1. These licence terms and conditions apply to the National Rail Enquiries (NRE) information feeds from its real time train running
information system (known as Darwin) and are based on version 2.0 of the Open Government Licence with specific amendments for
NRE (the “Licence”). NRE may at any time revise this Licence without notice. It is up to you (“You”) to review the Licence regularly,
which will be available on this website, in case there are any changes. Your continued use of the information feeds You have opted to
receive (the “Information”) after a change has been made to the Licence will be treated as Your acceptance of that change.
Using Information under this Licence
NRE grants You a worldwide, royalty-free, non-exclusive Licence to use the Information subject to usage thresholds (“High Volume
Usage”) and to the conditions below (as varied from time to time).
This Licence does not affect Your freedom under fair dealing or fair use or any other copyright or database right exceptions and
limitations.
This Licence shall apply from the date of registration and shall continue for the period the Information is provided to You or until You
breach the Licence.
Rights
You are free to:
 Copy, publish, distribute and transmit the Information;
 Use the Information in accordance with this licence and the Developer Guidelines
 Exploit the Information commercially and non-commercially for example, by combining it with other information, or by including it
in Your own product or application
Requirements
You must, where You do any of the above:
 ensure that Your use of the Information is accurate and is not misleading;
 ensure that Your use of the Information does not defraud or is not used to defraud the rail industry;
 ensure that NRE intellectual property rights, including all logos, design rights, patents and trademarks, are protected by following
the Developer Guidelines;
 ensure that Your use of the Information is in accordance with the Developer Guidelines;
 ensure the information You provide on registration is accurate and that You only use the Information for the purpose you indicate;
 acknowledge NRE as the source of the Information in accordance with the Developer Guidelines;
 not represent yourself as NRE, National Rail or an agent or partner of either or make any representations, warrantees or guarantees
in respect of the Information; and
 make efficient use of and minimise traffic to the Information feeds as far as reasonably possible. NRE reserves the right to regulate
or limit Your access to feeds when it is believed the overall service could be degraded by Your excessive use;
These are important conditions of this Licence and if You fail to comply with them the rights granted to You under this Licence, or any
similar licence granted by NRE, will end automatically.
Exemptions
This Licence does not:
 transfer any intellectual property rights in the Information to You or any third party
 permit You to sublicense the use of the Information
 include personal data in the Information
 provide any rights to use the Information after this Licence has ended
 provide any rights to use any other intellectual property rights, including patents, trade marks, and design rights; or
 permit You to use any automated system, software or process to extract content and/or data, including trawling, data mining and/or
screen scraping

2. The following additional conditions shall apply to the Information and its use:
 the Information is provided to You in a certain format and will not be tailored, reformatted or modified by NRE to meet Your
specific requirements. NRE reserves the right to amend this format from time to time.
 NRE accepts no obligation to provide the Information continuously or at any particular time and no commitment is given regarding
its freedom from interruption
 NRE provides no maintenance or support services, whether relating to the Information or any services and/or products developed
by You which incorporate the Information.
High Volume Usage
Where Your usage of the Information exceeds NRE’s high volume usage threshold (“High Volume Usage”) NRE may apply charges in
accordance with the Usage Charging Document.
Non-endorsement
This Licence does not grant You any right to use the Information in a way that suggests any official status or that NRE endorses You or
Your use of the Information.
Non warranty
The Information is licensed ‘as is’ and NRE excludes all representations, warranties, obligations and liabilities in relation to the
Information to the maximum extent permitted by law.
NRE is not liable for any errors or omissions in the Information and shall not be liable for any loss, injury or damage of any kind caused
by its use or any inability to use the Service.
Nothing in this Licence shall limit either NRE’s or Your liability for death or personal injury caused by negligence, and/or the negligence
of either NRE’s or Your respective employees or agents or for fraud.
Governing Law
This Licence is governed by the laws of England and Wales.
NRE’s Privacy Policy will apply to all personal information collected in connection with Your use of the Service.
