Law is boring
Until a few months ago,
the legal world lacked
every intention of
innovation.

2017: AI
AI & Machine Learning
will revolutionise old-
fashioned industries.
Accountancy, legal, manufacturing,
retail or logistics.

But why?
First, these industries have established
processes and subsequently, abundant
historical data to learn from. This is exactly what
is needed for AI-based optimisation: a known
process with specific KPIs and constraints, and
past data on how the process ran for the last
thousands of times.
Second, old industries value optimisation, and
have already used all other available options.

AI is already
everywhere.
Although most of us are unaware of it, AI
systems are everywhere, from bank apps that
let us deposit checks with a picture, to
everyone’s favourite Snapchat filter, to our
handheld mobile assistants.
Currently, one of the next big challenges that AI
researchers are tackling is reinforcement
learning, which is a training method that allows
AI models to learn from its past experiences.

What if the AI-controlled traffic signal learns
that it’s more efficient to change the light one
second earlier than before, but this causes more
drivers to run the light and resulting in more
accidents?
With reinforcement learning, there’s no fault
by humans and no foreseeability of injuries
caused by such accidents, so traditional law
would say the dev is not liable.

Who’s
liable?
The law will need to adapt to this technological
change in the near future. It is unlikely that we
will enter a dystopian future where AI is held
responsible for its own actions.

Most likely the legal world will need to adapt a
standard for AI with ethical & legal guidelines
and technical limits. For such a standard to
actually have any power, we will most likely
need government interference.
Trouble in 

AI paradise.
AI is artificial by design, and concepts such as
liability appear meaningless. A criminal
courtroom would be incompatible with AI
(Unless the developer intends to harm, which
would be his or her own crime).
The main question is whether the AI should be
liable if something goes wrong and someone
gets hurt. Isn’t that the natural order of things?
We don’t regulate non-human behavior, like
animals or plants or other parts of nature. Bees
aren’t liable for stinging you.

Ignorance is your enemy.
A lot of lawyers and traditional jurists do not believe
AI or machine learning will impact their business.
This is a crucial mistake this sector keeps on making.
Most law offices are only now establishing their own
branding, after having struggled for years with
how to combine deontology and traditional beliefs
with a more commercial approach. AI will be their
next hangover.
