You are hereby strictly directed to issue explanation notice to the employees named
below on the following allegations recorded by the undersigned on different occasions in your
presence and even when you are on leave;
i.) On Friday 2nd March, 2011, Mr. Haider Ali, Mr. Israr Ali, Mr. Qari Nasrullah,

a.) Prepare personal file folder for each employee of institute.
b.) Keep a new attendance register in your custody under lock and key whereas
staff may be directed to sign in their presence at 9am and 3pm every day by
signing the last column by you.
c.) To initiate immediate actions on the above lines under intimation to the
undersigned and the focal person PAITHOM and personal file of the employee.

verbally explained the honorable judge regarding the importance of record which was sealed by
the court which includes four hundred eleven certificates issue by the Prime Minister Secretariat
(Public) to be distributed to successful pass outs, the Institute camp office official record etc.
2. In response thereto, the honorable Judge enquired and instructed the CBA council as to
way, the orders of the court was violated and in what capacity? The council requested the
court for three days time to response in form of paragraph wise comments thereon and
which the court permitted with the direction to the undersigned to also attend the session
of the on 13-02-2012 to help the court in giving an appropriate judgment.

SUBJECT: DRAFT ADVERTISEMENT FOR BATCH-II AT MIANDAM
Dear Sir,
With reference to the completion of batch-I on 30-03-2012 at Mingora, the Batch-
II was supposed to be organized at Kalam but due to heavy snow fall this year the snow is still on
the ground that is why the subject batch is proposed to be conducted at Miandam considering the
weather conditions.
2. As such Miandam is a small summer resort ten kilometres (six miles) up a steep side
valley and 56 kilometers (35 mi) from Saidu Sharif, making it an hour's drive. The metaled road
passes small villages stacked up the hillside, the roofs of one row of houses forming the street for
the row of houses above. Tiny terraced fields march up the hillside right to the top. Miandam, is
a good place for walkers. Paths follow the stream, past houses with beehives set into the walls
and good-luck charms whitewashed around the doors. In the graveyards are carved wooden
grave posts with floral designs, like those used by Buddhists 1,000 years ago. Miandam is open
for tourists from March to October each year.
3. Whereas Kalam is 2070m high and 100 km from Mingora, it was the centre of an
independent state in the 19th century. It was later taken by Chitral then given to Swat after
partition. Kalam is 29 kilometres (18 miles) from Bahrain and about 2,000 metres (6,800 feet)
above sea level, the valley opens out, providing rooms for a small but fertile plateau above the
river. In Kalam the Ushu and Utrot rivers join to form the Swat River. The weather conditions
are favorable from July to October each year for tourists.
4. In lieu of the above it is proposed that Batch-II may kindly be conducted at
Miandam so that the passed out trainees may find jobs in the high peak tourist season this year
and ultimately take part in the development of tourism as a whole.

SUBJECT: SUMMARY FOR APPROVAL OF THE CABINET FOR MERGER OF

On reorganization of Federal Secretariat in pursuance of the Constitution (Eighteenth
Amendment) Act 2010 (Act No.X of 2010) the Pakistan Austrian Institute of Tourism and Hotel
Management (PAITHOM) along with employees under the Ministry of Tourism was transferred
to the Government of Khyber Pukhtunkhwa (Copy of the Notification attached as Annexure A)
2. The Institute was registered under Societies Act 1860 (XXI of 1860) on 4th June, 2003
(Annex-II) as a joint venture of Government of Pakistan and Austria to train manpower in
hospitality and tourism sector. The approval of the President of Pakistan regarding sanction of 93
posts was circulated by Ministry of Tourism vide letter No. 11(1)/2003-PAITHOM endorsed by
Deputy Financial Advisor, Finance Division (FA’s Organization (CSTY) No. 527-DFA (Cul)/04
to the Accountant General Pakistan Revenue, Islamabad and Peshawar to intimate that the
expenditure involved will be met from sanctioned budget under Demand No.20-Other
expenditure of Minorities, Culture, Sports, Tourism & Youth, Affairs Division—Pakistan
Austrian Institute of Hotel Management (PAITHOM), Guli Bagh, Swat to meet Pay and
Allowances of the staff. (Annex-III)
3. On a summary sent to the Prime Minister by Ministry of Tourism dated 02.01.2009 for
the renewal of contracts of employees of PAITHOM, Swat it was enquired by the Prime
Minister’s Secretariat (Public) vide letter No. PM Sectt’s U.O. No. 48(1)/Estab/2009 dated
07.02.2009 that, “Ministry of Tourism is requested to provide information as to whether these
employees are working against sanctioned

strength/ posts? In case the answer is yes, then why should they not be recruited on regular basis
in (PAITHOM)? (Annex-IV)
4. In response thereto, the Ministry of Tourism vide P&D Section’s U.O. No. 2(2)/2002-
Plng dated 20.02.2009 provided the requisite information as that all contract employees were
hired against the regular/sanctioned posts and Ministry supports the idea to regularize the
services of contract/ daily wages employees by accommodating them in National Pay Scales
with the assurance that Ministry shall first extend their contracts periods till regular recruitment.

5. Later on, the Ministry of Tourism regularized the services of 21 contract employees of
PAITHOM w.e.f 1st July, 2008 on instructions of the federal government vide establishment
division letter No. (Copies enclosed as Annex-VI) from BPS-1 to 15. Moreover, the Cabinet
Secretariat (Establishment Division) Government of Pakistan vide letter No.4/1/91-R.7/R.3 dated
6th September, 2000 intimated that the legal status of such organizations (Society & Corporation)
which are established through Resolutions came up for consideration before the Supreme Court
in Civil Appeal No. 154 of 1988, and it was held by the that the organizations established
through Resolutions were not bodies corporate but Government Departments, and their
employees were held to be civil servants (Annex-VII)
6. In view of the facts laid above, it is proposed that the Pay & Allowances in respect of
services of existing 29 employees of PAITHOM (Annex-VIII) may be regularized from
AG office permanently commemorating to their pay scales please.

SUBJECT: DAILY WAGES EMPLOYEES OF PAITHOM
Dear Sir,
With reference to the meeting held in the office of the Secretary regarding duty
routine of PAIHTOM cooks, the Secretary has desired that the matter of daily wage employees
other than regular employees may be examined in consultation with the Focal Person for their
termination being extra staff as the Institute is not fully functional and Institute and Hotel
building training is presently under the occupation of Pakistan Army. The following facts are
laid below regarding daily wage employees of PAITHOM;
i. The daily wages employees of PAITHOM can not be rightly termed as daily wager is
always appointed for less than 90 days and his appointment should have been
extended after every 89 days whereas in this case, these daily wages are working
regularly in PAITHOM for the last about 6 years to 10 years.
ii. That these employees were initially appointed on a one year contract on a lumpsum
salary of Rs: 4,800/- per month against sanctioned posts of PAIHTOM from BPS 1 to
5 of security guard, gardeners and driver. At next renewal they demand raise in
salaries and refused to sign contract papers. However neither their salaries were
enhanced nor were their services terminated.
iii. While according approval to regularization of 21 contract employees the Honorable
Federal Secretary has desired that a viable proposal may be prepared to regularize the
services of these daily wage employees because PAIHTOM as a society empowered
to regularize services of any staff as and when required.
iv. It is also pertinent to note that the Supreme Court decision on a civil appeal No. 154
of 1988 wherein it was held that organization established through resolution were not
bodies corporate but Government departments and their employees were held to be
civil servants (Copy enclosed as Annexure).
2. It is therefore submitted that in lieu of the facts elucidated above the matter of these so
called daily wages employees is reported herewith a list enclosed as desired please.

With reference to the PTDC case versus CBA Abbottabad wherein the undersigned
verbally explained the honorable judge regarding the importance of record which was sealed by
the court which includes four hundred eleven certificates issue by the Prime Minister Secretariat
(Public) to be distributed to successful pass outs, the Institute camp office official record etc.
4. In response thereto, the honorable Judge enquired and instructed the CBA council as to
way, the orders of the court was violated and in what capacity? The council requested the
court for three days time to response in form of paragraph wise comments thereon and
which the court permitted with the direction to the undersigned to also attend the session
of the on 13-02-2012 to help the court in giving an appropriate judgment.

31-03-2012 by the land lord which is self explanatory. The institute is presently executing three
month short certificate courses sponsored by NAVTEC in which 100 hundred trainees shall
complete their certificate on 30th March 2012.
2. The next batch of three month short term skill development courses shall be
conducted at Miandam Swat starting from April to June 2012, in fact, the second batch had to be
started in Kalam Swat but due to inappropriate weather conditions at Kalam, the second batch is
proposed to be executed at Miandam to the quarter concerned.
3. It is therefore requested that the Institute may kindly be allowed to execute the 2nd
training batch at Miandam, Swat at any rented hotel facility.

Kindly refer to our telephonic conversation on the subject noted above and to
further inform you that NAVTTC sponsored training Batch-I is going to be completed on 30th
March, 2011 and subsequently Institute has to make arrangements of training facility for 3-
month at Miandam starting from 1st April, 2011.
2. The undersigned has visited Miandam and found that most of the Hotels are closed
except a few which are run by locals owners. Only one Government owned PTDC Motel
is fully operational. The institute is used to organize NAVTTC sponsored trainings in
PTDC Motel in previous project due to provision of all facilities required for practical
orientations.
3. The rent of PTDC Motel for one one training hall plus one room shall be Rs:40000/- per
month while another private hotel namely the Miandam Palace Hotel is Rs:100000/ for 3
rooms and one small training hall (copy enclosed) hardly fit for seating 20 students at a
time.
4. You are therefore requested to kindly visit to PAITHOM Swat for carrying out training
evaluation and finalization of PTDC facility as proposed above on 30th March to 31st
March, 2012.

RULES AND REGULATIONS OF PAKISTAN AUSTRIAN
INSTITUTE OF TOURISM AND HOTEL MANAGEMENT
SWAT
1. DEFINITIONS
In the rules, unless otherwise referred to in the subject of the context, the following
expressions shall be interpreted as under;
“Board of Governors” or “the Board” means the Board of Governors set up under Rule 3.
Chief Accounts Officer means an officer so designated by the Board of Governors from time to
time.
Institute means the Austrian Institute of Tourism & Hotel Management,SWAT.
Rules or these Rules shall mean and include these rules and regulations for the time being in
force in accordance with the prescribed procedure.
2.REGISTERED OFFICE:
Registered office of the institute shall be situated at such place in Swat as the Board of
Governors may,from time to time determine.
3.ADMINISTRATIVE STRUCTURE OF THE INSTITUTE.
The organs of the Institute are:
.Board of Governors (supervisory Role)
.Executive Council (Executive Functions)
.Principal (Institute Head)
(I) BOARD OF GOVERNORS:
There shall be a Board of Governors consisting of not less than 19 and not more than 25
members.The Federal Government shall be empowered to constitute the board and to determine
its composition and the tenure of office as also to approve any replacement of its members that
may be necessary from time to time.
(II) FUNCTIONS AND POWERS OF THE BOARD:
Subject to supervision of Ministry of Tourism
Or the appropriate Ministry of the Federal Government,the Board shall have full authority to
determine and execute its policies undertakings,and shall:-
(i) Manage and administer the affairs of the Institute including Hotel.
(ii)Approve the course of studies.
(iii)Determine and /or approve the educational, research, extension,financial and other policies of
the Institute.
(iv) Request and receive grant-in-aid from the Federal government and other aid giving agencies.
(v)Approve the budget and receive half yearly statement of accounts of accounts and progress
reports.
(vi)From time to time, make and repeal, by-laws for the regulation of the business of the
Institute its officers and employee/staff.
(vii)Arrange for the audit of accounts by the duly appointed auditors and by comptroller and
Auditor General of Pakistan.
(viii)Purchase, acquire, mortgage, pledge, hypothecate or charge movable or immovable
property.
(ix)Borrow or lend money
(x)Construct to the chairman, Director, Committee or sub-committee or any other officer,
authority and responsibility for executing its policies.
(xi)Delegate to the chairman, Director, Committee or sub-committee or any other officer,
authority and responsibility for executing its policies.
(xii)Carry out, implement or deal with aims and objects of the Institute.
OFFICERS OF THE BOARD OF GOVERNORS:
(1) The following shall be the office of the Board :
(a) Chairman
(b)Vice Chairman
(c)Secretary
(2) The Chairman shall be appointed by the Federal Government from amongst the members and
shall hold office during the pleasure of the Government.
(3)The vice Chairman shall be elected annually by the members of the Board from amongst
themselves.
(4)The Principle/Director of the Institute shall be appointed by the Federal Government and shall
also serve as Secretary to the Board.
DUTIES OF THE OFFICE BEARERS:
(i)The Chairman or in his absence the Vice Chairman, shall preside over the meetings of the
Board. During the absence of both, the members present shall elect the amongst themselves to
preside over that meeting.
(ii)The members/secretary shall convene meetings of the Board with the approval of the
Chairman or the Vice Chairman in the absence of the Chairman. The member/secretary shall
keep a record of the proceedings of the meetings.
MEETINGS OF THE BOARD OF GOVERNORS:
(i)Meetings of the Board shall be convened as often as may be necessary and shall take place at
least once in every three months. Notice of a meeting shall issue once in every three months.
Notice of a meeting shall issue under the signature or authority of the Secretary and shall specify
the date, the time and the place of the meeting accompanied by the agenda.
(ii)The notice shall ordinarily be issued to the members not less than 7 days before the date of
meeting.
(iii)The quorum of a meeting of the Board shall be six.
(iv)All matters or decision shall be decided by a majority of the members present.
(v)Each member shall have one vote and in case of equality of votes, the chairman shall have a
second or casting vote.
(vi)Where an urgent decision has to be taken and there is no time to call a meeting of the Board,
the Secretary shall obtain the orders of the Chairman, who may, if he thinks fit, pass orders
forthwith on behalf of the Board, but in every such case the Chairman’s orders shall be placed
before the next meeting for confirmation/ratification. The chairman may authorize a circular
resolution which shall be deemed to have been passed, if the Resolution or copy thereof is signed
in token of approval by the majority of the Board of Governor.
(7) ADOURNED MEETING:
A meeting adjourned for want of time or quorum may proceed even if there is no quorum at the
subsequent meeting to which it adjourned.
(8) PROTECTION OF PROCEEDING:
No proceedings of a meeting shall be called into question by virtue of any vacancy in the body
by which it is held or for non-receipt of notice certified by the Chairman.
(9)APPOINTMENT OF COMMITTEE:
The Board of Governor may appoint Committee or sub-committee from time to time.
(10) FILLING OF CASUAL VACANCIES:
A member or officer bearer may cease to hold office in the Board of Governors or its
Committee/sub-committee because of registration, removal, demise or disability. The arising
vacancy shall as soon as possible be filled in by the Board of Governors.
(II) REMOVAL OF MEMBERS:
A member/office bearer of the Board of Governor or its committee/sub-committee shall be
removed from the membership by a resolution of the Board in case of his/her absence from the
three consecutive meetings of the Board or its committee/sub-committee expect for reasonable
cause and the consequential vacancy will be filled in as provided in sub rule (1) above.
11.ASSETS:
All movable and immovable properties of the Institute shall vest in the Institute but if the
Institute is wound up all such properties shall forthwith vest in the Federal Government. A
register of all movable and immovable properties shall be kept by the Director/Principle.
12 THE FUNCTION POWERS OF
PRINCIPLE/DIRECTOR:
1.General:
i. Shall have full authority subject to policy directives issued by the Federal Government in the
Ministry of Tourism to determine the details of the courses of study and the time table within the
Board outlines approved by the Board of Governors.
ii. To manage and provide services of the hotel of the Institute so as to make it profit generating
venture.
iii. To supervise, control and coordinate activities relating to Centre of Excellence,
Documentation Centre, Placement Services, Research and Reference functions of the Institute.
iv. Shall assign duties to the staff of the Institute.
v. Shall exercise in respect of the Institute such administrative and financial powers including
powers of delegation as may be delegated to him by the Board.
vi. May fill a post carrying a maximum pay as prescribed by the Board.
vii. Shall submit the annual budget of the Institute to the Board of Governors.
viii. Shall operate the bank and other accounts of the Institute within limits approved by the
Board of Governors.
ix. Shall prepare the annual report of the Institute for the Board of Governors and the Federal
Government.
x. Shall have power to incur miscellaneous contingent expenditure within the budgetary
provision.
xi. Shall exercise powers of a controlling officer in respect of his own bills and the traveling
allowance bill of the employees of the Board.
xii. Shall exercise such other powers as may as be entrusted to him by the Board.
Concept Paper for Promotion of Tourist Destinations in
Division of Khayber Pakhtunkhwa
At present, normalcy and peace prevails in Malakand Division which has not been possible
without the sustained and missionary efforts of Government of Khyber Pakhtunkhwa and
Pakistan Army after sacrifices of hundreds of innocent civil servants and public in general who
rightly deserve a due salute. No doubt, these martyrs sacrificed their lives for a great cause so
that the song of life never comes to an end with a broadband message that the secret of prosperity
lies in peace and tranquility.
War is the invention of all great art because war brings destruction and peace brings
construction. Swat and its dwellers are famous for their modernity and literacy since the times of
Wali-e-Swat. Even once, the British Queen has visited the city and recalled this city as the
Switzerland of Pakistan. Where the terrorism has damaged and deteriorated tourism
infrastructure and superstructure wherefrom thousands of families were used to get their bread
and butter but, thereon war on terror undoubtly brought rehabilitation and reconstruction by joint
efforts of Public and Private Sector.
The road to Kalam is open and reportedly it is even good for motor cars. Few patches are rough
but mostly smooth till Kalam right from Mingora. The security situation is normal and no fear
exists in local dwellers. The superstructure is closed due to non availability of tourists.
Now we are in a position to offer the residents of plain areas to enjoy their summer vacations and
holidays in cool and soothing natural environment at hill stations of upper swat without having
any fair. Before relaying this open offer we as a public sector may give incentive to private
sector in tourism and hospitality by taking a step towards their sustainability which has not been
possible in previous year by undertaking these steps;
Step I
To provide tourists a satisfactory holiday we may draw a policy by taking on board the private
sector which includes providers of transport, food and accommodation together with allied
facilities on terms of marketing their services to public at large through electronic and print
media, telemarketing and broachers and banners. By this we may able to provide on demand
comfortable and affordable transport, food & accommodation services to nature lovers of plain
areas by attracting them of the cool winds of upper swat from big cities. The providers of these
services ultimately shall get extra business than they have usual.
Step II
The hotel and restaurant business bore heavy damage and loss since mid 2007 to date as there are
no tourists. The private stake holder may be invited to the table and they may offered our
managed service agreement (wherein we may get their hotel on lease extendable on mutual
terms) so as to cater the needs of three types tourists i.e. elite class, white color class, aristocrats
and middle class people with special focus on students and families.
Step III
With the understanding of high level authorities of both the tourism department and Pakistan
Army to work for the same cause i.e promotion of tourism in swat by agreeing that transport
bringing tourists from big cities may be escorted by atleast one military personnel from departure
to arrival point so as to avoid frequent security checking after entering Malakand division. This
shall not only ensure a sense of travel safety in prospective tourists and they will not hesitate to
come with free mind to tourist attractive destinations.
Step IV
After taking assurance of coordination by above three steps we may offer value for money tour
packages for each class by working out actual expenditures in respect of full board plans
(accommodation with three meals) especially for students and families. Cottage and camping
lovers may also be offered viable packages. Group Youth packages, summer camps organizers
and Ramzan in Upper Swat may also be prepared. By motivating hotel owners to sell their
services using the TCKP platform. The hotel owners of upper Swat would love to accept this and
shall be even ready to go extra mile towards its achievement. Local people shall also be
contacted who usually rent out their purpose built house even in Ramzan along empty land for
camping with provision of local security on affordable terms so to revive tourism and to expect
revenue in ensuing seasons with greater flow of tourists.
Step V
To sell any product marketing is inevitable. As there is little time left in starting of high peak
tourist season it is necessary to initiate speedy marketing to attract targeted market which is only
possible through print media, telemarketing, sending these different packages through speedy
post to schools, colleges, universities, banks, pharmaceutical companies, textile and
manufacturing industries or identify local coordinators at big cities to relay the message.
Personal visits may also be arranged by deputing tourism experts to bring tourists in big cities.
The tourism promotional broachers and informative booklets may also be placed in shopping
malls, joy lands, hotels and restaurants and flippers may be placed in newspapers on holidays to
access the posh areas dwellers.
The FIRM USAID have also prepared a revised map of swat, telephone directory of Swat Hotel
Industry and Tour packages for this season at their own and got them printed too shall bring
them in coming STAG meeting. We may request them to assist us financially and ensure logistic
support to attract domestic tourist from big cities Punjab and Sindh as our cause to revive
tourism is common. Taking this step the financial implication on public sector shall also reduced
to minimum.
Step VI
A committee of experts shall be constituted on tourism experts to coordinate to achieve the
objectives of this marketing of tourism promotion in tourist attractive destinations of this region
consisting of Mr. Aftab Rana (USAID) who is also running Sustainable Tourism Foundation,
Mr. Zahoor Durani, who masters in arranging different age group of Youth Summer Camps, Mr.
Asif Javed, for being coordinator Hazara, Mr. Sajjad Hameed, Manager Admin & Properties, for
reporting progress to the competent authority and the undersigned. The main purpose of this
group should be to market tourism product ensuring harmony and peace with assured travel
safety to attract prospective tourists from plain areas.

Demanchi Hotel Naran) Coordinator Hazara Division at Abbottabad wherein he requested to
develop a Two Week Crash Training Programme at Naran for which the ToR’s are submitted as
follows;
Terms of Reference
1. The M/s Asif Javed being a stake holder at Naran shall identify and select trainees for a
Two Week Crash Training Programme for waiters, Room Boy/House Man and Front Office at
the place so provided by them for the purpose.
2. The PAITHOM shall provide two instructors for training while their boarding and
lodging shall be the responsibility of M/s Asif Javed
3. The PAITHOM shall develop the curriculum/training Schedule( copies and closed) and
the provision of provide training books to the training and shall conduct test at the end of training
for grading and certification.
4. M/s Asif Javed shall ensure the placement of advertisement, banners at the training
place/venue when before time of the starting of training.
5. It will be the liability of M/s Asif Javed to provide class room, white board, multimedia
and students stationary to the selected candidates. Not more than 30 trainings in each class may
be selected.
6. The trainings date shall be finalized by M/s Asif Javed as per their convenience and may
be intimated to PAITHOM for insuring availability of instructors well before time.
7. The attendance sheet, register shall b maintain by instructor provided by PAITHOM for
maintenance of trainings record.
8. In case of any change in the training programme by either party may b intimated in black
and white to each other well before time so that this change in programme may b intimated to the
concerned.

Dear Sir,
Kindly refer to the short training program for training of 15 trainees identified and
selected by SRSP for facilitation of tourists to provide better guest service and also to provide
them an opportunity to get self employment. The PAITHOM provided the institutional faculty
including trainee text books as per scheduled program started on 21st of April, 2012 in 4 days
training session of 24 hours followed by orientation visits.
2. The shortcoming of the training was that no training aids (White Boards &
Marker, Flip Charts, Multimedia & Student Writing Pads etc.) have been provided by the SRSP
as intimated by Mr. Zahur Durani to the undersigned telephonically but practically nothing was
made available during the training.
3. However, high caliber training was ensured to equip trainees to coop with the
competitors in the market working as drivers and other local transporters who are already
engaged in the same business. It is also requested that if next time any training is planned to be
organized in hospitality and tourism sector by SRSP of any other government or non government
organization the PAITHOM may be approached through Focal Person at Tourism Department to
ensure timely arrangement of training material and training aid.

PAITHOM is a joint venture of Government of Pakistan and Austria for a core objective to train
manpower in hospitality and tourism sector for which a well equipped institute with sufficient
infrastructure has been developed at Gulibagh, Swat Khyber Pakhtunkhwa at a total cost of Rs.140.8
Million along with share of Austrian Government of 32000 SHILLINGS. The Institute (PAITHOM) was
got registered as a non-for-profit society under Societies Act XXI of 1860 on 4th
june, 2003 (Annex-I)
2. To run the activities of the organization, the President of Pakistan accorded sanction of 93 regular
posts circulated by Ministry of Tourism, Islamabad vide letter No.11(1)/2003-PAITHOM, dated 10-04-
2004(Annex-II).
3. In the year 2009, the Ministry of Tourism (defunct) sought approval of Prime Minister Secretariat
Public for extension in contracts period of 28 contract employees on which the PM inquired that whether
these employees are working against sanctioned strength/posts? In case the answer is yes, then why
should they not be recruited on regular basis in PAITHOM and in response thereto the Ministry submitted
that we support the idea of regularization of these employees but first their contracts may be extended
from the date of expiry of their contracts till regular recruitment (Copies enclosed as Annex-III)
4. Later, in light of Establishment Division, Islamabad letter No.10/30/2008-R-II, dated 29-08-2008
(Annex-III), the services of 21 contract employees from BPS-01 to 15 were regularized w.e.f 1st
July,
2008 by the Secretary Ministry of Tourism, Islamabad being an Ex-officio Chairman Board of Governor
PAITHOM vide order No. 2(25)/2002-Plug (pt-III) dated 09-02-2011.
5. Board of Governors has framed service rules for PAITHOM’S employees and according to its
Chapter-II “Employment Policy & Procedure” under rules #10 Secretary/Chairman Board of Governors is
the appointing authority to fill the posts of BPS-16 and above (Annex-VI)
7. Presently, two officers are rendering services in BPS-19 w.e.f 22-10-2007 and BPS-16 w.e.f 17-
10-2007 in PAITHOM, therefore, the services period of the officers are proposed to be regularized w.e.f
the same dates. However, the financial benefits are proposed to be admissible with effect from the
approval of draft proposal.

five districts of Khyber Pakhtunkhwa namely, District Abbottabad at Galiyat & Ayubia), District

Hospitality and Tourism has become the biggest revenue generator as compare to other industries
of the world. Since industrial revolution it has been graded as the largest and one of the fastest growing
industry around the globe. There are some developing countries in South Asia whose economies depend
on this industry.
2. Like-wise, Pakistan, no doubt, has great potential for the development of this industry but some
inevitable accidents deteriorated the infrastructure and superstructure of tourism destinations in
Himalayan and Karakoram Range resulting into thin tourist flow to these destinations in preceding years.
3. This year there has been a proliferation of tourists thronging to Naran Valley via Murree for its
cool weather conditions and scenic picturesque of this panoramic valley. Unfortunately, we lack in proper
tourism administration structure for sustainability and preservation of such national asset.
4. Having agreed on this threatening issue the Secretary Tourism has kindly taken an initiative and
is reluctant to take all stake holders engaged in tourism education to participate in this eco-tourism waste
cleaning activity to provide future leaders of this industry to learn multicultural team work environment,
surviving on high altitudes, camping techniques, hiking and trekking procedures and much more.
5. TCKP & PAITHOM has joined hands together to host this tourist waste cleaning activity based
learning from re-known tourism experts with free camping accommodation (tents+ sleeping bags+
Mattress) as well as provision of sacks for waste dumping. We welcome students & their mentors to avail
this opportunity for helping preservation of eco-tourism of Khyber Pakhtunkhwa on first come first
served basis. The cost of transportation and meals is to be borne by the participating institutions/
organizations; however, we have made arrangements of 3-meal student food plan @500 daily. In addition

in respect of application submitted by the Mr. Hassan Ex. Contract employee PAITHOM dated
27th July, 2012 as desired by your kind office please.
Para-wise comments
i). The applicant was appointed on contract (renewable on mutual consent) basis for a period
of one year as F&B Manager in PAITHOM on 12th June, 2006 on a lump-sum salary of Rs:
15,000/- per month by the Ministry of Tourism, Islamabad. His contract was renewed with 15%
raise for another year till 11th June 2007. In the last quarter of 2007 the insurgents militant
activities started in Swat and the institute remained closed till April 2008. The institute started
again in April 2008 in presence of the security forces at PAITHOM. He submitted an application
for 3 weeks leave on 28th May, 2008 which was not allowed to him under contract service terms
and conditions by the then Incharge Mr. Liaqat Raza observing that his contract is going to
expire on 12th June, 2008. Mr. Hassan slipped away from the PAITHOM without intimating any
responsible person of the Institute in the early morning of 1st June 2012. The then Incharge
PAITHOM tried several times to contact him on his mobile number but he had switched off his
mobile. On his continuous absence from the show cause notices were sent on his home address
among which one of them was received by his wife. After having no response his contract
services stood terminated in accordance with the terms & condition of the contract appointment
that employer reserves the right to terminate contract service without assigning any reason from
the Institute. His claim that institute was not functional is not correct because institute along with
employees was temporarily shifted to PTDC Tourist Facilitation Center Abbottabad.
ii. Secondly, his claim that PAITHOM employees were appointed on bogus degrees is not
correct as the Ministry has hired all the staff after giving advertisement in local and national
dailies however appointment on posts of class IV requires the ability to read & write but no
qualification. However, the credentials of existing employees are attached herewith for
verification from the quarter concerned please.
iii. As he is not a bona-fide employee since 13th May, 2008 of the institute so his claim for
release of salaries is out of question.
iv. The credentials of all PAITHOM existing employees are enclosed herewith for
verification.
v. Reportedly he absconded from duty without leaving any luggage.
vi. The applicant has submitted the same request once to Secretary Ministry of Tourism for
release of salaries, compensation, placement and if not issuance of an experience letter however
experience letter was issued to him wherefore the relevant record is presently held by the court of
law at Abotabbad in case PTDC Vs CBA. Thus his request for placement cannot be acceded to
because he is not employee of PAITHOM.

Subject: JUSTIFICATION FOR REVISED PC-I TRAINING HOURS
Dear Sir,
Kindly refer to our telephonic conversation on the subject cited above the following
justification is given below for your kind perusal in the matter please.
 Firstly, it was instruction of the NAVTTC Head Office that PC-I may be revised within
the sanctioned budget of the Project so adhering to same instruction the training hours
has been adjusted.
 Secondly, the training delivery structure regarding hospitality and tourism courses is quit
different from other trades. It requires hand on practice exposure commemorating to
their theoretical hours. The institute, that is why, executes such courses in a professional
running hotel environment so that trainees may get their practice comprising on 3 hours
daily @ 24 days a month to a total of 450 hours per course for 6 months.
2. In lieu of the justification it is clear that a trainee ultimately gets 600 hours training per
course.

PTDC MOTEL, MIANDAM SWAT
Dear Sajjad Sahab,
Kindly refer to our visit to PTDC Motel Miandam Swat to evaluate courses in Hospitality
& Tourism Sector conducted by PAITHOM started w.e.f 10th
April 2012 to 9th
July, 2012 in five trades
namely, 1. Front Office,2. Housekeeping, 3. F&B Service, 4. F&B Production, 5. Tourist Guide.
2. The undersigned along with Mr. Zahid Khan has visited the training venue on 26th
of
June 2012 and inspected the on going classes on 27th
June 2012 at 900 Hrs sharp in the morning till the
last class at 4pm in the evening and found the following strengths and weakness as detailed below and the
same are hereby suggested for betterment of the courses curricula;
1. The training of 2nd
Batch was much better and equipped with more logistic facility then the 1st
Batch
at Peoples Square at Mingora which was not suitable in a way or other.
2. The repetition drill carried on by the instructional staff for giving real life experience to the trainees
was appreciable because it enhances the training value and job orientation.
3. The instructional faculty was found satisfactory and their command on the relevant trade/course.
4. The attendance percentage of the various trades were up to mark and satisfactory as well as of
trainers.
5. It is suggested that sufficient funds for practical orientation of job may be sanctioned so that each
trainee may get a chance foron handspractice.
6. The 3rd
batch is highly appreciated if executed in Diamond Hills Hotel or Sangam Hotel considering
weather conditions of extreme snow fall in Kalam. If not possible the same batch may be conducted at
Swat University Campus by allocating 50% seats for Behrain/Kalam starting from October to March
so that the trained skill force may take active participation in next season while doing jobs in the
Local Hotel

3. Report is submitted along with evaluation forms duly filled in by trainees of 2nd
Batch as desired
by your kind office for further necessary action please.

Dear Sir,
Kindly refer to the subject noted above it is stated that a current account titled, “Hotel
Training Institute” No.1812-7 amounting to Rs.8.9 million maintained at National Bank of
Pakistan Super Market Branch is required to be transferred to Swat to be deposited as fix deposit
for earning yearly income profit @11.5% offered by Bank of Punjab & Alfalah Bank.
2. The subject account was maintained by Ministry of Tourism Islamabad and its two
officials were operating this account namely Mr. Muhammad Sharif (PRO) & Mr. Nasir Hayat
(Assistant Chief) afterwards under the implementation of the 18th constitutional amendment the
account was got transferred to PAITHOM Swat being its welfare account while the previous
signatories were changed as 1. Mr. Hurmat Yab Khan, (Incharge PAITHOM) 2. Mr. Sajjad
Hameed (MAP) TCKP
3. As per codal formality of the subject the new signatories are required to place their
specimen signatures in person to get this transfer done. It is therefore requested that approval of
the competent authority may be sought for visit to Islamabad w.e.f 13th to 14th September, 2012
please.

Ref No. 3(4)/2011/PAITHOM-NAVTEC Dated: 09/03/2012 To Regional Director, NAVTEC Prime Minister Secretariat (Public) Peshawar SUBJECT: DRAFT ADVERTISEMENT FOR BATCH-II AT MIANDAM Dear Sir, With reference to the completion of batch-I on 30-03-2012 at Mingora, the Batch- II was supposed to be organized at Kalam but due to heavy snow fall this year the snow is still on the ground that is why the subject batch is proposed to be conducted at Miandam considering the weather conditions. 2. As such Miandam is a small summer resort ten kilometres (six miles) up a steep side valley and 56 kilometers (35 mi) from Saidu Sharif, making it an hour's drive. The metaled road passes small villages stacked up the hillside, the roofs of one row of houses forming the street for the row of houses above. Tiny terraced fields march up the hillside right to the top. Miandam, is a good place for walkers. Paths follow the stream, past houses with beehives set into the walls and good-luck charms whitewashed around the doors. In the graveyards are carved wooden grave posts with floral designs, like those used by Buddhists 1,000 years ago. Miandam is open for tourists from March to October each year. 3. Whereas Kalam is 2070m high and 100 km from Mingora, it was the centre of an independent state in the 19th century. It was later taken by Chitral then given to Swat after partition. Kalam is 29 kilometres (18 miles) from Bahrain and about 2,000 metres (6,800 feet) above sea level, the valley opens out, providing rooms for a small but fertile plateau above the river. In Kalam the Ushu and Utrot rivers join to form the Swat River. The weather conditions are favorable from July to October each year for tourists. 4. In lieu of the above it is proposed that Batch-II may kindly be conducted at Miandam so that the passed out trainees may find jobs in the high peak tourist season this year and ultimately take part in the development of tourism as a whole. SUBJECT: SUMMARY FOR APPROVAL OF THE CABINET FOR MERGER OF PAITHOM EMPLOYEES PAY & ALLOWANCES ON PAY ROLLOF GOVERNMENT OF KYBER PUKHTUNKHWA On reorganization of Federal Secretariat in pursuance of the Constitution (Eighteenth Amendment) Act 2010 (Act No.X of 2010) the Pakistan Austrian Institute of Tourism and Hotel Management (PAITHOM) along with employees under the Ministry of Tourism was transferred to the Government of Khyber Pukhtunkhwa (Copy of the Notification attached as Annexure A) 2. The Institute was registered under Societies Act 1860 (XXI of 1860) on 4th June, 2003 (Annex-II) as a joint venture of Government of Pakistan and Austria to train manpower in hospitality and tourism sector. The approval of the President of Pakistan regarding sanction of 93 posts was circulated by Ministry of Tourism vide letter No. 11(1)/2003-PAITHOM endorsed by Deputy Financial Advisor, Finance Division (FA’s Organization (CSTY) No. 527-DFA (Cul)/04 to the Accountant General Pakistan Revenue, Islamabad and Peshawar to intimate that the expenditure involved will be met from sanctioned budget under Demand No.20-Other expenditure of Minorities, Culture, Sports, Tourism & Youth, Affairs Division—Pakistan Austrian Institute of Hotel Management (PAITHOM), Guli Bagh, Swat to meet Pay and Allowances of the staff. (Annex-III) 3. On a summary sent to the Prime Minister by Ministry of Tourism dated 02.01.2009 for the renewal of contracts of employees of PAITHOM, Swat it was enquired by the Prime Minister’s Secretariat (Public) vide letter No. PM Sectt’s U.O. In response thereto, the Ministry of Tourism vide P&D Section’s U.O. No. 2(2)/2002- Plng dated 20.02.2009 provided the requisite information as that all contract employees were hired against the regular/sanctioned posts and Ministry supports the idea to regularize the services of contract/ daily wages employees by accommodating them in National Pay Scales with the assurance that Ministry shall first extend their contracts periods till regular recruitment. (Annex-V) 5. Later on, the Ministry of Tourism regularized the services of 21 contract employees of PAITHOM w.e.f 1st July, 2008 on instructions of the federal government vide establishment division letter No. (Copies enclosed as Annex-VI) from BPS-1 to 15. Moreover, the Cabinet Secretariat (Establishment Division) Government of Pakistan vide letter No.4/1/91-R.7/R.3 dated 6th September, 2000 intimated that the legal status of such organizations (Society & Corporation) which are established through Resolutions came up for consideration before the Supreme Court in Civil Appeal No. 154 of 1988, and it was held by the that the organizations established through Resolutions were not bodies corporate but Government Departments, and their employees were held to be civil servants (Annex-VII) 6. In view of the facts laid above, it is proposed that the Pay & Allowances in respect of services of existing 29 employees of PAITHOM (Annex-VIII) may be regularized from AG office permanently commemorating to their pay scales please. The following facts are laid below regarding daily wage employees of PAITHOM; i. The daily wages employees of PAITHOM can not be rightly termed as daily wager is always appointed for less than 90 days and his appointment should have been extended after every 89 days whereas in this case, these daily wages are working regularly in PAITHOM for the last about 6 years to 10 years. ii. That these employees were initially appointed on a one year contract on a lumpsum salary of Rs: 4,800/- per month against sanctioned posts of PAIHTOM from BPS 1 to 5 of security guard, gardeners and driver. At next renewal they demand raise in salaries and refused to sign contract papers. However neither their salaries were enhanced nor were their services terminated. iii. While according approval to regularization of 21 contract employees the Honorable Federal Secretary has desired that a viable proposal may be prepared to regularize the services of these daily wage employees because PAIHTOM as a society empowered to regularize services of any staff as and when required. iv. It is also pertinent to note that the Supreme Court decision on a civil appeal No. 154 of 1988 wherein it was held that organization established through resolution were not bodies corporate but Government departments and their employees were held to be civil servants (Copy enclosed as Annexure). 2. It is therefore submitted that in lieu of the facts elucidated above the matter of these so called daily wages employees is reported herewith a list enclosed as desired please.   • 21. RULES AND REGULATIONS OF PAKISTAN AUSTRIAN INSTITUTE OF TOURISM AND HOTEL MANAGEMENT SWAT 1. DEFINITIONS In the rules, unless otherwise referred to in the subject of the context, the following expressions shall be interpreted as under; “Board of Governors” or “the Board” means the Board of Governors set up under Rule 3. Chief Accounts Officer means an officer so designated by the Board of Governors from time to time. Institute means the Austrian Institute of Tourism & Hotel Management,SWAT. Rules or these Rules shall mean and include these rules and regulations for the time being in force in accordance with the prescribed procedure. 2.REGISTERED OFFICE: Registered office of the institute shall be situated at such place in Swat as the Board of Governors may,from time to time determine. 3.ADMINISTRATIVE STRUCTURE OF THE INSTITUTE. The organs of the Institute are: .Board of Governors (supervisory Role) .Executive Council (Executive Functions) .Principal (Institute Head) (I) BOARD OF GOVERNORS: There shall be a Board of Governors consisting of not less than 19 and not more than 25 members.The Federal Government shall be empowered to constitute the board and to determine its composition and the tenure of office as also to approve any replacement of its members that may be necessary from time to time. (II) FUNCTIONS AND POWERS OF THE BOARD: Subject to supervision of Ministry of Tourism Or the appropriate Ministry of the Federal Government,the Board shall have full authority to determine and execute its policies undertakings,and shall:- (i) Manage and administer the affairs of the Institute including Hotel. (ii)Approve the course of studies. (iii)Determine and /or approve the educational, research, extension,financial and other policies of the Institute. (iv) Request and receive grant-in-aid from the Federal government and other aid giving agencies. (v)Approve the budget and receive half yearly statement of accounts of accounts and progress reports. (vi)From time to time, make and repeal, by-laws for the regulation of the business of the Institute its officers and employee/staff. (vii)Arrange for the audit of accounts by the duly appointed auditors and by comptroller and Auditor General of Pakistan. (viii)Purchase, acquire, mortgage, pledge, hypothecate or charge movable or immovable property. (ix)Borrow or lend money
  • 22. (x)Construct to the chairman, Director, Committee or sub-committee or any other officer, authority and responsibility for executing its policies. (xi)Delegate to the chairman, Director, Committee or sub-committee or any other officer, authority and responsibility for executing its policies. (xii)Carry out, implement or deal with aims and objects of the Institute. OFFICERS OF THE BOARD OF GOVERNORS: (1) The following shall be the office of the Board : (a) Chairman (b)Vice Chairman (c)Secretary (2) The Chairman shall be appointed by the Federal Government from amongst the members and shall hold office during the pleasure of the Government. (3)The vice Chairman shall be elected annually by the members of the Board from amongst themselves. (4)The Principle/Director of the Institute shall be appointed by the Federal Government and shall also serve as Secretary to the Board. DUTIES OF THE OFFICE BEARERS: (i)The Chairman or in his absence the Vice Chairman, shall preside over the meetings of the Board. During the absence of both, the members present shall elect the amongst themselves to preside over that meeting. (ii)The members/secretary shall convene meetings of the Board with the approval of the Chairman or the Vice Chairman in the absence of the Chairman. The member/secretary shall keep a record of the proceedings of the meetings. MEETINGS OF THE BOARD OF GOVERNORS: (i)Meetings of the Board shall be convened as often as may be necessary and shall take place at least once in every three months. Notice of a meeting shall issue once in every three months. Notice of a meeting shall issue under the signature or authority of the Secretary and shall specify the date, the time and the place of the meeting accompanied by the agenda. (ii)The notice shall ordinarily be issued to the members not less than 7 days before the date of meeting. (iii)The quorum of a meeting of the Board shall be six. (iv)All matters or decision shall be decided by a majority of the members present. (v)Each member shall have one vote and in case of equality of votes, the chairman shall have a second or casting vote. (vi)Where an urgent decision has to be taken and there is no time to call a meeting of the Board, the Secretary shall obtain the orders of the Chairman, who may, if he thinks fit, pass orders forthwith on behalf of the Board, but in every such case the Chairman’s orders shall be placed before the next meeting for confirmation/ratification. The chairman may authorize a circular resolution which shall be deemed to have been passed, if the Resolution or copy thereof is signed in token of approval by the majority of the Board of Governor. (7) ADOURNED MEETING: A meeting adjourned for want of time or quorum may proceed even if there is no quorum at the subsequent meeting to which it adjourned. (8) PROTECTION OF PROCEEDING: No proceedings of a meeting shall be called into question by virtue of any vacancy in the body by which it is held or for non-receipt of notice certified by the Chairman.
  • 23. (9)APPOINTMENT OF COMMITTEE: The Board of Governor may appoint Committee or sub-committee from time to time. (10) FILLING OF CASUAL VACANCIES: A member or officer bearer may cease to hold office in the Board of Governors or its Committee/sub-committee because of registration, removal, demise or disability. The arising vacancy shall as soon as possible be filled in by the Board of Governors. (II) REMOVAL OF MEMBERS: A member/office bearer of the Board of Governor or its committee/sub-committee shall be removed from the membership by a resolution of the Board in case of his/her absence from the three consecutive meetings of the Board or its committee/sub-committee expect for reasonable cause and the consequential vacancy will be filled in as provided in sub rule (1) above. 11.ASSETS: All movable and immovable properties of the Institute shall vest in the Institute but if the Institute is wound up all such properties shall forthwith vest in the Federal Government. To manage and provide services of the hotel of the Institute so as to make it profit generating venture. iii. Shall operate the bank and other accounts of the Institute within limits approved by the Board of Governors. ix. Shall have power to incur miscellaneous contingent expenditure within the budgetary provision. xi. Shall exercise powers of a controlling officer in respect of his own bills and the traveling allowance bill of the employees of the Board. xii. Shall exercise such other powers as may as be entrusted to him by the Board. No doubt, these martyrs sacrificed their lives for a great cause so that the song of life never comes to an end with a broadband message that the secret of prosperity lies in peace and tranquility. War is the invention of all great art because war brings destruction and peace brings construction. Swat and its dwellers are famous for their modernity and literacy since the times of Wali-e-Swat. Even once, the British Queen has visited the city and recalled this city as the Switzerland of Pakistan. Where the terrorism has damaged and deteriorated tourism infrastructure and superstructure wherefrom thousands of families were used to get their bread and butter but, thereon war on terror undoubtly brought rehabilitation and reconstruction by joint efforts of Public and Private Sector. The road to Kalam is open and reportedly it is even good for motor cars. Few patches are rough but mostly smooth till Kalam right from Mingora. The security situation is normal and no fear exists in local dwellers. The superstructure is closed due to non availability of tourists. Now we are in a position to offer the residents of plain areas to enjoy their summer vacations and holidays in cool and soothing natural environment at hill stations of upper swat without having any fair. Before relaying this open offer we as a public sector may give incentive to private sector in tourism and hospitality by taking a step towards their sustainability which has not been possible in previous year by undertaking these steps; Step I To provide tourists a satisfactory holiday we may draw a policy by taking on board the private sector which includes providers of transport, food and accommodation together with allied facilities on terms of marketing their services to public at large through electronic and print media, telemarketing and broachers and banners. By this we may able to provide on demand comfortable and affordable transport, food & accommodation services to nature lovers of plain areas by attracting them of the cool winds of upper swat from big cities. The providers of these services ultimately shall get extra business than they have usual. Step II The hotel and restaurant business bore heavy damage and loss since mid 2007 to date as there are no tourists. The private stake holder may be invited to the table and they may offered our managed service agreement (wherein we may get their hotel on lease extendable on mutual terms) so as to cater the needs of three types tourists i.e. elite class, white color class, aristocrats and middle class people with special focus on students and families. Step III With the understanding of high level authorities of both the tourism department and Pakistan Army to work for the same cause i.e promotion of tourism in swat by agreeing that transport bringing tourists from big cities may be escorted by atleast one military personnel from departure to arrival point so as to avoid frequent security checking after entering Malakand division. This shall not only ensure a sense of travel safety in prospective tourists and they will not hesitate to come with free mind to tourist attractive destinations. Step IV

After taking assurance of coordination by above three steps we may offer value for money tour packages for each class by working out actual expenditures in respect of full board plans (accommodation with three meals) especially for students and families. Cottage and camping lovers may also be offered viable packages. Group Youth packages, summer camps organizers and Ramzan in Upper Swat may also be prepared. By motivating hotel owners to sell their services using the TCKP platform. The hotel owners of upper Swat would love to accept this and shall be even ready to go extra mile towards its achievement. Local people shall also be contacted who usually rent out their purpose built house even in Ramzan along empty land for camping with provision of local security on affordable terms so to revive tourism and to expect revenue in ensuing seasons with greater flow of tourists. Step V To sell any product marketing is inevitable. As there is little time left in starting of high peak tourist season it is necessary to initiate speedy marketing to attract targeted market which is only possible through print media, telemarketing, sending these different packages through speedy post to schools, colleges, universities, banks, pharmaceutical companies, textile and manufacturing industries or identify local coordinators at big cities to relay the message. Personal visits may also be arranged by deputing tourism experts to bring tourists in big cities. The tourism promotional broachers and informative booklets may also be placed in shopping malls, joy lands, hotels and restaurants and flippers may be placed in newspapers on holidays to access the posh areas dwellers. The FIRM USAID have also prepared a revised map of swat, telephone directory of Swat Hotel Industry and Tour packages for this season at their own and got them printed too shall bring them in coming STAG meeting. We may request them to assist us financially and ensure logistic support to attract domestic tourist from big cities Punjab and Sindh as our cause to revive tourism is common. Taking this step the financial implication on public sector shall also reduced to minimum. Step VI A committee of experts shall be constituted on tourism experts to coordinate to achieve the objectives of this marketing of tourism promotion in tourist attractive destinations of this region consisting of Mr. Aftab Rana (USAID) who is also running Sustainable Tourism Foundation, Mr. Zahoor Durani, who masters in arranging different age group of Youth Summer Camps, Mr. Asif Javed, for being coordinator Hazara, Mr. Sajjad Hameed, Manager Admin & Properties, for reporting progress to the competent authority and the undersigned. The main purpose of this group should be to market tourism product ensuring harmony and peace with assured travel safety to attract prospective tourists from plain areas.

The Institute (PAITHOM) was got registered as a non-for-profit society under Societies Act XXI of 1860 on 4th june, 2003 (Annex-I) 2. To run the activities of the organization, the President of Pakistan accorded sanction of 93 regular posts circulated by Ministry of Tourism, Islamabad vide letter No.11(1)/2003-PAITHOM, dated 10-04- 2004(Annex-II). 3. In the year 2009, the Ministry of Tourism (defunct) sought approval of Prime Minister Secretariat Public for extension in contracts period of 28 contract employees on which the PM inquired that whether these employees are working against sanctioned strength/posts? In case the answer is yes, then why should they not be recruited on regular basis in PAITHOM and in response thereto the Ministry submitted that we support the idea of regularization of these employees but first their contracts may be extended from the date of expiry of their contracts till regular recruitment (Copies enclosed as Annex-III) 4. Later, in light of Establishment Division, Islamabad letter No.10/30/2008-R-II, dated 29-08-2008 (Annex-III), the services of 21 contract employees from BPS-01 to 15 were regularized w.e.f 1st July, 2008 by the Secretary Ministry of Tourism, Islamabad being an Ex-officio Chairman Board of Governor PAITHOM vide order No. 2(25)/2002-Plug (pt-III) dated 09-02-2011. 5. Board of Governors has framed service rules for PAITHOM’S employees and according to its Chapter-II “Employment Policy & Procedure” under rules #10 Secretary/Chairman Board of Governors is the appointing authority to fill the posts of BPS-16 and above (Annex-VI) 7. Unfortunately, we lack in proper tourism administration structure for sustainability and preservation of such national asset. 4. Having agreed on this threatening issue the Secretary Tourism has kindly taken an initiative and is reluctant to take all stake holders engaged in tourism education to participate in this eco-tourism waste cleaning activity to provide future leaders of this industry to learn multicultural team work environment, surviving on high altitudes, camping techniques, hiking and trekking procedures and much more. 5. TCKP & PAITHOM has joined hands together to host this tourist waste cleaning activity based learning from re-known tourism experts with free camping accommodation (tents+ sleeping bags+ Mattress) as well as provision of sacks for waste dumping. We welcome students & their mentors to avail this opportunity for helping preservation of eco-tourism of Khyber Pakhtunkhwa on first come first served basis. The para-wise comments in respect of application submitted by the Mr. Hassan Ex. Contract employee PAITHOM dated 27th July, 2012 as desired by your kind office please. Para-wise comments i). The applicant was appointed on contract (renewable on mutual consent) basis for a period of one year as F&B Manager in PAITHOM on 12th June, 2006 on a lump-sum salary of Rs: 15,000/- per month by the Ministry of Tourism, Islamabad. His contract was renewed with 15% raise for another year till 11th June 2007. In the last quarter of 2007 the insurgents militant activities started in Swat and the institute remained closed till April 2008. The institute started again in April 2008 in presence of the security forces at PAITHOM. He submitted an application for 3 weeks leave on 28th May, 2008 which was not allowed to him under contract service terms and conditions by the then Incharge Mr. Liaqat Raza observing that his contract is going to expire on 12th June, 2008. Mr. Hassan slipped away from the PAITHOM without intimating any responsible person of the Institute in the early morning of 1st June 2012. The then Incharge PAITHOM tried several times to contact him on his mobile number but he had switched off his mobile. On his continuous absence from the show cause notices were sent on his home address among which one of them was received by his wife. After having no response his contract services stood terminated in accordance with the terms & condition of the contract appointment that employer reserves the right to terminate contract service without assigning any reason from the Institute. His claim that institute was not functional is not correct because institute along with employees was temporarily shifted to PTDC Tourist Facilitation Center Abbottabad. ii. Secondly, his claim that PAITHOM employees were appointed on bogus degrees is not correct as the Ministry has hired all the staff after giving advertisement in local and national dailies however appointment on posts of class IV requires the ability to read & write but no qualification. However, the credentials of existing employees are attached herewith for verification from the quarter concerned please. iii. As he is not a bona-fide employee since 13th May, 2008 of the institute so his claim for release of salaries is out of question. iv. The credentials of all PAITHOM existing employees are enclosed herewith for verification. v. Reportedly he absconded from duty without leaving any luggage.

The applicant has submitted the same request once to Secretary Ministry of Tourism for release of salaries, compensation, placement and if not issuance of an experience letter however experience letter was issued to him wherefore the relevant record is presently held by the court of law at Abotabbad in case PTDC Vs CBA. It requires hand on practice exposure commemorating to their theoretical hours. The institute, that is why, executes such courses in a professional running hotel environment so that trainees may get their practice comprising on 3 hours daily @ 24 days a month to a total of 450 hours per course for 6 months. 2. The undersigned along with Mr. Zahid Khan has visited the training venue on 26th of June 2012 and inspected the on going classes on 27th June 2012 at 900 Hrs sharp in the morning till the last class at 4pm in the evening and found the following strengths and weakness as detailed below and the same are hereby suggested for betterment of the courses curricula; 1. The training of 2nd Batch was much better and equipped with more logistic facility then the 1st Batch at Peoples Square at Mingora which was not suitable in a way or other. 2. The repetition drill carried on by the instructional staff for giving real life experience to the trainees was appreciable because it enhances the training value and job orientation. 3. The instructional faculty was found satisfactory and their command on the relevant trade/course. 4. The attendance percentage of the various trades were up to mark and satisfactory as well as of trainers. 5. It is suggested that sufficient funds for practical orientation of job may be sanctioned so that each trainee may get a chance foron handspractice. 6. The 3rd batch is highly appreciated if executed in Diamond Hills Hotel or Sangam Hotel considering weather conditions of extreme snow fall in Kalam. If not possible the same batch may be conducted at Swat University Campus by allocating 50% seats for Behrain/Kalam starting from October to March so that the trained skill force may take active participation in next season while doing jobs in the Local Hotel 7. of KALAM. 3.
