1) An ACAS collision avoidance system scenario where a pilot must choose between following an RA that could cause an accident with one aircraft or not following it and causing an accident with another.
2) A scenario where an RPAS is stolen during flight and used illegally to film a military zone, raising legal issues around the operator's responsibility.
3) An scenario where an RPAS surveying a cultural site collides with and damages the monument, discussing the civil liability of the owner/operator under Italian law.

In both the EU and US, there are safe harbour provisions in place that should, under certain conditions, provide online service providers (OSPs) with immunity in the case of intellectual property infringement by third parties. However, the significant litigation against OSPs demonstrates that the safe harbour provisions are neither effective nor efficient. By providing OSPs with immunity against third party liability, safe harbour provisions contribute to a climate where the behaviour of OSPs is dominated by short-term business interests which are conducive neither to the enforcement of intellectual property rights by the OSPs nor to legal certainty for proprietors, internet users and OSPs alike.
The precondition for invoking safe harbour provisions, that one remain passive and only act reactively, leads to wilful blindness, although OSPs are best positioned to filter infringing use of content proactively. This article therefore asserts that the safe harbour provisions must be replaced by strict intermediary liability. As will be pointed out below, this transition is not as dramatic as it seems.
Safe harbours provisions were drafted at a moment when OSPs, as social media, still needed to be developed. They do not protect proprietors against infringement. Moreover, the protection of OSPs against liability is an illusion. If one extrapolates the development in filter technology one can see that advocating safe harbour provisions has become a rearguard battle and that implementation of strict liability for OSPs is inescapable.

This intends to define task allocation between the remote pilot and the drone in order to derive task responsibilities of all actors involved in drones operations.

Italian Domestic Law: Criminal Law
• Art. 682 Penal Code: “Whosoever enters places, where the access is
forbidden because of the military interest of the State, is punished with the
imprisonment from three months to one year or with a fine from fifty to
three hundred and nine euro, unless the act does not constitute a more
serious crime.
The provisions of this Article shall apply also to a property used as
headquarters of the office, department, or storage of materials of the
Administration of Public Security, to which access is prohibited for reasons of
public safety”.
12. Is there any general duty to report?
It does not exist any general duty to report for private citizens
unless the violation concerns particularly serious crimes.
Art. 364 Penal Code: “The citizen that is informed of a crime
against the State, for which the law establishes a life sentence,
and does not immediately report to the Authorities indicated in
article 361, he shall be punished with imprisonment up to one
year or with a fine of one hundred and three thousand thirty
Euros”.

13. What should the RPAS operator do when he realizes that his
drone has been used to commit a crime?
• The owner of the RPAS is responsible as coauthor of
the crime with the hacker
• The prosecutor has the burden of proof that the
hacker and the operator had a shared plan
• The operator’s defense might have an interest to
demonstrate that he did not cooperate in the
criminal action neither materially nor in the planning
of the action

Art. 2051 civil code: “Everyone is liable for the damage caused by goods that are
in its custody, unless the fortuitous case is proved”.
Three elements:
• The good: The majority of legal cases have held that the duty of control and
custody ex art. 2051 c.c. exists even in relation to things devoid of a proper
dynamism and however able to cause damages.
• The custody: the basis for liability resides in the relation between person and
good that can be identified in the power that the subject can exercise on the
object to avoid to cause damages to third parties.
• The causation: it shall exist a causation link between the good and the
damage. It is sufficient to prove that the good caused the damage.
