WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) Director León Rodríguez announced today that, effective May 26, 2015, the Department of Homeland Security (DHS) is extending eligibility for employment authorization to certain H-4 dependent spouses of H-1B nonimmigrants who are seeking employment-based lawful permanent resident (LPR) status. DHS amended the regulations to allow these H-4 dependent spouses to accept employment in the United States.
Finalizing the H-4 employment eligibility was an important element of the immigration executive actions President Obama announced in November 2014. Affidavit of Support under Section 213A of the Immigration and Nationality Act (INA) is required for most family-based and some employment-based immigrants to show that they have adequate means of financial support and are not likely to become public charge. Immigrants who are deemed likely to become public charges may gain admission to the United States if a sponsor signs United States Citizenship and Immigration Services Form I-864, Affidavit of Support, thereby promising to maintain the sponsored immigrant at no less than 125% of the Federal Poverty Guidelines for the immigrant's household size. See 8 CFR § 213a.2(c)(2). In April 2013, the Senate ‘Gang of Eight’ released its proposal for overhauling our nation’s immigration system. Call the Border Security, Economic Opportunity, and Immigration Modernization Act of 2013 (s.744), this bill proposes to eliminate the current immigration backlog, create new visa categories for high-skilled and skilled workers, overhaul our green card application system, and address the statuses of approximately 11 million undocumented workers in the United States.

BASHYAM SPIRO WEBINAR - I-601A Stateside Provisional Waiver 3.20.13
Effective March 4, 2013, the Department of Homeland Security will begin a new process for adjudication of these waiver applications. Under the new process, certain foreign spouses delay returning to their home country until a “provisional waiver” is approved in the U.S. The new process will drastically reduce the amount of time that the foreign spouse has to remain in his or her home country. Hopefully, the new process will also provide some measure of confidence that the foreign spouse will indeed return to the US.

Today, immigration practitioners and employers have needed to adapt to a myriad of changes in the H-1B professional worker program. It started a few years ago with stricter USCIS requirements on an H-1B employee’s itinerary if placed at an off-site work location. Then, in January 2010, the USCIS released the Neufeld Memo which redefined the employer-employee relationship, and made it harder for staffing firms to apply for H-1B visas.
This presentation outlines how the USCIS has implemented this memo by issuing lengthy Requests for Evidence (RFE) on the ‘right to control’ issue, what to expect from a typical RFE, as well as how to properly respond to these RFEs to give H1B cases the best chance for success.
