Ballynagran Landfill Facility
Greenstar Holdings went into receivership in August 2012. The Bank of Ireland
appointed David Carson as Receiver over Greenstar Holdings (those parts of
the Greenstar Group not actively involved in landfïll operations). The
Ballynagran landfïll is now being operated by Greenstar South East Limited. It
should be noted that Greenstar South East is not the licensed operator of the
Landfill - the licence is issued to Greenstar Holdings Ltd.
The EPA has issued proceedings in the High Court against Greenstar Holdings
Ltd as Licensee of the landfill, Greenstar Ltd, Greenstar North East Ltd,
Greenstar South East Ltd, Greenstar Connaught Ltd, KTK Landfill Ltd, Bank of
Ireland and David Carson as receiver. This action seeks to recover monies
which Greenstar was required to keep for purposes of closure, remediation,
restoration and aftercare, and which, in breach of that requirement, it dissipated.
Approximately €12 million of those monies is now in the hands of Bank of
Ireland, and the Agency is seeking to recover it. The Agency is also seeking
payment from Bank of Ireland of €6 million on foot of guarantees which it
provided to ensure payment of Greenstar's liabilities.

misappropriated by Greenstar / Receiver or Bank of Ireland.
Issues with Smells. Since January the smells from the Landfill have been
particularly bad.
