9.2.9 Transfer of Material
Prior to any transfer of material from a party to another party, the parties concerned
shall sign a Material Transfer Agreement (MTA),…
The receiving party especially undertakes:
to use the material trasmitted for the sole purpose(s) expressively authorised …
not to use the material outside the laboratory (adress specified in MTA), and
not to transfer all or part of thios amterial to any third party …
to limit the access to the material to those of ist personnel involved in ist part
of project FrutiBreedomics …
to handle material in compliance with all national and international laws,
regulations and guidelines
not to exploit, patent, protect, clain any title, deed or restrictive rights on the
material without the proir written permission of ist owner(s)
The sending partner does not warrant the sufficiency, accuarcy or fitness for purpose …
The receiving party does not acquire any proprietary right on material
Availability of material (general
considerations)
9.4.4 In exception of the previous articles, access rights to foreground being plant material
created within the framework of … WP2 (hereinafter „PM2“) shall be ruled by the following
provisions:
9.4.4.1 Access rights to .. PM2 if needed for use of a partys foreground, at the exception of
breeding activities which are adressed hereunder, shall be granted: (i) royalty-free for internal
research and education purposes and “(ii) on fair and reasonable conditions for any other

use (except breeding)“

9.4.4.3 Access right for breeding to PM2
Concerning PM2 developed from basic material (hereinafter „PM2a“):
PM2a shall include PM2 produced by using a background being a plant material
found „as it“ in the nature, or which is not more than two generation from the
original donor parent
The donor of PM2a shall give on request a non-exclusive and royalty free access
rights to other parties and to the member of the stakeholders platform for the
use of their PM2a in breeding activities

9.4.4.3 Access right for breeding to PM2

Concerning PM2 developed from advanced material (hereinafter „PM2b“)
PM2b shall include PM2 produced by using a background being a plant material
which decends more than two generations from ist original natural donor
parent
Material derived from the fast-breding (early flowering) approach shall be
considered as PM2b material
By exception, the ownership of PM2b will be deemed to be in co-ownership of
the party having produced the concerned PM2b and of the owner of the
backgound used to produce it
…. For the parties not involved in WP2 and for any other third party, including
those members of the stakeholder platform, the owners of the PM2b will be
free to decide of their access rights policy for breeding activities
