 size sheets (21.0 x 29.7 cm) for all the Patent drawings as it is the
most acceptable sheet size, including the USPTO and the PCT.
The USPTO also accepts patent drawings on US Letter size i.e.- 8.5 x
11inches/21.6 x 27.9 cm.
We always recommend preparing patent drawings on A4 size as it is
suitable and make our client’s independent for foreign filings too. Not only
it saves our client’s time and effort, but also saves their money, hence
economical.

(f) Size of paper. All drawing sheets in an application must be the same
size. One of the shorter sides of the sheet is regarded as its top. The size of
the sheets on which drawings are made must be:
(1) 21.0 cm. by 29.7 cm. (DIN size A4), or
(2) 21.6 cm. by 27.9 cm. (8½ by 11 inches).
