1. Learn from the Experts: The Do’s and Don’ts of Data Collection

George Rudoy, Founder and CEO of Integrated Legal Technology LLC, joins Legal IQ to
reflect on some of the discussions at the Information Retention and e-Disclosure
Management Conference 2011 on data privacy, retention and preservation, and destruction in
various jurisdictions.
Legal IQ: It’s great of you to join me after the event to reflect on some of the topics
discussed. Firstly, I’d like to take one of the topics that was covered in one of your sessions.
Could you sum up the key considerations when it comes to rules of supply to data privacy
retention, preservation, and destruction in various jurisdictions?
G Rudoy: Obviously, for any of the companies that are operating in the global space, it is
very difficult to map out and to clearly execute on the retention policy, given that each of the
jurisdictions that this company is operating in would have different requirements in regards to
retention. There would be restrictions in regards to the movement of data due to data privacy.
This was covered quite well at the conference. There were many people that shared their
expertise on that subject. To summarise it the most difficult part, which is creating a
consistent retention policy, can really be taken in two parts. One is the creation of a global
overarching policy that would be simple enough and would be adjustable enough and
adaptable enough to apply to any of these jurisdictions to work across the board. Then if
necessary, be augmented by a specific retention policy, or for a reason that is really drastic
for a jurisdiction that’s very different from the overarching policy. I think what happens as a
result is less pressure on a company to have no doubts in regards to the retention policy for
each of the jurisdictions. It really depends on what would be a global perspective and then
adjusted as necessary in every jurisdiction.
Legal IQ: Can you offer some dos and don’ts when it comes to collecting, gathering and
using data?
G Rudoy: Everybody, I think by now, is aware of the fact that because of the data privacy and
the data protection, as well as some of the cultural and custom-based restrictions in countries
when you operate across the globe, most of the companies are aware that in order to move
data from one jurisdiction to the other, you really need to rely on the advice of your privacy
expert that now exists in most of the companies.
