- 4. The Corporate Manslaughter & Homicide Act 2007
• The Corporate Manslaughter and Homicide Act 2007 is a landmark law that
came in to effect on 6th April 2008.
• Now, for the first time, companies and organisations can be found guilty of
corporate manslaughter as a result of serious management failures resulting
in a gross breach of a „Duty of Care‟ leading to a fatality.

- 5. Employers are legally required to ensure „Duty of Care‟
Employers have a „Duty of Care‟ for the health, safety and welfare at work of all
their employees. They are also responsible for the health and safety of those
affected by work activities, for example any self-employed people they engage
and visitors such as contractors.
This „Duty of Care‟ cannot be transferred to any other person, including those people
who work alone. It is the employer‟s duty to assess risks to lone workers and take
steps to avoid or control risks where necessary.
Employees also have a duty to take reasonable care of themselves and other
people affected by their work activities and to co-operate with their employers
in meeting their legal obligations.
Lone Workers should not be at more risk than other employees.

- 7. Penalties an Organisation could face if convicted
of Corporate Manslaughter
In the event of a guilty verdict, the court must consider the following penalties:-
Guidelines published in February 2010 by the Sentencing Guidelines Council (SGC),
recommend “the appropriate fine will seldom be less than £500,000 and may
be measured in millions of pounds”.
Publicity Orders requiring the publication of the fact of the conviction, particulars
of the offence, level of fine and terms of any remedial order.
Remedial Orders requiring the defendant to have remedied
any specific failings by the time of sentencing. The cost of
Compliance with remedial orders should not be taken
in to account when fixing the fine.

Compensation will usually be dealt with in a civil court.

- 8. Penalties an Individual could face if convicted as...
• „Controlling Minds‟ can face up to two years imprisonment for separate
offences related to the Health and Safety at Work Act 1974.
• Director‟s and Manager‟s can also face prosecution for „common law
manslaughter by gross negligence‟ which carries a maximum of life
imprisonment.
The law defines „Controlling Minds‟ as:
“People who have significant influence over the procedures and activities
undertaken by others within the Organisation.”

- 9. Whilst the Burden of Proof remains with the Prosecution, organisations
are breaching their „Duty of Care‟ and breaking the Law if they do not
have, maintain and record the following:
