28. არსებული მიდგომა ეწინააღმდეგება საერთაშორისო პრაქტიკას;
კანონპროექტით გათვალისწინებული ზღვრული ნორმები ძალიან
მაღალია და განსხვავებით სხვა ქვეყნებისაგან, ეს გამონაკლისები
ვრცელდება ყველა სახის შეთანხმებებზე და ხელშეკრულებეზე, მათ
შორის კარტელურზეც (ფასების ფიქსაცია, ბაზრების დაყოფა, სატენდერო
შთანხმებული პირობების შეთავაზება;
გამონაკლისებისადმი ასეთი მიდგომა საზიანოა საქართველოს
ბაზრისათვის. ის კიდევ უფრო გაზრდის კარტელური და სხვა სახის
ანტიკონკურენციული შეთანხმებების რაოდენობას;
ამდენად, აუცილებელია ამ მუხლის სერიოზული გადამუშავება.
29. საერთაშორისო პრაქტიკაში ანალოგიური ნორმები
ძირითადად 5-15 პროცენტის ფარგლებშია.
ამასთან გასათვალისწინებელია, რომ არც ერთი ქვეყანა არ
ავრცელებს ამ გამონაკლისებს კარტელურ შეთანხმებებზე,
როგორიცაა ფასების ფიქსაცია, ბაზრების ან მომხმარებელთა
დანაწილება კონკურენტებს და შეთანხმებული სატენდერო
პირობების შთავაზება.

კონკურენციული გარემოს გაჯანსაღების თვალსაზრისით.

36. კონკურენციული პოლიტიკის კრიზისი და დარგობრივი
რეგულირების სისტემის არაეფექტიანობა (მათ შორის
დანახარჯების გათვალისწინებით) დღის წესრიგში აყენებს
ეკონომიკური რეგულირების სისტემის სერიოზული
რეფორმების აუცილებლობას. ეს უკანასკნელი კი საჭიროებს
ძლიერ პოლიტიკურ ნებასა და რეფორმატორთა
მაღალკვალიფიციურ გუნდს ქვეყნის ხელისუფლების
უმაღლეს ეშელონებში (უშუალოდ პრეზიდენტის ან
პარლამენტის დაქვემდებარებაში), გუნდს, რომელიც
დღევანდელი პრობლემების სიმწვავის მიუხედავად, შეძლებს
ეკონომიკურად დასაბუთებული, რეფორმატორული
გადაწყვეტილებების მიღებას ქვეყნის გრძელვადიანი
ეკონომიკური ინტერესების და არა მოკლევადიანი ეფექტების
გათვალისწინებით. წინააღმდეგ შემთხვევაში რეფორმებზე
გაწეული შრომა და დანახარჯი უმიზნო და უშედეგო
ფორმალობად გადაიქცევა.
37. არსებული ვითარებისა და ეკონომიკური რეგულირების
საერთაშორისო ტენდენციების გათვალისწინებით, შესაძლოა
განხილულ იქნეს ორი ალტერნატივა:
უახლოეს პერსპექტივაში კონკურენციის კანონისა და
სააგენტოს სრულყოფა. საშუალო ვადაში მეორადი
კანონმდებლობის განვითარება, კონკურენციული პოლიტიკის
მათ შორის აღსრულების პოლიტიკის თანმიმდევრული
გაჯანსაღება და ეფექტურობის ამაღლება.
კონკურენციული პოლიტიკის რეფორმის განხორციელება
ზოგადად ეკონომიკური რეგულირების პოლიტიკის რეფორმის
ფარგლებში, დარგობრივი რეფორმების ახალ ტალღასთან
ერთად.
38. კანონმა კონკურენციის შესახებ უნდა უზრუნველყოს
ანტიკონკურენციული ქმედებების პრევენცია და აღკვეთა და ამ
მიზნით შექმნას სათანადო მექანიზმები კონკურენციის წესებისა და
პრინციპების არადისკრიმინაციული და თანმიმდევრული
გამოყენებისათვის.
კონკურენციის სააგენტოს დიზაინი
თანამდებობაზე დანიშნვის და გათავისუფლების პროცედურები
იძულებითი აღსრულების მექანიზმები (სანქციები და სხვა)
გადაწყვეტილებების გასაჩივრების პროცედურები და სხვა.
კონკურენციის შესახებ საკანონმდებლო კანონის ძირითადი
დებულებები კონცენტრირებული უნდა იყოს ფირმათაშორის
შეთანხმებებზე, დომინირებული კომპანიების საქმიანობაზე მათი
მდგომარეობის ბოროტად გამოყენების დაუშვებლობისა და
აღკევეთის მიზნით, საბაზრო ძალაუფლების კონცენტრაციაზე
(შერწყმები და შეძენები) და სხვა ორგანიზაციულ სტრუქტურულ
ცვლილებებზე.
39. კანონის გავრცელების არეალი არ უნდა იყოს
შეზღუდული სახელმწიფო მფლობელობაში
არსებული კომპანიებით და სამთავრობო
სტრუქტურების ანტიკონკურენციული ქმედებებით
(საქართველოს გარდა კონკურენციის შესახებ
ზოგადი კანონის მოქმედების არეალი არც ერთ
ქვეყანაში არ შემოიფარგლება მხოლოდ სახელმწიფო
კომპანიებითა და აღმასრულებელი ხელისუფლების
ქმედებებით).
კანონის გამოყენების საფუძველი უნდა იყოს
კონკრეტული ანტიკონკურენციული ქმედება და
არა ის თუ ვინ ჩაიდინა იგი;
40. მოდელი -ვარიაციები
შერცევა განპირობებულია კონკრეტული ქვეყნის სახელმწიფოებრივი
მოდელი, სოციალური, ეკონომიკური, პოლიტიკური და სხვა
ფაქტორები.
უკანასკნელ წლების ტენდენციები ერთიანი
(ინტეგრირებული/კომბინირებული) მოდელების გამოყენებისა.
ფართოვდება კონსენსუნსი კონკურენციის საკითხებზე
პასუხისმგებელი ორგანოების უწყებრივი დამოუკიდებლობის
სასარგებლოდ. სამი თავისუფლების პრინციპი; გადაწყვეტილების
მიღების თავისუფლება, საბიუჯეტო დამოუკიდებლობა და საკადრო
დამოუკიდებლობა. რეკომენდებულია, დამოუკიდებლობის ეს
ელემენტები გამყარებული უნდა იყოს საკანონმდებლო
დებულებებით.
41. კომისიური მოდელი - სამი- ხუთი კომისიონერით გააცნია
როგორი მანდატი ექნება (კონკურენციის კანონი თუ
კონკურენციის კანონი პლუს მომხმარებელთა დაცვის
სახელმწიფო პოლიტიკა, მსგავსად აშშ და პოლონური
მოდელებისა). მიზანშეწონილად მიგვაჩნია, რომ ეს ორგანო
პასუხისმგებელი იყოს მომხმარებელთა დაცვის პოლიტიკის
გატარებაზეც (გარდა სურსათის უვნებლობასა და ხარისხთან
დაკავშირებული საკითხებისა).
რაც შეეხება უფლებამოსილი პირების თანამდებობაზე
დანიშნვას, მიზანშეწონილად გვესახება ეს პროცედურა
განხორციელდეს - პრეზიდენტის (ცხდაია თუ პრეზიდენტი
politikurad ნეიტრალური იქნება) და პარლამენტის
მონაწილეობით
42. ეფექტიანი საჯარო მარეგულირებელი უწყება
კონკურენციიდამოუკიდებლობა, ანგარიშვალდებულება,
ტრანსპარენტულობა, მანდატის შესაბამისი დაფინანსება და
სათანადო ადამიანური რესურსები, გასაჩივრების კარგად
ორგანიზებული პროცედურები
კანონმა უნდა განსაზღვროს სააგენტოს დიზაინისისეთი
ძირითადი ელემენტები, როგორიცაა
ა) სამართლებრივ სტატუსთან დაკავშირებული ელემენტები,
ბ) სტატუსი უფრო ფართო სამთავრობო სტრუქტურაში და
აგრეთვე ბიზნესისა და მომხმარებელთა წარმომადგენლებთან
ურთიერთობებში
გ) შიდა პროცესების ორგანიზაცია. გარდა ამისა ეფექტიანი
პოლიტიკის უზრუნველსაყოფად აუცილებელია არსებობდეს
ცხადი სააპელაციო ნორმები და პროცესები
43. კანონი unda ითვალისწინებს პოლიტიკური, ორგანიზაციული
და ფინანსური დამოუკიდებლობის ისეთ აღიარებულ
მექანიზმებს (ელემენტებს), როგორიცაა:
ბ) თანამდებობაზე დანიშვნის ნათლად განსაზღვრული
კრიტერიუმები
გ) ხელისუფლების აღმასულებელი და საკანონმდებლო შტოს
მონაწილეობა თანამდებობაზე დანიშვნის პროცედურებში
დ) პასუხისმგებელი პირების (მაგ. აღმასრულებელი
დირექტორი, ან კომისიის წევრები მოდელის
გათვალისწინებით) დანიშნვას განსაზღვრული ფიქსირებული
ვადით, რომელიც არ უნდა ემთხვეოდეს საარჩევნო ციკლს
ე) პასუხისმგებელ პირთა გათავისუფლების ფორმალური
წესების არსებობას, მათ შორის თანამდებობიდან ვადაზე ადრე
გათავისუფლების პირობებს;
44. სათანადო სტატუსი და აღმასრულებელი ძალაუფლება
აღსრულების ეფექტიანი პრაქტიკის უზრუნველსაყოფად
აუცილებელია სათანადო სტატუსი და აღმასრულებელი
ძალაუფლება.

45. ყოველივე ზემოაღნიშნულისა და ქართული რეალობის
გათვალისწინებით, მიგვაჩნია, რომ ქვეყანაში უნდა შეიქმნას
და ფუნქციობდეს სათანადო რესურსებით (ფინანსური და
საკადრო) უზრუნველყოფილი სხვა სამათავრობო
სტრუქტურისაგან რეალურად დამოუკიდებელი
(დისტანცირებული, მაგრამ არაიზოლირებული!)
მარეგულირებელი ორგანო (არსებითი მნიშვნელობა არა აქვს
რა ერქმევა მას), რომლის ფუნქციებიც, საქმიანობის ძირითადი
მიმართულებებიც, აღმასრულებელი უფლებამოსილებაც,
დიზაინის ელემენტებიც, პროცედურული საკითხებიც და
გადაწყეტილების გასაჩივრების პროცედურებიც მკაფიოდ
იქნება განსაზღვრული საკანონმდებლო აქტებით.
