Editor's Notes
Just so you understand the various elements of the inspection--greeting the inspector--then the opening conference will follow--this will usually be brief in nature---explaining why we are there--the purpose of our visit--what we will be doing ---and that a closing conference will be held at the conclusion of our visit. Your rights and responsibilities will be covered with you during this opening conference. If you have questions--now is the time--or if not now then save them for the closing--but ask them. We have by law the right to take photographs and to interview employees privately-- Some employers resist this part--and we can take that as refusal to permit the inspection process--or we may issue subpoena’s to have them come to the area office for questioning-the idea of these interviews is to obtain the employees input during the inspection process---input that is not swayed by the audience --hopefully
First let me say --you have the right to not permit the inspection--what happens if you do that? The Compliance officer will leave--if they don’t have a warrant and start the process to obtain an inspection warrant--how long does that take? There are lots of variables that can determine that --but it can be from a few hours to few days to a few weeks--there is no definite period that must be followed--and if you have refused the permission to do an inspection before we may have already obtained the warrant before we made our entry--we do keep lists of these employers in the Region--
If you can take some one with you on the walk around inspection that can correct any deficiencies noted --this can earn you discount on any penalties if corrected on the spot---and back to this “inspectors are human” theme--not only are they human they also work in a government job--documenting a violation requires lots of paperwork to be completed--if what is noted is a minor problem fixed quickly then the inspector has to decide whether or not to fill out all those forms--or to just note that it was corrected during inspection--it also demonstrates a lot about your commitment to safety on the job and again demonstrates your philosophy--and to coin an old phrase “Actions speak louder than words”--so take action --be proactive --and the parallel I like to use sometimes---if you are speeding on the freeway and you see the police car with the radar--don’t you slow down? Even though they may already have an infraction---continuing on at the same speed can only get you into more trouble---
The closing conference will be held at the conclusion of the inspection--the compliance officer at that point --is kind of like the fortune teller---they will go over the findings of the inspection--what violations were noted and what items will be issued on your citations---please note that any OSHA violation may have a penalty assessed with it--the CSHO will not be able to tell you what penalties will be issued at that point--they can however answer whether penalties will be assessed or not--just not how much---serious, repeat and willful citations must have a penalty attached to the citation. The compliance officer recommends violations, and penalties to the Area Director--but I am the one that makes the decision to issue or asses the citations and fines. That is why it is important --that if you feel mistreated--that our findings are unfair--that you don’t understand the citations--or you want to discuss any part of the inspection process---take advantage of the informal conference. -----This is not a “hearing’ and you do not need an attorney--to attend--it is just that an informal meeting between the Area Director and you and whoever you want to bring to discuss any of your concerns--it is an opportunity to try and resolve any problems that can be resolved with out using the “contest” process.
If you decide to contest the citations and penalties issued--your rights will be explained to you at the closing, sent to you in writing on the citations--explained again at the informal conference--if you choose one--but here are some important things to remember---It must be in writing--telling the CSHO--or me or your attorney or your best friend--doesn’t count--you have to write it down and get it to the Area office within 15 working days---these are government working days ---so those are M-F --don’t count weekends or national holidays.--
