A conditional exclusion from the definition of solid waste for certain specified solvents used in specific manufacturing sectors for specific purposes. These hazardous secondary materials must be managed according to the conditions of this exclusion in order to be eligible for the exclusion. 40 CFR 261.4(a)(27) became effective July 13, 2015 and is part of the codification of the 2015 Definition of Solid Waste Final Rule.

7. Remanufacturing Exclusion for Spent
Solvents
The remanufacturing exclusion encourages the
recycling of 18 higher-value and lightly-
contaminated hazardous spent solvents used for
reacting, extracting, blending, or purifying
chemicals in the pharmaceutical, organic chemical,
plastics and resins, and the paint and coatings
sectors.

• Remanufacturing means processing a higher-
value hazardous secondary material in order to
manufacture a product that serves a similar
functional purpose as the original commercial-
grade material. For the purpose of this definition,
a hazardous secondary material is considered
higher-value if it was generated from the use of a
commercial-grade material in a manufacturing
process and can be remanufactured into a similar
commercial-grade material.
