The AS is worth 50% of the overall
A level grade.
What skills will you need to be a
successful law student?
 Can you retain a lot of information accurately?
 Can you write clear, well structured essays in timed conditions?
 Can you motivate yourself to meet deadlines, work independently
and support your class learning?
 Can you produced a detailed piece of writing with well explained or
argued points, supported by clear evidence?
Equipment?
 For each topic you will receive a hand out, and so do not need a
text book
 There are copies of AS textbooks in the libraries for you to borrow.
 You may find a supportive book like the My Revision Notes AS
Law series helpful, or the A Level Law Review Magazine.
 There will be a list of helpful websites in the AS Law guide you
receive at the end of the introductory unit.
Overview of the Course:
English Legal System
We will follow the whole system
through... from the police to the
conviction, sentencing and appeal...
And learn what it will take to be a lawyer!
1 x 2 hour exam
4 question – a mix of essay & problems
WEEK A
Sources of Law
Basically, this will show you where we get
laws from, how we make them and
how we figure out what they mean
We will look at both how Parliament and
how the Courts, as well as the EU
create law.
1 x 1 hour exam
1 complete question – a mix of essays &
short problems.
WEEK B
Independent Study
This is not optional.. .
You will be given one task per week
They will be set, by email, on the Friday, and due in by
3.20 the following Friday.
 They will also be detailed on the blog for your
information.
You will need to sign in in the library and complete it
during one of your IS hours, leaving it in the box.
You can use the resources of the libraries at either school,
or the internet – there will be suggestions as to where to
start on the task sheet
Any questions?
Introduction to the Law:
Can you solve the riddle?
Which crime is not a crime
if you do it, but is a crime
if you assist it?
Suicide
What does the law say?
This is an Act of Parliament.
1. What is the maximum
sentence for this offence?
2. What is the purpose of
the Act?
3. Who will convict you of
the offence?
Applying the Law:
When might you be liable?
Task:
Look at the scenarios on your table.
All of you should be able to decide
whether or not they would be liable for
assisting the death of V and why.
Most of you should be to decide
whether any of those liable should
instead be liable for the murder of V.
Some of you may be able to support
your reasoning with reference to the
case(s) you looked at for homework.
That’s one approach
So, should we change the law?
Lord Falconer’s
Private Member’s Bill
Can you find your way through
the legal language and work
out what its about?
This is why Acts of Parliament take so long!
Starter:
How much detail can you answer in?
If I help someone
to die, I am always
liable for an
offence. Is this true?
Why?
A person who
helps another to die
may be charged with
which offences?
Name the Act which
covers the offence
of assisted suicide.
Below are three levels of the same question...
How much detail can you give in your response?
Intro:
Why do we look to the courts?
Either for clarification of what the
statue says...
Or establishing or refining a common
law principle which Parliament has not
covered yet.
To know which court we should listen
to, we need to know the court
hierarchy...
Can you complete it?
So what have the courts got to say?
Working with your Summer Homework
Cases:
 Re A (conjoined twins) [2001] 2 WLR 480.
 Nicklinson v Ministry of Justice (2012) EWHC 2381
 Airedale N.H.S. Trust v Bland [1993] A.C. 789
 Purdy v DPP (2009) UKHL 45
Each of these cases were arguing that there should be no liability
for helping someone to die. What was the Court’s response?
All of you need to complete the
summary of your cases on the
reverse of your work sheet
Most of you need to use the case
summary sheets to complete
the overview of the four cases
Some of you will be able to use
the four cases to produce a
summary of the court’s
approach to the issue of
assisted suicide.
Got it?
Can you answer the following questions to check your understanding?
1. Tony Nicklinson was asking for the
extension of which decision to his
facts?
2. Why was the court ok with removing
the feeding tube in Bland?
3. How was Debbie Purdy’s case
different to the other three?
4. What grounds was the Re:A decision
made on?
5. Which two cases took place in the
Court of Appeal?
A couple more decisions of interest...
Reading a case...
 Article 2 ECHR says that we all have the
‘Right to Life’
 Do we have a similar ‘right to death’ in a
manner we wish?
 Article 3 ECHR, says that we can not be
subject to inhumane and degrading
treatment.
 Is leaving someone to die, such
treatment?
Pretty v UK 2002
Sought a declaration from the DPP
that her husband would not be
prosecuted if he helped her to die.
The House of Lords (Supreme Court)
had turned her down…
…she appealed to the ECtHR
 Which case is this similar to?
 Can you explain the different
outcomes in the two cases?
 Do you think that we should
have a right to die? Why? Why
not?
A limitation on the law?
Analysing a case...
Read the case report from the bbc and
answer the questions in as much detail as
you can.
This is known as original precedent which
is where the court makes a decision on a
brand new area of law.
They do it by analogy.
Re: M 2011So, we can remove a feeding tube from
someone in PVS, accompany our loved
ones abroad if it is their wish…
What about those in a minimally
conscious state? Can we remove the
feeding tube?
Task:
Read the article in your source
booklets and answer the questions in
as much detail as you can (you may
find it useful to answer questions 6
and 7 the other way round!).
Extension: Summarise the common law
relating to assisted suicide and
euthanasia, using at least three cases
in your response.
The Most Recent Decision...
R (Nicklinson and another) v Ministry of Justice 2013
In July this year, the
Court of Appeal
handed down the
most recent decision
in this area.
Watch the video and
read one of the two
reports.
What did the courts
decide and why?
Which other cases does
it link to?
How does it link to
those other cases?
What do you think the
Supreme Court will say?
Plenary:
Summarise the law so far!
Possible offences for those
assisting V to die:
Possible defences for those
assisting V to die:
Proposals for reform:
Court decisions:
1. Case:
Question of Law
Outcome
2. Case:
Question of Law
Outcome
3. Case:
Question of Law
Outcome
4. Case:
Question of Law
Outcome
Key Terms:
Homework:
“With reference to the decisions of the Courts and Parliament,
discuss whether the government should change the law on
assisted suicide and allow mercy killings in some circumstances.”
Write your response to the
question above, referring to at
least two cases, and one statute
in your conclusions.
It should be a minimum of 2
sides.
Cases should be in italics
 Statutes should be
underlined.
