ORDER
Facts:
1. The appellant filed RTI application dated 02.02.2017 seeking information
on 7 points regarding refusal of registration of Writ Petition (Crl.) D. No. 2188
of 2017.
2. The CPIO responded on 04.03.2017. The appellant filed first appeal on
08.03.2017. The FAA responded on 04.04.2017. The appellant filed second
appeal on 06.04.2017 before the Commission.
Hearing:
3. Both the parties participated in the hearing personally. Mr. Ajay Agrawal
(CPIO) represented the respondent along with his counsel Mr. Harshvardhan
Singh Rathore (Advocate). Mr. Om Prakash (son of Late Smt. Asha Rani Devi)
participated in the hearing to pursue the case.
4. The appellant stated that the subject matter of non-registration of Writ
Petition (Crl.) D. No. 2188 of 2017 is administrative in nature. Therefore,
information should be provided to him.
5. The respondent stated that the sought for information is in the form of a
query which does not come within the definition of ‘information’ u/section 2(f) of

2. the RTI Act. Further, he stated that they are not obliged to give information in
the nature of the legal opinion sought by the appellant. He also stated that
issue of non-registration of Writ Petition (Crl.) D. No. 2188 of 2017 is judicial in
nature. In this regard, they have furnished a reply to the appellant on
04.03.2017. The reply given was read out and was found to be satisfactory.
Discussion/ observation:
6. The action/steps taken by the respondent in giving response to the RTI
application is satisfactory.
Decision:
7. No further intervention of the Commission is required in the matter.
The appeal is disposed of. Copy of the order be given to the parties free of
cost.
