EU-GHS/CLP: van leverancier tot klant, omgaan met de verplichtingEcomatters
EU-GHS (EC 1272/2008) is de nieuwe Europese regelgeving over de indeling, etikettering en verpakking van stoffen en mengsels. Deze regelgeving, in het Engels aangeduid als “Classification, Labelling and Packaging” (CLP), vervangt op termijn de Gevaarlijke stoffen- en de Preparatenrichtlijnen (EEG/67/548 en 1999/45/EG).
Vanaf 2015 dienen alle stoffen en mengsels (uitgezonderd o.a. voeding, cosmetica en medicijnen), te zijn (her)ingedeeld, geëtiketteerd en verpakt volgens EU-GHS/CLP. Voor u als producent of leverancier brengt dit grote veranderingen met zich mee. Veel van uw producten kunnen volgens de nieuwe regelgeving zwaarder ingedeeld worden, wat nadelig kan zijn voor uw operaties en/of klanten. Ook zijn de eisen die gesteld worden aan de productetiketten en –verpakkingen aangescherpt. Zo worden de R- en S-zinnen vervangen door H- en P- zinnen, en nemen nieuwe, rood omkaderde symbolen op de nieuwe etiketten de plaats in van de klassieke oranje gevaarspictogrammen.
Ecomatters heeft een EU-GHS/CLP Indelings Service ontwikkeld om het herindelen en etiketteren van mengsels makkelijker te maken en het proces aanzienlijk te versnellen. Op efficiënte wijze wordt het risico op alle in de regelgeving gedefinieerde gevaren automatisch geanalyseerd, waarbij de kans op menselijke fouten wordt gereduceerd. Op 26/02 leg ik op de See-days de impact uit van CLP op de milieuvergunning en de opslag van gevaarlijke stoffen in Vlaanderen. Vanaf 1/06/2015 wijzigt er heel wat. Hierbij meer duidelijkheid
REACH (regelgeving EC 1907/2006), de huidige Europese wetgeving voor registratie, evaluatie en autorisatie van chemicaliën is van kracht sinds 1 juni 2007. REACH geeft de industrie (fabrikanten, importeurs, distributeurs en professionele gebruikers) de verantwoordelijkheid om de risico’s van chemische stoffen te beheren en veiligheidsinformatie voor deze stoffen beschikbaar te stellen. De laatste REACH deadline is in 2018 en geldt voor stoffen geproduceerd of geïmporteerd in een hoeveelheid groter dan 1 ton per jaar.
Ecomatters heeft een ruime ervaring met REACH registraties en het onderhouden van relaties met ECHA, SIEF en consortia. De services die wij leveren op dit gebied zijn onder andere: Opstellen van REACH dossiers, literatuuronderzoek en documentatie, (Q)SAR analyse, read across/groepering strategieën, data evaluatie (waarde- en kwaliteitsbepaling), maken van testplannen en gebruiken van vrijstellingen, onderzoek monitoring, blootstellingsscenario’s (ES’s), risicobeoordelingen (CSA’s) en chemische veiligheidsrapporten (CSR’s).

Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Als de bestaande indeling van een stof wijzigt, gelden mogelijk
andere eisen voor de verpakking. Een andere indeling van
stoffen en mengsels kan ook gevolgen hebben voor de opslag
van stoffen en mengsels en de veiligheidssignalering op de
werkplek.

De indeling moet u doorgeven aan downstream gebruikers of
distributeurs.
De indeling van een stof die u op de markt brengt moet u
afstemmen met andere fabrikanten of importeurs van dezelfde
stof. (Dit hoeft niet voor alle categorieën als er een
geharmoniseerde indeling is voor bepaalde categorieën.)
De indeling en etikettering van een stof moet u melden aan het
Europees Agentschap voor chemische stoffen (ECHA) in Helsinki.
(Dit hoeft niet als u de stof volgens REACH (1907/2006) heeft
geregistreerd.)
Alle informatie over de gevaarseigenschappen van een stof of

U moet alle stoffen die u in de handel brengt indelen volgens
de eisen van EU-GHS. U kunt daarbij de indeling van een stof of
mengsel gebruiken die door een andere actor (fabrikant,
importeur of andere formuleerder) in de toeleveringsketen is
opgesteld. Dit kan alleen als de samenstelling van uw mengsel
hetzelfde is.
De verpakking van een ingedeeld mengsel moet u voorzien van
een etiket met pictogrammen, signaalwoorden,
veiligheidsaanbevelingen en waarschuwingszinnen.

Als de samenstelling van een stof of mengsel verandert of als
er nieuwe informatie over een stof beschikbaar komt, moet u

voldoen staan in de verordening.

veiligheidsinformatieblad) doorgeven aan andere downstream
gebruikers of distributeurs.
Ingedeelde mengsels die u voor 1 juni 2015 aan afnemers heeft
verstrekt hoeft u niet opnieuw te etiketteren en verpakken
volgens EU-GHS. Deze vrijstelling geldt tot 1 juni 2017.
Alle informatie over de gevaarseigenschappen van een stof of
mengsel, moet u bewaren gedurende ten minste tien jaar nadat

voordat u de voorwerpen in de handel brengt. Deze
verplichting geldt ook voor stoffen die niet op de markt
verkrijgbaar zijn en die vallen onder de registratieplicht of
meldingsplicht van REACH (1907/2006).

U moet een stof of mengsel dat als gevaarlijk is ingedeeld,
etiketteren en verpakken volgens de eisen van EU-GHS. Daarbij
kunt u de indeling gebruiken die door een ander bedrijf bijvoorbeeld fabrikant of importeur - in dezelfde
toeleveringsketen is bepaald (artikel 4, lid 5).
Alle bestaande etiketten van de chemische stoffen en mengsels
die u op de markt brengt vervangen. Ook uw productinformatie
en de veiligheidssignalering op de werkplek moet u aanpassen.
De informatie over de indeling krijgt u van uw leverancier.
Als de indeling van een stof of mengsels wijzigt, gelden
mogelijk andere eisen voor de verpakking. De eisen waaraan
verpakkingen moeten voldoen staan in de verordening (artikel
35).
Een andere indeling van stoffen en mengsels kan ook gevolgen
hebben voor de opslag van stoffen en mengsels en de
veiligheidssignalering op de werkplek.

verplichtingen.
• Het is wel belangrijk dat u vaststelt wat de consequenties
van de nieuwe wetgeving voor consumenten zijn.
• Denk bijvoorbeeld aan het treffen van andere
voorzorgsmaatregelen bij het gebruik van een stof of
mengsel, het aanpassen van veiligheidssignalering en instructies op de werkplek.

De EU-GHS verordening schrijft ook voor dat de verpakking aan
bepaalde eisen moet voldoen.
Speciale eisen worden voorgeschreven aan producten die
moeten worden voorzien van een kinderveilige sluiting of een
voelbare gevaarsaanduiding.
Consumenten krijgen na het inwerkingtreden van de EU-GHSverordening te maken met nieuwe etiketten op producten
Nieuwe pictogrammen in een rood kader vervangen geleidelijk
de oude vertrouwde oranje gevaarsymbolen.
