Agenda – Readdressing the legitimacy, scale and circumstances of humanitarian interventions
France is extremely concern and watchful into humanitarian intervention practice as it believes-
legitimacy, scale and circumstances scrutinized by strategic and influential approach to defend
legal ground. The question of legitimacy, effectiveness and liability in aftermath circumstances
of intervention arises measuring the casualties, instability and humanitarian crisis caused by that
intervention to that certain region. France’s soft diplomacy, reformation policy and emergency
support towards humanitarian need, urges an immediate and embolden action in addressment and
dissertation of conflict to sustain international peace and security.
Article 2(4) and 2(7) of the UN Charter preserves the territorial integrity, political independence
of states by forbidding any use of force, or threat of use of force against either. The accepted
exception to this principle, regarded as peremptory norm, is only the right to self-defence under
Article 51 of the UN Charter, and Collective Security measures under Chapter VII. France
believes legitimate implementation and proper post intervention strategy might defend the legal
ground as a joint initiative practiced by Security Council itself expressing its protective concern
to world peace and security, protection of fundamental Human Rights, Ethnic and mitigation of
minority/oppressed groups from aggression of dictatorial/extremist ruling parties/rebellions.
Historically, France has successfully intervened and settled the conflict in Mali(2013-14),
Central African Republic(2013-16) and Cote d’Ivoire(2004-15) by its holistic policy on Human
Rights and disarmament. Encourages strong economic sanctions, arm embargo and accession
negotiations to tackle rising humanitarian conflict and protection of innocent civilians upon
proper investigation by UNHRC. Upon unsuccessful sanctions/embargoes, limited scale UNSC
authorized legitimate intervention would govern and combat on by P5 and NATO jointly against
aggressive government/terrorists, on legal ground of Humanitarian rescue and protection to cease
possible plot for mass killing, genocide or ethnic cleansing (eg. Rwanda Genocide,1994)
influenced by religious or political means.
It proposes a complete Humanitarian evacuation strategy, peacekeeping enforcement and
sustainable financial and economic development for refugee and displaced people to ensure post
2. conflict human rights, healthcare, security, repatriation and legal assistance for peaceful
resettlement and repatriation. Suggesting cooperation of UNDP, WHO, WFP, UNHRC and
UNHCR’s joint program immediately after and during intervention to legitimate its appearance
to protect civilians, Human Rights and reduce casualties. Emergency voluntary assistance from
NGOs (Red Cross) and funding (doubled Humanitarian budget by voluntary contribution) for
build resilience and accountable government system should be imposed.
