Section 300 of the Indian Penal Code discusses the defense of "sudden fight" which can reduce criminal liability for murder to culpable homicide. For the exception to apply, there must not have been premeditation, undue advantage taken, or cruel/unusual actions. Several cases explore the boundaries - in one case, the defense did not apply when an unarmed person was stabbed after asking the accused to stop fighting. In another case, the defense was allowed when both sides were armed during the altercation. For the defense to apply, the fight must be sudden with no premeditation, done in heat of passion, and without undue advantage or cruelty based on established requirements.
