The Hawaii Department of Agriculture (HDOA) has failed to fulfill its responsibilities to enforce pesticide use violations under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). HDOA has a backlog of hundreds of inspection files dating back to 2008 that has prevented meaningful enforcement actions. This has allowed pesticide misuse to continue without consequences. The EPA has repeatedly warned HDOA about improving its enforcement efforts, but the problems have persisted and worsened. Due to HDOA's failures, the EPA should notify Hawaii that it intends to rescind the state's primary enforcement authority under FIFRA if deficiencies are not corrected within 90 days.
