BusinessDescription
A Music Publisher is the entity that represents the artist / songwriter and becomes his / her
agent. To enhance understanding the role of the music publisher (which is, in effect, that of an agent, manager,
lawyer, and business advisor to the artist / songwriter and his or her original creation), the following represents
a brief summary of some of the music publisher’s rights and responsibilities.
Rights of a Music Publisher:
1- The right to license performance on radio, television or other media (with these rights normally assigned to
either ASCAP or BMI for representation and collection of royalties)
2- The right to make arrangements of the composition and translations for exploitation in non-English-
speaking territories.
3- The right to dramatize the title, music, and lyric plot of the composition for use in motion pictures or
television programs.
4- The right to license the composition for records, tapes, CD’s, videocassettes and videodiscs.
5- The right to license uses of the composition in motion pictures, television programs, lives theatrical stage
productions and commercials.
6- The right to print the composition for use in sheet music and folios and license others to do so.
7- The right to license the title of the composition as the title of a motion pictures, television series, or episode
in a series.
8- The right to exercise any and all other rights in the composition that may then or in the future exist.
9- The right to negotiate licenses for the use of compositions in both current and future technology.

2. LICENSING AND PROTECTING MUSIC FOR RADIO, TELEVISION, MOVIES THEATHERS, CABLESTATIONS., TV
COMMERCIALS, VIDEOS CLIPS, DOCUMENTARIES, THEATRICAL PLAYWRIGHTS, MOVIE FILMS, RADIO
PROGRAMS, LIVE SHOWS & EVENTS.
Responsibilities of a Music Publisher:
1- Copyrighting musical compositions in the United States and making sure that the songs it represents are also
protected in foreign countries.
2- Securing recording, television, stage, and motion picture uses of song.
3- Arranging for the manufacture and distribution of sheet music, folios, songwriter compilations, and other
music oriented books.
4- Securing uses of songs in television and radio commercials.
5- Suing infringers of musical compositions and negotiating settlements, when appropriate.
6- Properly registering songs with the Harry Fox Agency, ASCAP, BMI, SESAC and all other representatives
and collection agents so that royalties can be collected for record, tape and CD sales as well as for radio and
television performances.
7- Staying abreast of new developments and formulating relevant policies and procedures so that songs may
earn maximum compensation.
8- Promoting the creation of new songs by helping to support and develop promising writers.
9- Negotiating fees and issuing appropriate licenses for all uses of music.
10- Making sure that payments from licensees (records companies, video distributors, television and film
producers are paid on time and accurately.
11- Providing information to representatives in foreign territories so that those representatives remain aware of
current developments with respect to a publisher's catalog.
12- Giving potential users prompt and correct information on songs being considered for use so that decisions
can be made quickly.
13- Promoting legislation affecting the music and entertainment industries and the protection of the rights of
creators.
14- Promoting interest in songs and their writers through special projects such as commemorative stamps,
anniversary, albums for radio stations, producers, recording artist, film producers, television companies and all
other users of music.
15- Keeping track of motion pictures, television shows, commercials and video projects in pre-production,
production or post-production so compatible songs can be submitted to producers for possible inclusion.
16- Communicating daily with representatives in foreign countries to ensure that the U.S. publisher has up-to-
date knowledge of current developments in foreign territories and that the foreign representatives have an
understanding of what is happening in the United States.
