Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

C++ is an enhanced and extended version of C programming language, developed by Bjarne Stroustrup in 1979 as part of his Ph.D. project. 1. Algemene Bezoekersvoorwaarden DRIJFT
Deze Algemene Bezoekersvoorwaarden zijn van de besloten vennootschap met beperkte
aansprakelijkheid Nederland Drijft B.V. (hierna: 'DRIJFT'), KvK nummer 71153683, en zijn
van toepassing op alle overeenkomsten die met bezoekers van door haar of in opdracht van haar
georganiseerde evenementen worden gesloten.
Artikel 1 Definities
DRIJFT:
De besloten vennootschap met beperkte aansprakelijkheid Nederland Drijft B.V. die haar bedrijf
onder andere maakt van het (doen) verlenen van diensten op het gebied van uitvoerende kunst en
met betrekking tot het (doen) organiseren van evenementen en de daarbij behorende
werkzaamheden en diensten;
Bezoeker:
Iedere natuurlijke persoon, die niet handelt in de uitoefening van een beroep of bedrijf en die direct
of indirect een overeenkomst sluit met DRIJFT in het kader van het bijwonen van een Evenement
alsmede een ieder die zich in, op of rondom de Evenementenlocatie begeeft;
Evenement:
Een ééndaagse gebeurtenis, waaronder begrepen een (muziek)-uitvoering en/of andere
manifestatie, een concert, dance-event, business-event of festival waaraan één of meerdere
personen deelnemen, georganiseerd en/of gefaciliteerd door of vanwege DRIJFT op de
evenementenlocatie;
Evenementenlocatie:
Locatie(s) waar een Evenement plaatsvindt, welke is ingezet
ten behoeve van het door of vanwege DRIJFT te organiseren en/of faciliteren.
Algemene Bezoekersvoorwaarden:
De onderhavige Algemene Bezoekersvoorwaarden die op(rechts)verhouding tussen de Bezoeker en
DRIJFT van toepassing zijn;
Overeenkomst:
Iedere verbintenisrechtelijke rechtsverhouding tussen de Bezoeker en DRIJFT die conform deze
Algemene Bezoekersvoorwaarden tot stand is gekomen en/of hieruit voortvloeit in verband met het
bijwonen van een Evenement, alsmede elke andere conform deze Algemene Bezoekersvoorwaarden
rechtsgeldig op de (rechts)verhouding tussen de Bezoeker en DRIJFT van toepassing verklaarde
bepaling of uiting;
(Voor)verkoopadres:
Een ten behoeve van de verkoop van toegangsbewijzen voor Evenementen door DRIJFT
ingeschakelde (voor)verkooporganisatie, inclusief die waar online/digitaal toegangsbewijzen kunnen
worden aangeschaft;
2. Toegangsbewijs:
Een rechtsgeldig verkregen bewijs, door of vanwege DRIJFT verstrekt, waaruit de bevoegdheid van de
Bezoeker blijkt zich op de Evenementenlocatie te mogen bevinden;
Toegangsprijs:
De prijs voor een Toegangsbewijs, zoals vermeld op het Toegangsbewijs, exclusief eventuele extra
service- en/of administratiekosten;
Artikel 2 Toepasselijkheid
2.1 Deze Algemene Bezoekersvoorwaarden zijn van toepassing op iedere Overeenkomst die tot
stand komt tussen DRIJFT en de Bezoeker ongeacht de wijze waarop deze Overeenkomst tot stand
komt, als ook op ieder bezoek van de Bezoeker aan de Evenementenlocatie.
2.2 DRIJFT heeft het recht deze Algemene Bezoekersvoorwaarden te allen tijde geheel of
gedeeltelijk te wijzigen. DRIJFT zal de Bezoeker tijdig van de wijzigingen in de Algemene
Bezoekersvoorwaarden in kennis stellen door dit op haar Social Media te melden. Indien de
Bezoeker van mening is dat de wijzigingen in strijd met de redelijkheid en billijkheid zijn, dan
dient de Bezoeker DRIJFT hiervan binnen 10 (tien) werkdagen na de in kennis stelling te
berichten, bij gebreke waarvan de Bezoeker zich met de wijzigingen akkoord verklaart.
2.3 De nietigheid van enige bepaling van deze Algemene Bezoekersvoorwaarden tast de
geldigheid van de overige bepalingen van deze Algemene Bezoekersvoorwaarden niet aan.
2.4 Op de aankoop van een Toegangsbewijs kunnen, naast de Algemene Bezoekersvoorwaarden,
(ook) eventuele (algemene) voorwaarden van de ticketprovider van toepassing zijn.
Artikel 3 Aanbiedingen en totstandkoming Overeenkomst
3.1 Informatie, aanbiedingen, mededelingen en prijsopgaven met betrekking tot Evenementen
en/of (de verkoop van) Toegangsbewijzen worden zo nauwkeurig mogelijk door DRIJFT en/of derden
mondeling, telefonisch, per e-mail, via de Website(s) en/of Social Media (weer)gegeven of verstrekt.
DRIJFT aanvaardt geen aansprakelijkheid voor eventuele onjuistheden of onvolledigheden in de
hiervoor bedoelde door DRIJFT en/of derden gedane mededelingen.
3.2 Een Overeenkomst komt tot stand op het moment dat de Bezoeker een Toegangsbewijs koopt
bij DRIJFT of een door DRIJFT ingeschakeld (Voor)verkoopadres, althans een aanbod van of vanwege
DRIJFT tot verkrijging ervan, al dan niet tegen betaling, heeft aanvaard en/of bij betreding van de
Evenementenlocatie.
Artikel 4 Toegang en Toegangsbewijs
4.1 De Bezoeker dient bij het betreden van de Evenementenlocatie en gedurende de periode dat
de Bezoeker op de Evenementenlocatie aanwezig is, te beschikken over een geldig legitimatiebewijs,
een geldig (verkregen) Toegangsbewijs en deze op eerste verzoek van medewerkers van DRIJFT,
medewerkers van de Evenementenlocatie, beveiligingspersoneel, politie en/of ander bevoegd gezag
te tonen. Indien blijkt dat de Bezoeker onder de 18 jaar oud is, wordt de toegang tot het Evenement
zonder meer ontzegd, tenzij expliciet anderszins bepaald door DRIJFT, zonder dat DRIJFT gehouden is
tot restitutie van de Toegangsprijs of eventuele in rekening gebrachte service- en/of
administratiekosten en/of anderszins ontstane kosten.
3. 4.2 Een Toegangsbewijs wordt eenmalig aan Bezoeker verstrekt en geeft aan één Bezoeker
eenmalig toegang tot het Evenement en de Evenementenlocatie en verliest na het verlaten van
de Evenementenlocatie automatisch zijn geldigheid.
4.3 Een Toegangsbewijs verschaft slechts de houder van het Toegangsbewijs toegang tot de
Evenementenlocatie. Het is de eigen verantwoordelijkheid van de Bezoeker om er voor te zorgen dat
hij de houder wordt en blijft van het Toegangsbewijs. Toegangsbewijzen zijn en blijven eigendom van
DRIJFT.
4.5 Een Toegangsbewijs bestaat uit een door of vanwege DRIJFT verstrekt document met barcode.
De barcode is een unieke code, die via elektronische communicatie (bijvoorbeeld e-mail) aan de
Bezoeker wordt verstrekt. Indien de Bezoeker ervoor heeft gekozen het Toegangsbewijs op deze
wijze te ontvangen, dient de Bezoeker ervoor te zorgen dat dit Toegangsbewijs daadwerkelijk en op
een veilige wijze via elektronische communicatie kan worden verstrekt. DRIJFT garandeert noch de
vertrouwelijkheid noch de ontvangst van het Toegangsbewijs.
4.6 Alleen aanschaf via DRIJFT of door haar ingeschakelde (Voor)verkoopadressen
garandeert de geldigheid van het Toegangsbewijs. Toegangsbewijzen kunnen door of vanwege
DRIJFT ongeldig worden verklaard en/of de Bezoeker kan de toegang tot de Evenementenlocatie
door of vanwege DRIJFT worden ontzegd, wanneer zou blijken dat het Toegangsbewijs niet is
verkregen van DRIJFT of van een door DRIJFT ingeschakeld (Voor)verkoopadres dan wel in het geval
van fraude, misbruik en/of overtreding anderszins van (een van) in de artikelen 4.1 t/m 4.11
neergelegde regels.
4.7 Vanaf het moment dat het Toegangsbewijs aan de klant ter beschikking is gesteld, rust op de
klant het risico van verlies, diefstal, beschadiging of misbruik van het Toegangsbewijs. De
Bezoeker is niet gerechtigd tot restitutie van de Toegangsprijs of enige andere vergoeding in
geval van verlies, diefstal beschadiging of misbruik van het Toegangsbewijs, alsmede in het
geval dat de Bezoeker om welke reden dan ook geen gebruik maakt van het Toegangsbewijs.
Een eenmaal verkregen Toegangsbewijs kan niet worden teruggeven of geruild.
4.8 Het is de Bezoeker niet toegestaan vermeldingen met betrekking tot auteursrechten, merken,
logo’s, modellen, handelsnamen en/of andere industriële of intellectuele eigendomsrechten van
DRIJFT en/of haar licentiegevers van de Toegangsbewijzen te (doen) verwijderen en/of
wijzigen dan wel op andere wijze de intellectuele eigendomsrechten van DRIJFT aan te
tasten.
4.9 DRIJFT behoudt zich het recht voor een maximum te stellen aan het aantal Toegangsbewijzen dat
per (potentiële) Bezoeker mag worden verkregen; de (potentiële) Bezoeker is in dat geval verplicht
zich hieraan te houden.
4.10 Toegang tot evenementen van DRIJFT die in de buitenlucht plaatsvinden staat voor
Bezoekers met een geldig toegangsbewijs in beginsel open tot 17.00 uur 's middags. Na 17.00
uur worden Bezoekers niet meer toegelaten tot de evenementenlocatie, tenzij DRIJFT in
een specifiek geval anders beslist.
4. Artikel 5 Verbod doorverkoop Toegangsbewijzen
5.1 Het is verboden een Toegangsbewijs op welke wijze dan ook aan derden door te (doen)
verkopen, te koop aan te (doen) bieden of in het kader van commerciële doeleinden aan
derden te (doen) verstrekken, tenzij via een door DRIJFT aangewezen additioneel officieel
verkoopkanaal voor secondary ticketing verkoopkanaal zoals Ticketswap. Het is eveneens
verboden het eventuele door DRIJFT gestelde maximum als bedoeld in artikel 4.9 van
deze Algemene Bezoekersvoorwaarden te (doen) overschrijden, direct dan wel indirect, onder
meer door via derden Toegangsbewijzen aan te (doen) schaffen en deze via derden verkregen
Toegangsbewijzen vervolgens op welke wijze dan ook aan derden door te (doen) verkopen, te
koop aan te (doen) bieden of in het kader van commerciële doeleinden aan derden te (doen)
verstrekken. Reguliere persoonlijke doorverkoop van een Toegangsbewijs via TicketSwap is
van het voorgaande uitgezonderd.
5.2 Indien de Bezoeker zijn Toegangsbewijs om niet en niet in het kader van commerciële
doeleinden aan derden ter beschikking stelt, is de Bezoeker in dat geval gehouden om alle
verplichtingen van de Bezoeker die voortvloeien uit een Overeenkomst of deze Algemene
Bezoekersvoorwaarden, onverminderd op leggen aan die derden. De Bezoeker staat er voor in
dat voornoemde derden alle voornoemde verplichtingen nakomen en/of zullen nakomen.
5.3 Indien de Bezoeker zich niet aan de verplichtingen uit dit artikel houdt, is DRIJFT
gerechtigd die Toegangsbewijzen aan te merken als ongeldig, kan hem de toegang tot het
Evenement ontzegd worden. De houder van een ongeldig Toegangsbewijs krijgt geen toegang tot het
Evenement of de Evenementenlocatie en heeft geen recht op enige vergoeding.
Artikel 6 Aansprakelijkheid
6.1 Het reizen van en naar als ook het betreden van, verblijven en activiteiten verrichten op en
verlaten van de Evenementenlocatie en het bijwonen van c.q. deelnemen aan het Evenement op de
Evenementenlocatie geschiedt geheel op eigen risico van de Bezoeker. DRIJFT ziet er op toe dat alle
in redelijkheid te nemen maatregelen zijn getroffen ter vermijding van schade voor Bezoekers.
DRIJFT is niet aansprakelijk voor enige schade, hoe ook genaamd, die de Bezoeker mocht lijden als
gevolg van de deelname, tenzij deze schade het directe gevolg is van aan DRIJFT toe te rekenen opzet
of grove schuld. Deze uitsluiting van aansprakelijkheid geldt ook voor ernstige schadesoorten zoals
alle mogelijke schadesoorten ten gevolge van letsel of overlijden.
6.2 DRIJFT is niet aansprakelijk voor schade als gevolg van de annulering,
wijziging of verplaatsing van een Evenement, noch voor enigerlei andere schade, uit welke
hoofde dan ook, welke direct of indirect het gevolg is van handelen of nalaten van DRIJFT
en/of de door haar in het kader van het Evenement ingeschakelde ondergeschikten, niet
ondergeschikten, hulppersonen, derden en/of andere personen, tijdens of in verband met het
Evenement, waaronder het reizen naar en van of verblijf op de Evenementenlocatie, tenzij de
schade het gevolg is van opzet of grove schuld van DRIJFT.
6.3 DRIJFT sluit haar aansprakelijk uit voor de wijze waarop aan het programma van het
Evenement, al dan niet in gewijzigde vorm, invulling wordt gegeven, daaronder mede begrepen
de inhoud en duur van het programma van het Evenement.
6.4 Indien en voor zover DRIJFT ondanks het bepaalde in deze Algemene Bezoekersvoorwaarden op
welke grond ook jegens de Bezoeker aansprakelijk mocht zijn voor enige door de Bezoeker geleden
schade, dan is deze aansprakelijkheid te allen tijde beperkt tot directe schade en tot het bedrag dat
onder de betreffende aansprakelijkheidsverzekering van DRIJFT zal worden uitgekeerd, en slechts
indien zij hiertoe wettelijk gehouden is. Ingeval van een tekortkoming is DRIJFT in een dergelijk geval
tevens slechts aansprakelijk, indien de Bezoeker DRIJFT onverwijld en op deugdelijke wijze schriftelijk
op de hoogte brengt van de tekortkoming, waarbij tevens een redelijke termijn wordt gesteld om
alsnog aan de verplichting te voldoen c.q. de fout te herstellen en indien DRIJFT ook na
die ingebrekestelling blijft tekortschieten in de nakoming van die verplichting c.q. het herstel
van de fout.
5. 6.5 DRIJFT sluit haar aansprakelijk uit voor verlies van kleding, zaken en/of andere
eigendommen van de Bezoeker en aanvaardt als zodanig ook geen aansprakelijkheid. Indien
de Bezoeker met concreet bewijs kan aantonen dat verlies van kleding, zaken en/of andere
eigendommen van de Bezoeker uitsluitend het gevolg is van opzet of grove schuld van
(personeel van) DRIJFT, dient de Bezoeker dit onverwijld en schriftelijk aan DRIJFT
te melden op straffe van verval van enige aanspraak op schadevergoeding en zal DRIJFT
op vertoon van een geldig aankoopbewijs van de betreffende eigendom(men) aan die
Bezoeker een vergoeding uitkeren ter hoogte van maximaal het aankoopbedrag, met een
maximum van € 250 (zegge: twee honderd en vijftig euro).
6.6 Gevonden voorwerpen dienen te worden afgegeven aan medewerkers van DRIJFT. Gevonden
voorwerpen worden door DRIJFT twee weken in bewaring genomen, gedurende welke periode de
rechtmatige eigenaar de door hem of haar verloren eigendom(men) bij DRIJFT kan afhalen.
6.7 DRIJFT sluit haar aansprakelijkheid uit voor indirecte schade, gevolgschade, gehoorschade,
zichtschade, blindheid en/of ander lichamelijk letsel van de Bezoeker in verband met het Evenement.
De Bezoeker is er uitdrukkelijk mee bekend dat er tijdens het Evenement en op of rondom de
Evenementenlocatie luide en/of versterkte muziek ten gehore kan worden gebracht.
6.8 De Bezoeker dient afdoende verzekerd te zijn tegen het risico van schade die hij of een
nabestaande mocht lijden ten gevolge van zijn overlijden, letsel of ziekte, veroorzaakt door zijn of
haar deelname aan het Evenement.
6.9 De Bezoeker vrijwaart DRIJFT voor aansprakelijkheid voor schade die derden mochten lijden als
gevolg van een aan een de Bezoeker toe te rekenen handelen of nalaten met betrekking tot het
Evenement. De Bezoeker dient afdoende verzekerd te zijn tegen het risico van aansprakelijkheid voor
dergelijke schade.
6.10 Het bepaalde in dit artikel geldt ook ten gunste van alle (rechts)personen waarvan DRIJFT zich
bij de uitvoering van de Overeenkomst bedient.
Artikel 7 Wijziging, annulering of verplaatsing Evenement
7.1 DRIJFT is gerechtigd (onderdelen van) een Evenement te annuleren, indien daartoe door DRIJFT
voldoende reden aanwezig wordt geacht, zonder dat de Bezoeker daardoor enige aanspraak heeft op
schadevergoeding. DRIJFT zal de Bezoeker zo snel als redelijkerwijs mogelijk in kennis stellen van een
annulering. Als er sprake is van overmacht dan is artikel 9 (Overmacht) van toepassing. Is er geen
sprake van overmacht dan heeft de Bezoeker recht op restitutie van de Toegangsprijs, maar niet op
de administratie- en servicekosten.
7.2 DRIJFT is gerechtigd (onderdelen van) een Evenement te wijzigen, zoals bijvoorbeeld het
programma, de locatie, de indeling, de tijdstippen, zonder dat de Bezoeker daardoor enige aanspraak
op schadevergoeding heeft. Het is de verantwoordelijkheid van de Bezoeker om te controleren of
een Evenement is gewijzigd. Bij wijziging zal DRIJFT haar best doen om ervoor te zorgen dat, zodra zij
hiervan op de hoogte is, de Bezoeker daarover wordt geïnformeerd. DRIJFT kan echter niet
garanderen dat de Bezoeker deze informatie voor aanvang van het Evenement ontvangt. DRIJFT is in
geval van wijziging niet gehouden tot vergoeding of restitutie van de Toegangsprijs van het
Toegangsbewijs en eventuele in rekening gebrachte service-, betaal- en/of administratiekosten en/of
anderszins ontstane kosten.
7.3 Toegangsbewijzen voor Evenementen die worden verplaatst blijven voor dat verplaatste
Evenement in beginsel geldig.
7.4 Indien een Evenement door of vanwege DRIJFT wordt verschoven naar een andere
datum blijft het Toegangsbewijs geldig voor de nieuwe datum waarop het Evenement zal
plaatsvinden. Mocht de Bezoeker het Evenement op de nieuwe datum niet kunnen of willen
bezoeken dan is de Bezoeker gerechtigd het Toegangsbewijs te retourneren aan DRIJFT of aan een
door DRIJFT ingeschakeld (Voor)verkoopadres. Ingeval van overmacht is artikel 9 (Overmacht) van
toepassing. Als geen sprake is van overmacht dan heeft de Bezoeker recht op restitutie van de
Toegangsprijs welke vermeld staat op het Toegangsbewijs, ongeacht welke prijs de Bezoeker voor
het Toegangsbewijs heeft betaald. Service- en/of administratiekosten zullen niet worden vergoed.
6. Artikel 8 Huisregels Evenement
8.1 Op ieder bezoek van de Bezoeker aan Evenementen van DRIJFT zijn de Huisregels van
DRIJFT van toepassing. Bezoekers zijn gehouden zich in overeenstemming met deze
Huisregels van DRIJFT en/of de Evenementenlocatie als ook de in het maatschappelijk
verkeer geldende regels van goed fatsoen en goede zeden te gedragen. Indien de Bezoeker
zich naar het oordeel van medewerkers van DRIJFT en/of de Evenementenlocatie en/of
beveiligingspersoneel niet op een dergelijke wijze gedraagt, kan de Bezoeker hier door
medewerkers van DRIJFT en/of de Evenementenlocatie en/of beveiligingspersoneel op
worden aangesproken. Bij overtreding van de Huisregels of eventuele herhaling of voortduren
van gedragingen van de Bezoeker die niet in overeenstemming met de genoemde Huisregels
en de in het maatschappelijk verkeer geldende regels van goed fatsoen en goede zeden zijn,
kan de Bezoeker de toegang tot het Evenement worden ontzegd en indien noodzakelijk worden
overgedragen aan de politie, zonder het recht op vergoeding van de Toegangsprijs en
eventuele in rekening gebrachte service- en/of administratiekosten en/of anderszins ontstane
kosten.
8.2 Het is de Bezoeker niet toegestaan om het bezoek aan het Evenement vast te leggen, in welke
vorm dan ook, op welke (digitale) drager dan ook, waaronder mede begrepen het fotograferen,
filmen, dan wel iedere andere wijze van het maken van geluids-, en/of beeldopnamen van het
Evenement. Indien de Bezoeker het Evenement heeft in niet-professionele zin heeft
vastgelegd, zoals met een smartphone, dan is de Bezoeker slechts toegestaan deze opnamen
voor eigen privégebruik en mogen deze op geen enkele wijze door de Bezoeker met een
commercieel oogmerk worden gebruikt of openbaar gemaakt.
8.3 DRIJFT behoudt zich het recht voor om gedurende een Evenement geluids- en/of
beeldopnamen te maken. De Bezoeker die een Evenement bezoekt:
a. stemt in met opname en/of (her)gebruik van zijn/haar naam, stem, portret en /of
afbeelding door middel van al dan niet live uitgezonden en opgenomen audio en video
display, uitzending of andere vorm van distributie waaronder foto’s of’ andere huidige
en/of toekomstige media technologieën; en
b. geeft onvoorwaardelijk toestemming tot het (her)gebruik zoals bedoeld in sub a), voor
onbepaalde tijd, wereldwijd en om niet; en
c. stelt noch DRIJFT noch partijen die met toestemming van DRIJFT gebruik
maken van beeld- en/of geluidsmateriaal voor al dan niet commerciële doeleinden,
aansprakelijk voor het (her)gebruik van dit beeld- en /of geluidsmateriaal; en
d. doet afstand van zijn/haar portretrecht, imagerecht en personarecht voor zover het gaat
om beelden in en rond de Evenementenlocatie waarbij hij/zij herkenbaar in beeld komt;
en
e. erkent dat een videobewakingssysteem operationeel is en gaat ermee akkoord dat door
of namens DRIJFT in het kader van openbare orde en veiligheid video opnamen
van de Bezoeker gemaakt kunnen worden; en
f. erkent dat mogelijke rechten van intellectuele eigendom, waaronder auteursrechten en
naburige rechten, met betrekking tot het door of vanwege de Bezoeker gemaakte beelden/
of geluidsmateriaal, in onverdeelde eigendom toevallen aan DRIJFT; de Bezoeker zal op eerste
verzoek van DRIJFT, om niet, de volledige medewerking verlenen aan alle eventuele formaliteiten
nodig om een rechtenoverdracht of rechtenverlening anderszins te bewerkstelligen; DRIJFT is te allen
tijde gerechtigd het hier bedoelde door of vanwege de Bezoeker gemaakte beeld- en/of
geluidsmateriaal te (doen) gebruiken, op welke wijze dan ook.
8.4 Het is de Bezoeker niet toegestaan om zonder de uitdrukkelijke schriftelijke toestemming van
DRIJFT, op de Evenementenlocatie promotiemateriaal, waaronder mede begrepen
samples, flyers, reclame en/of foldermateriaal uit te delen of te doen uitdelen voor zover de wet
dit toelaat.
8.5 Op de Evenementenlocatie is het slechts toegestaan te roken in de daarvoor aangewezen
7. (rook)ruimte(n). Buiten deze (rook)ruimte(n) is het uitdrukkelijk niet toegestaan te roken.
DRIJFT zal zich in alle redelijkheid inspannen om de Bezoeker op het rookvrije karakter
van (delen van) de Evenementenlocatie te wijzen. DRIJFT garandeert daarbij evenwel niet
dat het Evenement geheel rookvrij is. Het niet geheel rookvrij (kunnen) zijn van het Evenement
geeft de Bezoeker geen recht op restitutie van de Toegangsprijs of enige andere vergoeding.
Bij overtreding door de Bezoeker van het rookverbod volgt indien mogelijk onmiddellijke
verwijdering van de Bezoeker van het Evenement en de Evenementenlocatie. De eventuele als
gevolg van deze overtreding van het rookverbod aan DRIJFT opgelegde boetes zullen op
de Bezoeker worden verhaald. Onder roken wordt in dit verband tevens verstaan elektrisch
roken.
8.6 DRIJFT zal al hetgeen in alle redelijkheid binnen haar mogelijkheden ligt, ondernemen om
de veiligheid van de Bezoeker op de Evenementenlocatie zo veel mogelijk te waarborgen. In
het kader van de veiligheid op de Evenementenlocatie is de Bezoeker dan ook gehouden op
eerste verzoek van medewerkers van DRIJFT en/of de Evenementenlocatie,
beveiligingspersoneel, politie en/of ander bevoegd gezag:
a. zijn of haar medewerking te verlenen aan onderzoek aan kleding (fouilleren), zowel bij de
toegang tot het Evenement en de Evenementenlocatie als ook gedurende het verblijf op
het Evenement en de Evenementenlocatie; en/of inzage te verschaffen in meegevoerde
(hand/rug/draag)tas(sen) zowel bij de toegang tot het Evenement en de Evenementenlocatie als ook
gedurende het verblijf op het Evenement en de Evenementenlocatie; en/of
b. een detectiepoort te passeren; en/of
c. zich te legitimeren zowel bij de toegang tot het Evenement en de Evenementenlocatie
als ook gedurende het verblijf op het Evenement en de Evenementenlocatie.
De Bezoeker die zich hier niet aan wenst te onderwerpen, kan de toegang tot het
Evenement en de Evenementenlocatie worden geweigerd of ontzegd zonder recht op
restitutie van de Toegangsprijs of compensatie anderszins.
8.7 Het is de Bezoeker niet toegestaan zich (onnodig) op te houden voor nooduitgangen en
plaatsen op de Evenementenlocatie waar brandblussers hangen of andere brandwerende en/
of veiligheidsmaatregelen zijn getroffen.
8.8 Het is de Bezoeker uitdrukkelijk niet toegestaan professionele foto-, film-, drone- en/of
geluidsen/ of andere opnameapparatuur, glaswerk, plastic flessen, blik, vuurwerk, drugs, patronen
met lachgas, (vuur)wapen en/of andere gevaarlijke voorwerpen en/of stoffen, etenswaren en/of
(alcoholhoudende) dranken en/of (huis)dieren mee te brengen naar, althans in bezit te hebben
op de Evenementenlocatie, op straffe van inbeslagname van deze zaken en/of overdracht aan
de politie.
8.9 Het is de Bezoeker niet toegestaan (de inventaris van) de Evenementenlocatie op welke wijze
dan ook aan te tasten en/of te beschadigen. Het is de Bezoeker evenmin toegestaan
gevaarzetting te veroorzaken voor andere bezoekers, personeel en/of medewerkers van
DRIJFT en/of (personeel en/of medewerkers van) opdrachtnemers en hulpdiensten, onder
andere door op objecten te klimmen en/of zich op/in objecten te bevinden die op of om de
Evenementenlocatie aanwezig zijn (zoals bijvoorbeeld podia, hekken, containers etc.). Indien
de Bezoeker op enigerlei wijze schade toebrengt aan (de inventaris van) de Evenementenlocatie is de
Bezoeker gehouden deze schade te vergoeden.
8.10 De Bezoeker is gehouden instructies, voorschriften en/of aanwijzingen van medewerkers van
DRIJFT en/of de Evenementenlocatie, beveiligingspersoneel, de politie en/of ander
bevoegd gezag op eerste verzoek op te volgen. Deze instructies kunnen tevens toezien op het
voorkomen van (ongewenste) groepsvorming, agressief gedrag, onzedelijk of aanstootgevend
gedrag, calamiteiten, gevaarzetting, discriminatie, belediging, bedreiging, het dragen van
provocerende kleding, insignes, badges, hoofddeksels en vlaggen etc.
8.11 Indien de Bezoeker weigert zich aan de in dit artikel 8 genoemde (veiligheid)voorschriften te
houden, kan de Bezoeker de toegang tot het Evenement en/of de Evenementenlocatie worden
ontzegd en van de Evenementenlocatie worden verwijderd, zonder het recht op enige
8. vergoeding van de Toegangsprijs van het Toegangsbewijs en eventuele in rekening gebrachte
service- en/of administratiekosten en/of anderszins ontstane kosten.
8.12 Medewerkers van DRIJFT en/of de Evenementenlocatie, beveiligingspersoneel, de politie
en/of ander bevoegd gezag kunnen de Bezoeker bij een overtreding als bedoeld in dit artikel 8
te allen tijde verzoeken om mee te komen, verzocht worden een afschrift van zijn geldig
legitimatiebewijs af te geven en kan vervolgens van de Evenementenlocatie verwijderd worden.
De Bezoeker zal in dat geval te allen tijde vrijwillig, zonder verzet, medewerking verlenen aan
zo'n verzoek. DRIJFT zal vervolgens tijdens dan wel na het Evenement, al dan niet in
overleg met de betrokken autoriteiten, beslissen of de Bezoeker een ontzegging voor een of
meerdere Evenementen van DRIJFT opgelegd zal krijgen.
8.13 Consumptiebonnen- of munten gekocht tijdens het Evenement of gedurende het verblijf op de
Evenementenlocatie zijn uitsluitend geldig gedurende het betrokken Evenement en kunnen
door de Bezoeker niet worden ingeruild. DRIJFT zal tijdens en na afloop van het
Evenement nimmer tot restitutie van het aankoopbedrag van deze bonnen of munten
overgaan. Het is niet mogelijk reeds aangeschafte consumptiebonnen- of munten (door) te
verkopen. Het is Bezoekers verboden aangeschafte consumptiebonnen- of munten door te
(doen) verkopen.
Artikel 9 Overmacht
9.1 DRIJFT is niet gehouden tot nakoming van enige verplichting indien zij daartoe verhinderd is als
gevolg van overmacht. DRIJFT kan op grond van overmacht op een laat tijdstip besluiten het
Evenement geen doorgang te laten vinden. DRIJFT kan niet aansprakelijk worden gehouden voor
schade van de Bezoeker welke is ontstaan ten gevolge van overmacht en aanvaardt als zodanig ook
geen aansprakelijkheid. Onder overmacht wordt mede verstaan, doch niet daartoe beperkt:
stakingen, brand, (extreme) weersomstandigheden, epidemieën, (dreiging van) terreur, het intrekken
van de evenementenvergunning vanwege een negatieve waterkeuring, en alle overige van buiten
komende oorzaken, voorzien of niet voorzien, waardoor DRIJFT niet in staat is haar verplichtingen na
te komen.
9.2 Indien het Evenement wegens overmacht stilgelegd, gewijzigd, verplaatst of afgelast wordt, zal
DRIJFT de reeds betaalde Toegangsprijs van het Toegangsbewijs restitueren tot het eventuele
positieve saldo dat overblijft na verrekening van de gemaakte kosten van het Evenement, waarbij
rekening zal worden gehouden met het bedrag dat eventueel door de verzekeraar wordt uitgekeerd.
DRIJFT is niet gehouden tot vergoeding of restitutie van de in rekening gebrachte service-, betaal-
en/of administratiekosten en/of anderszins ontstane kosten.
9.3 Ingeval van stillegging, wijziging, verplaatsing of afgelasting van het Evenement als gevolg van
overmacht is DRIJFT niet gehouden tot enige schadevergoeding.
Artikel 10 Privacy en persoonsgegevens
10.1 Door het sluiten van een Overeenkomst met DRIJFT kunnen (persoons)gegevens van de
Bezoeker worden verzameld, vastgelegd en opgeslagen in een gegevensbestand. Deze door
de Bezoeker verstrekte (persoons)gegevens worden door DRIJFT verwerkt.
10.2 Op de verwerking van de door de Bezoeker verstrekte (persoons)gegevens is het privacybeleid
van DRIJFT van toepassing.
10.3 Bij het sluiten van de Overeenkomst met DRIJFT geeft de Bezoeker uitdrukkelijk
toestemming voor het verwerken van (persoons)gegevens
10.4 Indien gedurende een Evenement (beeld)opnamen worden gemaakt met beveiligingscamera’s,
kan DRIJFT deze in geval van calamiteiten aan derden, waaronder mede begrepen politie
en justitie, afstaan.
Artikel 11 Klachten
DRIJFT zal al hetgeen in alle redelijkheid binnen haar mogelijkheden ligt, ondernemen om het
verblijf van de Bezoeker gedurende het Evenement op de Evenementenlocatie zo prettig mogelijk te
9. maken. DRIJFT tracht daarbij eventuele overlast of ongemakken voor de Bezoeker tot een
minimum te beperken alsmede de veiligheid van de Bezoeker zoveel mogelijk te waarborgen. Mocht
de Bezoeker onverhoopt klachten hebben ter zake de uitvoering van de Overeenkomst en/of de
dienstverlening van DRIJFT, dan kan de Bezoeker hiervan schriftelijk melding maken door een
e-mail te sturen naar info@drijftnederland.nl. Klachten dienen uiterlijk binnen 7 (zeven) dagen na
de datum van het verblijf op de Evenementenlocatie bij DRIJFT te worden gemeld.
Artikel 12 Geschillen
Op deze Algemene Bezoekersvoorwaarden en alle Overeenkomsten waarop deze Algemene
Bezoekersvoorwaarden van toepassing zijn, is uitsluitend Nederlands recht van toepassing. Ieder
geschil uit een Overeenkomst of in verband met een Overeenkomst, zal bij uitsluiting worden
voorgelegd aan de daartoe bevoegde rechter in het arrondissement Zeeland – West-Brabant.
