Definition
Negotiation is when two lawyers are representing two
parties in dispute, in an attempt to reach an
agreement. Often without the presence of their clients.
It is usually part of the pre-action protocol stage.
Advantages
 Cost effective
 Time effective, If agreement is reached.
 Gain a clearer picture of matters
Disadvantages
 The parties may have different points of view on the matter/s in dispute.
 Negotiation may be used as a stalling tactic.
 Weaker parties are more vulnerable to be placed at a disadvantage. Of
accepting a lower settlement.
