2. • Background

3. Definition
• “Any Combination, whether temporary or
permanent, formed primarily for the purpose
of regulating the relations between workmen
and employers or between workmen and
workmen for imposing restrictive conditions
on the conduct of any trade or business and
includes any federations of two or more trade
unions.”
4. Appointment of registrar, Additional
and deputy Registrars

• Central Government Government:- TU not
confined to single state
• State Government:- other
5. Registration
• Any 7 or more members of TU by subscribing
their names may register
• At least 10 % or 100 workmen employed in
the Establishment/industry should be part of
TU
• Application should be accompained by copy of
rules and particulars
• Registration not compulsory
• Un registered unions may enjoy criminal and
civil immunity
6. Particulars of Applications
• Name , occupation and Addresses of applicants
• Name , occupation and Addresses of applicant’s
place of work
• Name of TU and address of head office
• The titles, names, ages addresses and
occupations of the office bearers of the TU
• List of assets and liability if existing for more than
one yr
7. • Certificate of Registration
• Cancellation of Registration in following cases,
1. If certificate obtained by fraud or mistake
2. Absence of requisite number of members
Registered Office
All communications and notices are to be addressed to
the registered office.
8. • Appeal
• On Refusal of the registration Appeal can be
done to relevant appellate courts
• Rights of Registered Trade Unions
• A body corporate having perpetual succession
and common seal, capacity to sue and to be
sued
9. Liabilities of registered trade unions
• With regards to General Funds
• Separate Fund for political purposes.
10. General Funds
• Payment of Salaries, allowances and expenses to office bearers
• Payment of expenses for the administration of TU
• For legal proceedings
• The conduct of trade Disputes
• Allowances to members or their dependants on account of death, old age, sickness
• Policies of assurance of lives of members
• The provision of educational social or religious benefits for members
• For periodical published
• Any other object notified by the government.
11. Separate Fund for political purpose
• Payment of any expenses incurred by a candidate for
election
• Holding of meeting for distribution of literature
• Registration of electors
• Holding political meetings
12. Miscellaneous provisions
• Right of members to inspect books
• Minor members:-
person who has attained 15 yrs of age
• Change of Name and Amalgamation
50 % of members’ voting required wherein 60 % of votes
should be in favor
Change of name notice signed by 7 members of both unions
and should be registered.
13. • Dissolution of Trade union
A notice signed by 7 members within 14 days of dissolution.
• Returns
Annually a statement of all receipts expanditure assets and
liabilities in prescribed form
In case of alteration a copy should be sent to registrar within
15 days.
14. Penalties
• Five rupees
• In case of continuous offense 5 rupees per week
which should not exceed 50 rupees
• Willful omission – 500 rupees
• With an intention to deceive – 200 rupees
• Court is not authorized to cognize the offence
without consent of TU.
