Dear Ms. Munger, Ms. Bail and Mr. Frankel:
I am in receipt of Minute Order No. 16 appointing me as the new hearing officer for the
above-captioned matter. I note that comments on and objections to this appointment are to be
filed no later than April 27, 2012. To assist you in your response, if any, I note the following:
I do not represent either the University of HawaII Institute for Astronomy nor Kilakila ‘0
Haleakal.. As a matter of full disclosure, please note that the husband of a paralegal in my law
firm, Randall Ishilcawa, is one of the attorneys representing the University on this matter. I do
not know Mr. Ishikawa. Also, on occasion, I represent MRC Greenwood, the President of the
University, in personal matters unrelated to the University (with the exception of representing
Dr. Greenwood in her negotiations with the Board of Regents concerning her employment
contract). I have never discussed the Haleakala matter with either Dr. Greenwood nor Mr.
Ishikawa, nor would I ever expect to do so.
I believe I can render a fair and impartial decision in this matter despite the above
associations.
