Medical termination of
preganancy act, 1971 and
rules.

• Medical Termination of Pregnancy Act was passed
by the parliament in 1971 with the objective to
provide for the termination of pregnancy by
Registered Medical Practitioner (R.M.P.) for
bonafide reasons. Termination of pregnancy during
certain period is harmful to the health of pregnant
woman or it may have serious effects on the child
of such woman. Pregnancy should be terminated
under hygienic conditions along with the required
facilities in specified premises under the
supervision of Registered Medical Practitioner.
Objecticve.
• The objective of this Act is to provide for the
termination of pregnancy by Registered Medial
Practitioner (R.M.P.) and to provide for matters
connected there with.
Definitions.
• 1. Gurdians :
• It means a person who have to take care of a minor or
lunatic.
• 2. Minor :
• Minor means a person who under the provisions of the
Indian Majority Act, 1875 is to be bedeemed not to have
attained in his majority.
• 3. Registered Medical Practitioner :
• Registered Medical Practitioner means a person holding
qualification granted by an authority specified or notified
under sec.3 of the Indian Medical Degrees Act, 1916 as may
be specified in the schedule to the Indian Medical Council
Act, 1956 and who has such experiences or training in
gynecology and obstetrics as may be prescribed by the rules
made under this act.
Circumstances Under Which
Pregnancy May be Terminated By
Registered Medical Practitioner.
• The pregnancy may be terminated by Registered
Medical Practitioner (R.M.P.) where the length of
pregnancy does not exceed 12 weeks and if such
Medical Practitioner of Option (formed in good faith)
that the continuance of pregnancy would involve a
grave danger to life of woman or to her physical and
mental health or the child to be born would be
seriously hanicapped due to physical and mental
health or the child to be born would be seriously
handicapped due to physical and mental
abnormalities.
• A pregnancy may be terminated by Registered Medical
Practitioner (R.M.P.) where the length of pregnancy exceeds 12
weeks but does not exceed 20 weeks , two Registered Medical
Practitioners ae of such opinion. The pregnancy which is alleged
to have been caused due to rape or due to failure of
contraceptive device used by a woman or her husband for
purpose of family planning which may be presumed to constitute
a grave risk to mental health of the woman.
• In determining health hazard , the pregnant woman's actual
condition in the foreseeable future may be taken into account.
• The Registered Medical Practitioner may terminate a pregnancy
of a woman who have attained 18 years of age with her consent
and the woman who have not attained 18 years of age the
consent of her gurdian in writing is necessary.
Places for the Termination of
Pregnancy.
• Pregnancy may be terminated by Registered
Medical Practitioner at-
• A. Hospital eastablished by the Government or
• B. Any other place approved by the state
Government for this purpose.
• Those places should provide -
• a. Operation table and surgical instruments for
performing abdominal and gynecological sugery.
• b. Aneasthetic equipment , resuscitation euipment
and sterilised equipment.
• Drugs and Parenteral fluids for emergency use.'
Inspection of A place for
Termination of Pregnancy.
• A place aproved for termination of pregnancy may
be inspected by the Chief Medical Officer of the
District, with a view to verify whether termination
of pregnancy is being done under safe and hygenic
conditions. If Chief Medical Officer is not satisfied
due to safety and hygienic condition of the place ,
he may call for any information or may sieze any
article , medicine , ampule , admission register or
other document maintained kept or found at the
place. The provisions of code of criminal
Procedures may also apply in case of seizures.
• Cancellation or Suspension of Certification of
Approval.
• If Chief Medical Officer of the District is not satisfied
with the facilities provided under the rules , he shall
report to the Government with the details of
deficiencies or defects found at the place. On receipt
of such report , the Government may either cancel
the certificate of approval or suspend the same for
such period as it may think fit . However , the owner
of the place shall be given a reasonable opportunity
of being heard.
Maintenance of Admission
Register.
• Medical Termination of pregnancy rules 1975 , provides
for the maintenance of admission register. Such register
should be maintained by the head of hospital or owner of
the approved place in prescribed form of the admissions
of women for terminaton of their pregnancies.
• Serial number should be given to each entry in the
Admission Register. A fresh serial should be given to each
calender year . The serial number of particular year
should be distinguished from the serial numbers of the
years, e.g. serial number 7 of 1987 and serial number 7 of
1988 should be as 7/1987 and 7/1988. The admission
Register is a secrete document . The details regarding the
name and other particulars of the pregnant woman
should not be disclosed to any person.
• Salient Features.
• The Medical Termination of Pregnancy
(Amendment) Bill 2020 seeks to include the rape
and assualt victims , incestuous victims, minor girls
, differently-abled girls , and women with fetal
deformities . The Medical Termination of Pregnancy
(Amendment) Bill 2020 seeks to widen the ambit of
the Medical Termination of Pregnancy Act 1971.
There are several salient features of the Bill which
have been mentioned below.
• It seeks to amend the Medical Termination of
Pregnancy Act 1971.
• The Bill seeks to propose the need of one
registered medical practitioner instead of two in
case of termination of pregnancy with a gestation
period of more than 20 weeks . This is given in
Section 3(2)(b) of the Medical Termination of
Pregnancy Act 1971.
• It introduces a new provision of seeking the advice
of two or more registered medical practitioners in
case of the termination of pregnancy of the
gestation period between 20-24 weeks.
• The Bill seeks to widen the ambit of the MTP Act
1971 and it seeks to include a special category of
woman that include differently-abled women , rape
survivors, miron girls and victims of incest.
• This bill also seeks to increase the maximum
gestation period of termination of pregnancy from
20 weeks to 24 weeks so that many women can
take advantage of it and can successfully terminate
their pregnancies which are endangered to their
lives.
• Th bill seeks to maintain the secrecy and
confidentiality of the women who want to
terminate their pregnancies . The rather a new
concept which will protect the identity of women.
• No medical practitioner will reveal the identity of
any woman who wants to terminate her pregnancy
according to law in force at that time.
• Conditions in which a women can medically
terminate her pregnancy includes where there is
the apprehension of grave endanger to her physical
and mental health , in case of fetal deformities ,
where a woman got pregnant in case of failure of
any contraception device , where the woman got
pregnant as a result of rape , this can cause serious
mental anguish on her mind.
• So these are some of the salient features of the
Medical Termination of the pregnancy
(Amendment ) Bill 2020.
Offecnces and Penalties.
• Any person who is not Registered Medical
Practitioner but engaged in termination of
pregnancy , such person shall be punishable with
an imprisonment or with a fine or with both.
• Any contravention of the provisions of this Act shall
be punishable with an imprisonment or with a fine
up to Rs.1000 or with both.

MTP Act Amendment 2021: Key Changes

  • 1. Medical termination of preganancy act, 1971 and rules. Presented By Miss Sudipta Roy Associate Professor East Point College of Pharmacy
  • 2. • Medical Termination of Pregnancy Act was passed by the parliament in 1971 with the objective to provide for the termination of pregnancy by Registered Medical Practitioner (R.M.P.) for bonafide reasons. Termination of pregnancy during certain period is harmful to the health of pregnant woman or it may have serious effects on the child of such woman. Pregnancy should be terminated under hygienic conditions along with the required facilities in specified premises under the supervision of Registered Medical Practitioner.
  • 3. Objecticve. • The objective of this Act is to provide for the termination of pregnancy by Registered Medial Practitioner (R.M.P.) and to provide for matters connected there with.
  • 4. Definitions. • 1. Gurdians : • It means a person who have to take care of a minor or lunatic. • 2. Minor : • Minor means a person who under the provisions of the Indian Majority Act, 1875 is to be bedeemed not to have attained in his majority. • 3. Registered Medical Practitioner : • Registered Medical Practitioner means a person holding qualification granted by an authority specified or notified under sec.3 of the Indian Medical Degrees Act, 1916 as may be specified in the schedule to the Indian Medical Council Act, 1956 and who has such experiences or training in gynecology and obstetrics as may be prescribed by the rules made under this act.
  • 5. Circumstances Under Which Pregnancy May be Terminated By Registered Medical Practitioner. • The pregnancy may be terminated by Registered Medical Practitioner (R.M.P.) where the length of pregnancy does not exceed 12 weeks and if such Medical Practitioner of Option (formed in good faith) that the continuance of pregnancy would involve a grave danger to life of woman or to her physical and mental health or the child to be born would be seriously hanicapped due to physical and mental health or the child to be born would be seriously handicapped due to physical and mental abnormalities.
  • 6. • A pregnancy may be terminated by Registered Medical Practitioner (R.M.P.) where the length of pregnancy exceeds 12 weeks but does not exceed 20 weeks , two Registered Medical Practitioners ae of such opinion. The pregnancy which is alleged to have been caused due to rape or due to failure of contraceptive device used by a woman or her husband for purpose of family planning which may be presumed to constitute a grave risk to mental health of the woman. • In determining health hazard , the pregnant woman's actual condition in the foreseeable future may be taken into account. • The Registered Medical Practitioner may terminate a pregnancy of a woman who have attained 18 years of age with her consent and the woman who have not attained 18 years of age the consent of her gurdian in writing is necessary.
  • 7. Places for the Termination of Pregnancy. • Pregnancy may be terminated by Registered Medical Practitioner at- • A. Hospital eastablished by the Government or • B. Any other place approved by the state Government for this purpose. • Those places should provide - • a. Operation table and surgical instruments for performing abdominal and gynecological sugery. • b. Aneasthetic equipment , resuscitation euipment and sterilised equipment. • Drugs and Parenteral fluids for emergency use.'
  • 8. Inspection of A place for Termination of Pregnancy. • A place aproved for termination of pregnancy may be inspected by the Chief Medical Officer of the District, with a view to verify whether termination of pregnancy is being done under safe and hygenic conditions. If Chief Medical Officer is not satisfied due to safety and hygienic condition of the place , he may call for any information or may sieze any article , medicine , ampule , admission register or other document maintained kept or found at the place. The provisions of code of criminal Procedures may also apply in case of seizures.
  • 9. • Cancellation or Suspension of Certification of Approval. • If Chief Medical Officer of the District is not satisfied with the facilities provided under the rules , he shall report to the Government with the details of deficiencies or defects found at the place. On receipt of such report , the Government may either cancel the certificate of approval or suspend the same for such period as it may think fit . However , the owner of the place shall be given a reasonable opportunity of being heard.
  • 10. Maintenance of Admission Register. • Medical Termination of pregnancy rules 1975 , provides for the maintenance of admission register. Such register should be maintained by the head of hospital or owner of the approved place in prescribed form of the admissions of women for terminaton of their pregnancies. • Serial number should be given to each entry in the Admission Register. A fresh serial should be given to each calender year . The serial number of particular year should be distinguished from the serial numbers of the years, e.g. serial number 7 of 1987 and serial number 7 of 1988 should be as 7/1987 and 7/1988. The admission Register is a secrete document . The details regarding the name and other particulars of the pregnant woman should not be disclosed to any person.
  • 11. • Salient Features. • The Medical Termination of Pregnancy (Amendment) Bill 2020 seeks to include the rape and assualt victims , incestuous victims, minor girls , differently-abled girls , and women with fetal deformities . The Medical Termination of Pregnancy (Amendment) Bill 2020 seeks to widen the ambit of the Medical Termination of Pregnancy Act 1971. There are several salient features of the Bill which have been mentioned below.
  • 12. • It seeks to amend the Medical Termination of Pregnancy Act 1971. • The Bill seeks to propose the need of one registered medical practitioner instead of two in case of termination of pregnancy with a gestation period of more than 20 weeks . This is given in Section 3(2)(b) of the Medical Termination of Pregnancy Act 1971. • It introduces a new provision of seeking the advice of two or more registered medical practitioners in case of the termination of pregnancy of the gestation period between 20-24 weeks.
  • 13. • The Bill seeks to widen the ambit of the MTP Act 1971 and it seeks to include a special category of woman that include differently-abled women , rape survivors, miron girls and victims of incest. • This bill also seeks to increase the maximum gestation period of termination of pregnancy from 20 weeks to 24 weeks so that many women can take advantage of it and can successfully terminate their pregnancies which are endangered to their lives.
  • 14. • Th bill seeks to maintain the secrecy and confidentiality of the women who want to terminate their pregnancies . The rather a new concept which will protect the identity of women. • No medical practitioner will reveal the identity of any woman who wants to terminate her pregnancy according to law in force at that time.
  • 15. • Conditions in which a women can medically terminate her pregnancy includes where there is the apprehension of grave endanger to her physical and mental health , in case of fetal deformities , where a woman got pregnant in case of failure of any contraception device , where the woman got pregnant as a result of rape , this can cause serious mental anguish on her mind. • So these are some of the salient features of the Medical Termination of the pregnancy (Amendment ) Bill 2020.
  • 16. Offecnces and Penalties. • Any person who is not Registered Medical Practitioner but engaged in termination of pregnancy , such person shall be punishable with an imprisonment or with a fine or with both. • Any contravention of the provisions of this Act shall be punishable with an imprisonment or with a fine up to Rs.1000 or with both.
  • 17. MTP Act 1971 The MTP Amendment Act 2021 Indications (Contraceptive Failure) Only applies to married women. Unmarried women are also covered. Gestational Age Limit. 20 weeks for all indications 24 weeks for rape survivors Beyond 24 weeks for substantial fetal abnormalities. Medical Practitioner Opinions Required Before Termination One RMP till 12 weeks . Two RMPs till 20 weeks. One RMP till 20 weeks Two RMPs 20-24 weeks Medical Board Approval after 24 weelks
