IT IS A SPECIAL LAW WHICH SEEKS TO
ERADICATE ALL FORMS OF SEXUAL
HARASSMENT BY RECOGNIZING THAT BOTH
MEN AND WOMEN MUST HAVE EQUALITY,
SECURITY AND SAFETY NOT ONLY IN PRIVATE,
BUT ALSO ON THE STREETS, PUBLIC SPACES,
ONLINE, WORKPLACES AND EDUCATIONAL
AND TRAINING INSTITUTIONS.

BACKGROUND
 AN OVERWHELMING 88% OF WOMEN AGED 18 TO 24 YEARS OLD
EXPERIENCED SEXUAL HARASSMENT IN THE STREETS (SWS, 2010).
 WHILE WOLF-WHISTLING AND CATCALLING ARE THE MORE
COMMON CASES, OTHER FORMS OF SEXUAL HARASSMENT
INCLUDE LASCIVIOUS LANGUAGE, STALKING, RUBBING OR
TOUCHING, INCIDENT GESTURES, EXHIBITIONISM AND PUBLIC
MASTURBATION.
 58% OF THESE INCIDENTS TAKE PLACE ON THE STREETS AND
SMALL ALLEYS. THEY HAVE ALSO BEEN REPORTED TO HAPPEN
IN PUBLIC VEHICLES, WASHROOMS, SCHOOLS AND WORKPLACES.

DEMANDS, REQUESTS OR OTHERWISE REQUIRES
OF, WHETHER THE DEMAND, REQUEST OR
REQUIREMENT FOR SUBMISSION IS ACCEPTED.

OF PERSONAL SPACE AND PUBLIC SAFETY, THE SAFE
SPACES ACT ADDRESSES GENDER-BASED SEXUAL
HARASSMENT IN PUBLIC AREAS SUCH AS STREETS, PRIVATELY-
OWNED PLACES OPEN TO THE PUBLIC, AND PUBLIC UTILITY
VEHICLES, AMONG OTHERS. IT ALSO EXTENDS THE
PROTECTION EVEN TO CYBERSPACE AND PROVIDES FOR
PROHIBITED ACTS AND THEIR CORRESPONDING PENALTIES.

 ANY PERSON, NOT ONLY WOMEN, BUT MEN AND
CHILDREN ARE ALSO PROTECTED.
 IT IS NOT ONLY WOMEN W H O ARE PROTECTED

RECOGNIZES THAT ANYONE CAN PERPETUATE
SEXUAL HARASSMENT AND ANYONE CAN BE A VICTIM
OF SEXUAL HARASSMENT.

IMPLEMENTING BODIES FOR GENDER BASED ONLINE
SEXUAL HARASSMENT
• PNP ANTI-CYBERCRIME GROUP – AS THE NATIONAL OPERATIONAL SUPPORT UNIT OF PNP PRIMARY
RESPONSIBLE FOR THE IMPLEMENTATION OF PERTINENT PHILIPPINE LAWS ON CYBER CRIME, SHALL
RECEIVE COMPLAINTS OF GENDER BASED ONLINE SEXUAL HARASSMENT AND DEVELOP AN ONLINE
MECHANISM FOR REPORTING REAL TIME GENDER BASED ONLINE SEXUAL HARASSMENT AND APPREHEND
PERPERTRATORS.
• CYBERCRIME INVESTIGATION AND COORDINATING CENTER OF THE DICT SHALL
COORDINATE WITH PNPACG TO PREPARE APPROPRIATE AND EFFECTIVE MEASURES TO MONITOR AND

PENALTIES FOR GENDER BASED ONLINE SEXUAL
HARASSMENT
• The penalty of online GBSH violation is prision correccional in its medium period
[imprisonment of six (6) months and one (1) day to two (2) years and four (4) months] or
a fine of not less than one hundred thousand pesos (PHP 100,000.00) but not more than
five hundred thousand pesos (PHP 500,000.00), or both, at the discretion of the court.
• If the perpetrator is a juridical person, its license or franchise shall be automatically
deemed revoked, and the persons liable shall be the officers thereof, including the editor
or reporter in the case of print media, and the station manager, editor and broadcaster in
the case of broadcast media.
• An alien (foreigner) who commits gender-based online sexual harassment shall be
subjected to deportation proceedings after serving sentence and payment of fines.

3.QUALIFIED GENDER-BASED STREETS, PUBLIC SAPCES AND ONLINE SEXUAL
HARASSMENT PENALTY NEXT HIGHER IN DEGREE WILL BEAPPLIED IN THE FOLLOWING
CASES:
 COMMITTED IN A COMMON CARRIER OR PUV, (JEEPNEYS, TAXIS, TRICYCLES, OR APP-BASED
TRASNPORT NETWORK VEHICLE SERVICES, WHERE THE PERPETRATOR IS THE DRIVER OF THE
VEHICLE AND THE OFFENDED PARTY IS THE PASSENGER.
 OFFENDED PARTY IS A MINOR, A SENIOR CITIZEN, OR A PERSON WITH DISABILITY (PWD), OR A
BREASTFEEDING MOTHER NURSING HER CHILD.
 OFFENDED PARTY ISA DIAGNOSED WITH A MENTAL PROBLEMTENDING TO IMPAIR CONSENT.
 PERPETRATOR IS MEMBER OF THE UNIFORMED SERVICES, SUCH AS THE PNP AND THE ARMED
FORCES OF THE PHILPPINES,AND THE ACT WAS PERPETRATED WHILE THE PERPETRATOR WAS IN
UNIFORM; AND A GOVERNMENT EMPLOYEE.
 COMMITTED IN A GOVERNMENT AGENCY OFFERING FRONTLINE SERVICES TO THE PUBLIC AND THE
PERPETRATOR IS

4.GENDER-BASED SEXUAL HARASSMENT IN THE WORKPLACE
INCLUDES THE FOLLOWING:
 UNWELCOME SEXUAL ADVANCES, REQUEST OR DEMAND FOR SEXUAL FAVORS OR
ANY ACT OF SEXUAL NATURE (VERBALLY, PHYSICALLY OR THROUGH THE USE OF
TECHNOLOGY) THAT HAS OR COULD HAVE A DETRIMENTAL EFFECT ON THE
CONDITIONS OF AN INDIVIDUAL’S EMPLOYMENT OR EDUCATION, JOB
PERFORMANCES OR OPPORTUNITIES; (Ex. Pagbibigyan kita sa hinihingi mong promotion, kung
pagbibigyan mo rin ako; pag-usapan natin to sa tahimik at malamig na lugar)
 A CONDUCT OF SEXUAL NATURE AND OTHER CONDUCT, BASED ON SEX,
AFFECTING THE DIGNITY OF A PERSON WHICH IS UNWELCOME,
UNREASONABLE, AND OFFENSIVE TO THE RECIPIENT (VERBALLY, PHYSICALLY OR
THROUGH THE USE OF TECHNOLOGY)
 A CONDUCT THAT IS UNWELCOME AND PERVASIVE AND CREATE AN INTIMIDATING,
HOSTILE OR HUMILIATING ENVIRONMENT FOR THE RECIPIENT

 CREATE AN INDEPENDENT INTERNAL MECHANISM OR A COMMITTEE ON
DECORUM AND INVESTIGATION TO INVESTIGATE AND ADDRESS COMPLAINTS
OF GENDER BASED SEXUAL HARASSMENT.
 PROVIDE AND DISSEMINATE, IN CONSULTATION WIL ALL PERSONS IN THE
WORKPLACE,A CODE OF CONDUCT OR WORKPLACE POLICY

What can a victim of workplace GBSH do?
 The victim can file an administrative complaint with the
Committee on Decorum and Investigation (CODI) and/or file a
civil and/or criminal case before the courts.

5. GENDER-BASED SEXUAL HARASSMENT IN EDUCATION AND
TRAINING INSTITUTIONS
 ALL SCHOOLS, WHETHER PUBLIC OR PRIVATE, SHALL DESIGNATE AN
OFFICER-IN-CHARGE TO RECEIVE COMPLAINTS REGARDING
VIOLATIONS OFTHIS ACT.
 ENSURE THAT VICTIMS PROVIDED WITH A GENDER-SENSITIVE
ENVIRONMENT THAT IS BOTH RESPECTFUL TO THE VICTIMS’ NEEDS AND
CONDUCIVE TO TRUTH-TELLING.
 ADOPT AND PUBLISH GRIEVANCE PROCEDURES TO FACILITATE THE
FILING OF COMPLAINTS BY STUDENTSAND FACULTY MEMBERS.

DUTY OF THE SCHOOL
 UPON KNOWLEDGE OF GENDER-BASED SEUXAL HARASSMENT
OR SEXUAL VIOLENCE, THE SCHOOL SHOULD PROMPTLY
INVESTIGATE TO DETERMINE THE VERACITY OF SUCH
INFORMATION OR KNOWLEDGE AND THE CIRCUMSTANCES
UNDER WHICH THE ACT OF GENDER-BASED SEXUAL
HARASSMENT OR SEXUAL VIOLENCE WERE COMMITTED AND TAKE
APPROPRIATE STEPS TO RESOLVE THE SITUATION.
 THE SCHOOL MUST TAKE IMMEDIATE ACTION TO ELIMINATE THE
SAME ACTS, PREVENT THEIR RECURRENCE,AND ADDRESS THEIR
EFFECTS.

 ONCE A PERPATRATOR IS FOUND GUILTY, THE EDUCATIONAL INSTITUTION
MAY RESERVE THE RIGHT TO STRIP THE DIPLOMA FROM THE PERPETRATOR OR
ISSUE AN EXPULSION ORDER.
 THE COMMITTEE O N DECORUM AND INVESTIGATION (CODI) OF
ALL EDUCATIONAL INSTITUTIONS SHALL ADDRESS GENDER-BASED
SEXUAL HARASSMENT AND ONLINE SEXUAL HARASSMENT IN
ACCORDANCE WITH THE RULES AND PROCEDURES CONTAINED IN THEIR
CODI MANUAL

DUTIES OF SCHOOL HEAD
 DISSEMINATE OR POST A COPY OF THIS ACT IN A CONSPICUOUS PLACE IN THE
EDUCATIONAL INSTITUTION.
 PROVIDE MEASURES TO PREVENT GENDER-BASED SEXUAL HARASSMENT IN
EDUCATIONAL INSTITUTIONS, LIKE INFORMATION CAMPAIGNS.
 CREATE AN INDEPENDENT INTERNAL MECHANISM OR A CODI TO
INVESTIGATE AND ADDRESS COMPLAINTS OF GENDER-BASED SEXUAL

FOR ADMINISTRATIVE SANCTIONS BY THE SCHOOL AS STATED IN THEIR
SCHOOL HANDBOOK.
ROUTINE INSPECTION
 THE DEPED, CHED, AND THE TESDA SHALL CONDUCT REGULAR
SPONTANEOUS INSPECTIONS TO ENSURE COMPLIANCE OF
SCHOOL HEADS WITH THEIR OBLIGATIONS UNDER THISACT.

 CONFIDENTIALITY – AT ANY STAGE OF THE INVESTIGATION,
PROSECUTION AND TRIAL OF AN OFFENSE UNDER THIS ACT, THE
RIGHTS OF THE VICTIM AND THE ACCUSED WHO IS A MINOR SHALL BE
RECOGNIZED.
 RESTRAINING ORDER – COURT, EVEN BEFORE RENDERING A FINAL
DECISION, MAY ISSUE AN ORDER DIRECTING THE PERPETRATOR TO
STAY AWAY FROM THE OFFENDED PERSON AT A DISTANCE SPECIFIED
BY THE COURT, OR TO STAY AWAY FROM THE RESIDENCE, SCHOOL,
PLACE OF EMPLOYMENT, OR ANY SPECIFIED PLACE FREQUENTED BY
THE OFFENDED PERSON.

SUCH REMEDIES OR PSYCHOLOGICAL COUNSELING SERVICES SHALL BE
BORNE BYTHE PERPETRATOR.

SAFE SPACESACT: RA NO. 11313 IT IS A SPECIAL LAW WHICH SEEKS TO ERADICATE ALL FORMS OF SEXUAL HARASSMENT BY RECOGNIZING THAT BOTH MEN AND WOMEN MUST HAVE EQUALITY, SECURITY AND SAFETY NOT ONLY IN PRIVATE, BUT ALSO ON THE STREETS, PUBLIC SPACES, ONLINE, WORKPLACES AND EDUCATIONAL AND TRAINING INSTITUTIONS.

SAFE SPACESACT :RA NO. 11313 BACKGROUND  AN OVERWHELMING 88% OF WOMEN AGED 18 TO 24 YEARS OLD EXPERIENCED SEXUAL HARASSMENT IN THE STREETS (SWS, 2010).  WHILE WOLF-WHISTLING AND CATCALLING ARE THE MORE COMMON CASES, OTHER FORMS OF SEXUAL HARASSMENT INCLUDE LASCIVIOUS LANGUAGE, STALKING, RUBBING OR TOUCHING, INCIDENT GESTURES, EXHIBITIONISM AND PUBLIC MASTURBATION.  58% OF THESE INCIDENTS TAKE PLACE ON THE STREETS AND SMALL ALLEYS. THEY HAVE ALSO BEEN REPORTED TO HAPPEN IN PUBLIC VEHICLES, WASHROOMS, SCHOOLS AND WORKPLACES.
  • 5. SAFE SPACESACT :RA NO. 11313 R.A. NO. 7877 :ANTI-SEXUAL HARASSMENT OF 1995 • THE ACT IS COMMITTED BY A PERSON WHO, HAVING AUTHORITY, INFLUENCE OR MORAL ASCENDANCY OVER ANOTHER IN A WORK OR TRAINING OR EDUCATION ENVIRONMENT, DEMANDS, REQUESTS OR OTHERWISE REQUIRES OF, WHETHER THE DEMAND, REQUEST OR REQUIREMENT FOR SUBMISSION IS ACCEPTED.

SAFE SPACESACT :RA NO. 11313 THE PHILIPPINE COMMISSION FOR WOMEN (PCW), THE PRIMARY POLICY-MAKING AND COORDINATING BODY ON WOMEN AND GENDER EQUALITY CONCERNS, OPINES THAT THE CONFINEMENT OF SEXUAL HARASSMENT TO THE EXISTENCE OF AUTHORITY, INFLUENCE OR MORAL ASCENDANCY BETWEEN THE OFFENDER AND THE OFFENDED PARTY UNDULY RESTRICT ITS APPLICATION LETTING THE SAME ACT BETWEEN PEER AND CO-WORKERS TO RUN UNCHECKED AND UNREGULATED. THE SAME ACT COMMITTED AGAINST THE SUPERIOR OFFICER IS ALSO NOT WITHIN ITS PURVIEW.

SAFE SPACESACT :RA NO. 11313  ON APRIL 17, 2019, THE SAFE SPACES ACT OR PREVIOUSLY CALLED ANTI- BASTOS BILL, WAS SIGNED INTO LAW BY THE PRESIDENT.  WITH THE AIM OF ENSURING AN INDIVIDUAL’S SENSE OF PERSONAL SPACE AND PUBLIC SAFETY, THE SAFE SPACES ACT ADDRESSES GENDER-BASED SEXUAL HARASSMENT IN PUBLIC AREAS SUCH AS STREETS, PRIVATELY- OWNED PLACES OPEN TO THE PUBLIC, AND PUBLIC UTILITY VEHICLES, AMONG OTHERS. IT ALSO EXTENDS THE PROTECTION EVEN TO CYBERSPACE AND PROVIDES FOR PROHIBITED ACTS AND THEIR CORRESPONDING PENALTIES.
  • 8. SAFE SPACESACT :RA NO.11313  ANY PERSON, NOT ONLY WOMEN, BUT MEN AND CHILDREN ARE ALSO PROTECTED.  IT IS NOT ONLY WOMEN W H O ARE PROTECTED UNDER THE SAFE SPACES ACT, BECAUSE IT RECOGNIZES THAT ANYONE CAN PERPETUATE SEXUAL HARASSMENT AND ANYONE CAN BE A VICTIM OF SEXUAL HARASSMENT.

SAFE SPACESACT :RA NO. 11313 SALIENT FEATURES OF THE SPACE SAFE ACT  GENDER-BASED SEXUAL HARASSMENT  EXPANDS THE SCOPE OF ANTI-SEXUAL HARASSMENT ACT OF 1995  STRENGTHENS THE ADMINISTRATIVE MECHANISMS AGAINST SEXUAL HARASSMENT IN WORKPLACES AND IN EDUCATIONAL AND TRAINING INSTITUTIONS.  RECOGNIZES THAT SEXUAL HARASSMENT CAN BE COMMITTED BETWEEN PEERS OR BY A SUBORDINATE TO A SUPERIOR, BY A STUDENT TO A TEACHER OR BY A TRAINEE TO A TRAINER.
