Lourdes G. Suntay owned a three-carat diamond ring valued at P5,500. She delivered the ring to Clarita R. Sison for sale on commission. Without Suntay's knowledge, Sison's niece pledged the ring with Dominador Dizon's pawnshop for P2,600. When Suntay demanded the ring back, Sison gave her the pawn ticket. Suntay then filed a case against Sison for estafa and asked Dizon to return the ring, which he refused. The court ruled in Suntay's favor, finding she had an absolute right to recover her property that was unlawfully taken.
