87. The state government has declared a three day mourn-

Mumbai: Sensex slumped 486 points on Thursday, largely in tandem with

cabinet on Thurs-
day approved a Rs
23,123-crore package
for improving health
infrastructure to fight
COVID-19 as part of
which around 2.4 lakh
medical beds and 20,000
ICU ones would be
created with a special focus on paediatric care. Address-
ing a press conference here after the first meeting of the
Union cabinet following its reshuffle on Wednesday, Health
Minister Mansukh Mandaviya said the package will be im-
plemented over the next nine months till March 2022. The
meeting was chaired by Prime Minister Narendra Modi.

a sensitive decision to
give compassionate ap-
pointmenttothedepend-
ent family members of
the deceased state em-
ployees at the earliest.
Now to provide compas-
sionate appointment
with quick effect, the
State Nodal Officer and
CaseInchargewillbeap-
pointed in each depart-
ment. The Personnel
Departmenthasissueda
circular in this regard.
According to the cir-
cular, for speedy dispos-
al of applications re-
ceived for appointment
to the dependent of the
state employee, a nodal
officer will be made in
each department, who
will normally be a sen-
ior officer posted as the
head of the department.
Similarly, in each case
of deceased dependent
appointment, an em-
ployee will be appointed
as the case in-charge for
speedy action. The case
in-charge will be an em-
ployee of the same of-
fice in which the de-
ceased employee was
posted. State nodal offic-
ers and case in-charges
will ensure speedy dis-
posal of cases of com-
passionate appointment
at the department and
office level.
The State Nodal Of-
ficer will have to main-
tain the details of all
the cases related to the
compassionate appoint-
ment of the department
as well as get the case
in-charge appointed
soon after the death of

5 of family mowed down
by a dumper in Jhalawar
Jhalawar: Five members
of a family, including three
children, were mowed
down by a dumper while
asleep outside their house
in Jhalawar, police said
on Thursday. The incident
took place on Wednesday
night at Ghorakhal on the
Teen Dhar road under the
Mandawar police station
area. Police have detained
the dumper driver and
handed over the bodies to
family members after au-
topsy. The deceased have
been identified as Suresh
Bheel, 44, his wife Sitabai,
40, and their three children
Nirmala, 11, Pavan, 7,
Kamlesh, 5. According to
police, the victims were
sleeping on cots outside
their “kutcha” house when
around 12.30 am, the un-
controlled dumper mowed
them down. Two other
children escaped injuries
as they were sleeping at a

Bairwa, a resident
of Laban village, died
while being taken to a
hospital in 2011. For the
last two months, his
soul has reportedly
been troubling his par-
ents who had to placate
the soul with rituals at
the spot where the
youth died and took his
soul along with them.
The story seems to be
the plot of a horror pot-
boiler from a Bolly-
wood flick but it is a
real not reel incident.
The family was told by
a local deity to invoke
his soul and fulfill its
unfulfilled desire. On
Thursday, occult ritu-
als were performed
near the Khatkar Mej
river, where he had
died, and it was claimed
that Sheru’s soul en-
tered his mother’s body
and asked to take it
along and dedicate a
place for it. The soul
was trapped in a pot
and handed over to the
mother. Now, some are
terming it as a super-
stition but for the fam-
ily of Sheru it is a
great relief.

old girl was found dead
in a forest near Dun-
garpur. It is suspected
that the minor has been
raped and murdered.

victim had injuries.
During investigation,
the police came to know
that the victim went into
the woods with a boy
named Bhuria Meena on
Wednesday. After some
hours he left, but the girl
was not with him.
Jaipur: A 20-year-old woman was raped while she
was drying clothes on the roof of her rented accom-
modation on July 6. The accused also lives on rent
on the terrace of the same house. The victim’s father
lodged a case at Shiprapath police station, which RPS
Naresh Banshiwal is investigating. The matter came to
light on Thursday. According to the police report, the
accused’s friend stood guard outside the room. Her
brother rescued her when she did not come down.
Udaipur: A minor was gangraped for 2 years by 2
accused, of the same village. They intimidated her
and repeatedly raped, she told the police. The matter
came to light after victim was found 4 months preg-
nant during a medical check-up when she fell ill. A
case has been filed under the POCSO Act at Gogunda
police station. The police took the girl for medical
examination and are looking for both the accused.
Baran: In a green initiative, Rajasthan State Road
Transport Corporation has selected Baran depot for the
first trial of CNG buses. To start with, on Thursday the
first CNG bus was flagged
off from Baran to Nahargarh.
According to Chief Manager
Sunita Jain, the bus opera-
tional between Baran-Nahar-
garh is an experiment, where
a CNG kit has been installed
in the old roadway bus by the
corporation. A distance of 250 km can be covered by
a gas kit installed in the bus. Traffic manager Naveen
Dadhich informed that the bus is capable of doing two
rounds every day and the route chart of the CNG bus
has also been prepared.

Jaipur: Patwar recruitment exam will be held on

their previously applications. Hari Prasad Sharma,

Jaipur: The state government issued a notification
while fixing the number of members of Rajasthan
Waqf Board. Now, there will be only 5 members. The
members of the Board shall consist of one Muslim
MP from the State, one Muslim Member from the
State Legislative Assembly and one Muslim Member
from Bar Council of the State and two members
shall be Mutawalli of Waqf having an annual income
of Rs 1 lakh or more. Secretary, Minority Affairs and
Waqf Department, PC Kishan said that the election
of members of the Board will be held on August 17,
2021, which will be done according to the program
fixed and broadcast by the Chief Electoral Officer.

VIGILANCE WING EFFECTIVE
Jaipur: The exercise of restructuring Vigilance Wing
of Mines Dept has intensified. On Thursday, ACS Dr
Subodh Agarwal discussed all options in detail with
the team to make the Vigilance Wing of the dept ef-
fective and efficient. The biggest challenge before the
department is to stop illegal mining and transporta-
tion. Along with this, revenue has to be increased by
stopping wastage. In view of the abundant reserves
of minerals in the state, among the priorities of CM
Ashok Gehlot is to increase exploration and mining
work,’ ACS Agarwal said. Meanwhile, during the
meeting Director, Mines, KB Pandya and Deputy
Secretary, Mines, Neetu Barupal were present.

The state govt has postponed decision to invite children
to schools for the time being in view of the possibility

was no discussion on opening schools. In the first phase,

studies by opening schools for
children from class 9 to 12.
This proposal has been put on
hold for the time being. The
rationale behind proposal to
open school was that corona
is under control and in 15
months, schools have been closed except for 3 months. After
the opinion of experts, decision has been taken to postpone
opening of school, colleges. After July 20, the govt may
review once, only after this review, there will be a decision,
till then school will remain closed for the children.

has picked up the
cudgels on behalf of
the traditional medi-
cinesystemtorejecta
study claiming that the immune-
booster herb Giloy damaged the
liver of six patients in Mumbai.
The ministry said that the study
published in the peer-reviewed
Journal of Clinical and Experi-
mental Hepatology “would be
misleading and disastrous to the
Traditional Medicine system of
India as herb Guduchi or Giloy
has been used in Ayurveda since
long. The efficacy of Tinospora
cordifolia, Giloy’s botanical
name, in managing various dis-
orders is well established”.
Ayurvedic medicines have
been in the markets for decades,
perhaps centuries. Allopathic
medicines were not as popular
then. Then herbs were freely
and locally available and people
used them under the guidance
of trained vaidyas. That is not
the case these days and people
use them carelessly, without re-
alizing that herbal medicines
can have side-effects. The minis-
try should first check the pa-
tients’ history of Giloy use and
then junk the study
.

Digital Media Eth-
ics Code) Rules, 2021 was first
opposed, by many who be-
lieved in freedom of expres-
sion, when the Ministry of
Electronics and Information
Technology proposed to
change rules under the IT Act
in December 2018. One provi-
sion in the 2018 proposal and
which has also been included
in 2021 is of particular con-
cern. It relates to traceability
of originators of information
on social media platforms
and has become a conten-
tious issue which many say
would involve weakening of
encryption which protects a
messenger on social media
platforms. WhatsApp has
contested the traceability
clause in the Supreme Court.
The News Broadcasters As-
sociation has joined the legal
battle against the new IT
rules. It has filed a writ peti-
tion in the Kerala High Court
arguing that the new rules
could unfairly curb freedom
of speech and expression. It
isthe“oversightmechanism”
by a joint secretary of the
Ministry of Information and
Broadcasting which is par-
ticularly irksome. The NBA
stated that the “rules create
an oversight mechanism giv-
ing the executive unfettered,
unbridled and excessive pow-
ers to regulate content of
digital media. The Grievance
Redressal Mechanism creat-
ed and the powers delegated
have a chilling effect on the
content of the media”.
It is being contended that
the idea of an executive as an
oversight authority is remi-
niscent of the Emergency
when a district magistrate or
an officer designated by him
would walk into a newspaper
office and cross out news
which he thought was anti-
government.

MINOR REVISIONS
ne of the major fears I had
raised was about not getting
the property back by the
landlords whenever they
wanted it. The current law
seems to have taken care of
the same quite a bit. Most of
the time, the owners, popu-
larly known as the ‘landlords’
even if they own just a small
apartment in a big society, do
not rent out their properties
for the fear of not getting
them back. Can there be a
situation worse than a per-
son not getting his house,
which he bought out of his
hard-earned money, back
from the tenant when he
needs it? The law has no busi-
ness to sympathise with any
such forceful occupier of the
house. The section 23 of MTA
2021 does define a heavy pen-
alty i.e. twice the rent for first
two months and four times
the rent for the subsequent
months of such forceful oc-
cupation by the tenants but,
refrains the owners from dis-
connecting the essential ser-
vices such as the electricity
and the water supply to such
tenants. Although MTA 2021,
through its Sections from 21
to 25, speaks amply about
evicting such tenants yet it
restricts the landlords to take
any forceful action himself.
In my opinion, when the own-
ers are not spared by such
service providers on delay-
ing their payments to them,
why should then the tenants
get such an immunity
.
Today, those owners who
are investors are not even
able to recover the interest
cost on the capital they have
invested while those owners
who have rented out their
apartments out of some com-
pulsion, are just able to re-
cover the expenses of main-
taining their properties.
SUGGESTED
REVISIONS IN THE ACT
..commercial aspects such
as the Security deposit, ad-
vance rent, hike in rent
should be market driven,
based on the demand and
supply or as agreed be-
tween the parties..
All the commercial terms
of such transactions should
be market-driven. Security
deposit, advance rent, agree-
ment period, hike in rent
every year should be allowed
to be based on the demand
and supply and as agreed be-
tween the parties. The law
should be invoked only when
and where the agreements
are incomplete and have been
omitted to cover the points of
dispute between the two
agreeing parties.
The law to be enforced
should factor in the type of
properties to be rented out.
Whetherresidential,commer-
cial, industrial, land or any
other. Currently, except for a
very few terms, there are no
specific terms for residential
and commercial properties.
SECURITY DEPOSIT
Section 11 of the act restricts
the Security Deposit not to
exceed two months’ rent and
six months’ rent for residen-
tial and commercial premis-
es respectively
. It is to be un-
derstood as to why such a
deposit is collected from the
tenants. Most of the time ten-
ants vacate the premises and
exit the agreement abruptly
either out of some compul-
sion such as due to their cur-
rent poor economic health or
for a better deal or due to the
shifting of their base.
Further, capping the secu-
rity deposit may sometimes
be counterproductive for the
tenantstoo.Quiteafewtimes,
mostlywhenacompanyrents
an apartment for its employ-
ees, the tenant prefers to give
more deposit to negotiate for
a lower rent. This is because
the deposit being refundable,
is paid by the employer while
the rent is borne by the em-
ployee. But, if the security
deposit is capped, the land-
lord will have no option but to
be rigid on the rent.
PENALTY FOR NOT
VACATING THE
PREMISES
Although the act envisages a
speedy adjudication yet the
owner, if he so desires, be al-
lowed to take possession of
his premises immediately on
expiry ( or earlier determina-
tion ) of the agreement
whether peacefully or force-
fully. Rest others are com-
mercial penalties, which can
be levied and recovered from
the outgoing tenant later.
COST OF ENTERING
INTO THE AGREEMENT
The law seems to be silent on
thisissue.Theprimeresponsi-
bility of registering the agree-
ment is that of the owner but,
the cost of the same should be
borne by the tenants.

Jaishankar is cur-

in France, Ministry of
Finance on Thursday
said it has not received
any notice, order or
communication, in this
regard, from any
French court.
“Government is try-
ing to ascertain the
facts, and whenever
such an order is re-
ceived, appropriate le-
gal remedies will be
taken, in consultation
with its Counsels, to
protect the interests of
India,” the ministry
said in a statement.
It added that govern-
ment has already filed
an application on
March 22, 2021, to set
aside December 2020 in-
ternational arbitral
award in The Hague
Court of Appeal. “GoI
will vigorously defend
its case. It is also stated
that CEO  representa-
tives of Cairns have ap-
proached GoI for dis-

Tikait on Thursday that farmers are ready to talk with
the government on the farm laws but made it clear that
the discussions should be held without conditions.
Tikait was responding to Union Agriculture Minister
Narendra Singh Tomar’s remarks earlier today where
he said that the government is ready to hold talks with
the protesting farmers to discuss other options. “They
are imposing conditions that we should go to them for
talks. They say that they can amend the laws but will
not scrap them. Farmers have not been protesting for
eight months so that they can follow the government’s
orders. If the government wants to talk, they can talk,
but no conditions should be imposed,” Tikait told ANI.

with the application for
compassionate appoint-

ough examination of
the application, if any
deficiency is found in it,
with the cooperation of
the case in-charge, that
deficiency will have to
be addressed within 30
days and if any guid-
ance or permission is
required from the Per-
sonnel Department, co-
ordination will also
have to be made for it.
After receiving the ap-
plication, it will be the
responsibility of the
State Nodal Officer to
get the appointment or-
der issued within 45
days after getting it ap-
proved from the compe-
tent level and in coordi-
nation with the Person-
nel Department.
Similarly
, the case in-
charge will have to get
the application within
the stipulated time by
providing necessary in-
formation and applica-
tion form to the depend-
ent relatives for compas-
sionate appointment.
The case in-charge will
also have to ensure that
the necessary formali-
ties are completed at the
level of the Head of Of-
fice, to remove the short-
comings of the applica-
tion, taking necessary
action within a period
of 15 days on receipt of
the application from the
Head of the Office.
Along with this, in con-
stant coordination with
the nodal officer, the re-
sponsibility of ensuring
that the deficiencies in
the application form are
filled immediately
. The
incharge will also have
the responsibility to see
that appointment order
isgiventothedeceased’s
dependent.
It is noteworthy that
in the absence of infor-
mation on the death of a
state employee, cases of
unnecessary delay in
compassionate appoint-
ment at the office level
were reported. Taking
this seriously
, the Chief
Minister has taken this
initiative with the aim
of providing immediate
relief to the victim’s
family
. This will ensure
speedy action in cases
of compassionate ap-
pointment.

states and UTs so far.

Sources said that

tenders of the manager

Sandeep Ahuja. Apart
from this, many MD lev-

In the current situa-
tion, when the govern-
ment was unable to take
any decision under po-
litical pressure, an RAS
officer, Chandmal Ver-
ma was given the post-
ing to get rid of the
problem. However, it is
yet unknown as to from
where and how the
name of Chandmal Ver-
ma came.
Apparently, Verma is

that 2,985 new houses at
Jaipur, Bharatpur, Dun-
garpur, Bhiwadi and
Kotputli have been in-
cluded in the Wednes-
day Auction e-bid Sub-
mission Scheme with
huge discounts. Most of
these accommodation s
are located at various
developed schemes of
Jaipur. All these houses
will be available in e-bid
submission of auctions
from Wednesday, July
19, 2021.
The Commissioner
further added, “Out of
these 2,953 houses/flats
in Jaipur city, 2 in
Bharatpur, 3 in Dungar-
pur, 16 independent
houses in Kotputli and
11 in Bhiwadi would be
made available at huge
discount. In this era of
Covid-19 pandemic, eve-
ry person’s dream is to
possess a home of their
own.Takinginitiativein
this direction, houses/
flats in fully-developed
colonies will be provid-
ed at a price 2 to 3 times
less than the market
rates. These houses will
be provided on 156 easy
monthly instalments of
13 years,” he said.
Arora also said that
149 flats of 1 BHK size
worth Rs 21.38 lakh of
Pratap Apartment (Low
Income Group) located
in Sector 29 of the pres-
tigious Pratap Nagar
Housing Scheme of the
Board, will now be
available at the mini-
mum auction rate of Rs
8 lakh. With this, 3 BHK
flats of Rs 70 lakh in
Pratap Apartments
(High Income Group)
will now be available
for just Rs 35 lakh.
The Commissioner
said that 1,111 flats of 1
BHK size worth Rs 9.97
lakh of Dwarkapuri
Housing Scheme locat-
ed in Sector 29 of Pratap

will now be available at
the minimum auction
rate of only Rs 6 lakh.
The super buildup
area of a flat in this
scheme is approxi-
mately 358 sq. ft.
“Moreover, 77 flats of
2 BHK size worth Rs
38.38 lakh in Gomti
Apartment (Middle In-
come Group-A) located
near RUHS, are now
available at the mini-
mum auction rate of
only Rs 25 lakh. Under
the Weekend Home
Scheme developed by
RHB at Nayla, 567 hous-
es will now be provided
at a discount of 25 per-
cent. Now these week-
end homes will be avail-
able for only Rs 11,
55,000 whereas, earlier
their price was Rs 15,
40,000” the Commis-
sioner said.

lakh, which will now be

lakh. “Similarly, 6 flats

are available at 25% dis-
count, 12 flats of MIG-A
(G+3) of Shivalik, Neel-
kanth and Gurushikhar

allotted to the successful bidder on instal-

the 'last link' has en-
sured that he has a

Choudhary's con-
nect with Congress
started in 1991 and
witnessing his abili-
ties, he was soon ap-
pointed as NSUI's
Block President for
Kotputli in 1993.
While he contested
several college elec-
tions through 1995-96,
he was simultaneous-
ly given higher posi-
tions in the NSUI. In
97-98, he was elected
President of Ra-
jasthan University
Law College.
By 2003, he gradu-
ated into the Youth
Congress and in
2007, he was ap-
pointed the Vice-
President of
Kissan Congress to
President of
Kissan Congress in
2012, a position he
has held continuously
since. But perhaps his
biggest distinc-
tion is his
appointment as AICC
Spokesperson, a posi-
tion which he has
been continuing on
since March 2015 till
date and is currently
also the working Pres-
ident of District Con-
gress Committee,
Jaipur Rural.
At a time, when
youth is getting at-
tracted towards poli-
tics only due to the
spotlight it provides,
Choudhary is an ex-
ception, for, he took
the 'old road' of doing
away with the lime-
light, and making a
difference for the par-
ty

stamp duty on documents related to transfer of im-
movable property acquired by secured creditors to new
management and concession in registration fee for revival
of sick micro and small units of construction sector. The
proposal to increase the maximum limit to Rs 10,000 has
been approved. The CM has also approved the draft of the
notifications related to this. It is noteworthy that in the
past also, a notification was issued on March 8, 2017, to
provide exemption on documents related to transfer of
immovable property of such units. But units were finding
it difficult to acquire its benefits due to ambiguity in provi-
sions. Industries Dept had proposed the amendments.

According to the cir- cular, for speedy dispos- al of applications re- ceived for appointment to the dependent of the state employee, a nodal officer will be made in each department, who will normally be a sen- ior officer posted as the head of the department. Similarly, in each case of deceased dependent appointment, an em- ployee will be appointed as the case in-charge for speedy action. Turn to P6 CM Ashok Gehlot 5 of family mowed down by a dumper in Jhalawar Jhalawar: Five members of a family, including three children, were mowed down by a dumper while asleep outside their house in Jhalawar, police said on Thursday. The incident took place on Wednesday night at Ghorakhal on the Teen Dhar road under the Mandawar police station area. Police have detained the dumper driver and handed over the bodies to family members after au- topsy. The deceased have been identified as Suresh Bheel, 44, his wife Sitabai, 40, and their three children Nirmala, 11, Pavan, 7, Kamlesh, 5. According to police, the victims were sleeping on cots outside their “kutcha” house when around 12.30 am, the un- controlled dumper mowed them down. It is suspected that the minor has been raped and murdered. Nithauwa Police official Abdul Razzaq said the victim had injuries. During investigation, the police came to know that the victim went into the woods with a boy named Bhuria Meena on Wednesday. After some hours he left, but the girl was not with him. Jaipur: A 20-year-old woman was raped while she was drying clothes on the roof of her rented accom- modation on July 6. The accused also lives on rent on the terrace of the same house. The victim’s father lodged a case at Shiprapath police station, which RPS Naresh Banshiwal is investigating. The matter came to light on Thursday. According to the police report, the accused’s friend stood guard outside the room. Her brother rescued her when she did not come down. Udaipur: A minor was gangraped for 2 years by 2 accused, of the same village. They intimidated her and repeatedly raped, she told the police. The matter came to light after victim was found 4 months preg- nant during a medical check-up when she fell ill. A case has been filed under the POCSO Act at Gogunda police station. The police took the girl for medical examination and are looking for both the accused. Baran: In a green initiative, Rajasthan State Road Transport Corporation has selected Baran depot for the first trial of CNG buses. To start with, on Thursday the first CNG bus was flagged off from Baran to Nahargarh. According to Chief Manager Sunita Jain, the bus opera- tional between Baran-Nahar- garh is an experiment, where a CNG kit has been installed in the old roadway bus by the corporation. A distance of 250 km can be covered by a gas kit installed in the bus. The ministry said that the study published in the peer-reviewed Journal of Clinical and Experi- mental Hepatology “would be misleading and disastrous to the Traditional Medicine system of India as herb Guduchi or Giloy has been used in Ayurveda since long. The efficacy of Tinospora cordifolia, Giloy’s botanical name, in managing various dis- orders is well established”. Ayurvedic medicines have been in the markets for decades, perhaps centuries. Allopathic medicines were not as popular then. Then herbs were freely and locally available and people used them under the guidance of trained vaidyas. That is not the case these days and people use them carelessly, without re- alizing that herbal medicines can have side-effects. The minis- try should first check the pa- tients’ history of Giloy use and then junk the study . The current law seems to have taken care of the same quite a bit. Most of the time, the owners, popu- larly known as the ‘landlords’ even if they own just a small apartment in a big society, do not rent out their properties for the fear of not getting them back. Can there be a situation worse than a per- son not getting his house, which he bought out of his hard-earned money, back from the tenant when he needs it? The law has no busi- ness to sympathise with any such forceful occupier of the house. The section 23 of MTA 2021 does define a heavy pen- alty i.e. twice the rent for first two months and four times the rent for the subsequent months of such forceful oc- cupation by the tenants but, refrains the owners from dis- connecting the essential ser- vices such as the electricity and the water supply to such tenants. Although MTA 2021, through its Sections from 21 to 25, speaks amply about evicting such tenants yet it restricts the landlords to take any forceful action himself. In my opinion, when the own- ers are not spared by such service providers on delay- ing their payments to them, why should then the tenants get such an immunity . Today, those owners who are investors are not even able to recover the interest cost on the capital they have invested while those owners who have rented out their apartments out of some com- pulsion, are just able to re- cover the expenses of main- taining their properties. SUGGESTED REVISIONS IN THE ACT ..commercial aspects such as the Security deposit, ad- vance rent, hike in rent should be market driven, based on the demand and supply or as agreed be- tween the parties.. All the commercial terms of such transactions should be market-driven. Security deposit, advance rent, agree- ment period, hike in rent every year should be allowed to be based on the demand and supply and as agreed be- tween the parties. The law should be invoked only when and where the agreements are incomplete and have been omitted to cover the points of dispute between the two agreeing parties. The law to be enforced should factor in the type of properties to be rented out. Whetherresidential,commer- cial, industrial, land or any other. Currently, except for a very few terms, there are no specific terms for residential and commercial properties. SECURITY DEPOSIT Section 11 of the act restricts the Security Deposit not to exceed two months’ rent and six months’ rent for residen- tial and commercial premis- es respectively . It is to be un- derstood as to why such a deposit is collected from the tenants. Most of the time ten- ants vacate the premises and exit the agreement abruptly either out of some compul- sion such as due to their cur- rent poor economic health or for a better deal or due to the shifting of their base. Further, capping the secu- rity deposit may sometimes be counterproductive for the tenantstoo.Quiteafewtimes, mostlywhenacompanyrents an apartment for its employ- ees, the tenant prefers to give more deposit to negotiate for a lower rent. This is because the deposit being refundable, is paid by the employer while the rent is borne by the em- ployee. But, if the security deposit is capped, the land- lord will have no option but to be rigid on the rent. PENALTY FOR NOT VACATING THE PREMISES Although the act envisages a speedy adjudication yet the owner, if he so desires, be al- lowed to take possession of his premises immediately on expiry ( or earlier determina- tion ) of the agreement whether peacefully or force- fully. Rest others are com- mercial penalties, which can be levied and recovered from the outgoing tenant later. COST OF ENTERING INTO THE AGREEMENT The law seems to be silent on thisissue.Theprimeresponsi- bility of registering the agree- ment is that of the owner but, the cost of the same should be borne by the tenants. ..Based on the market cap- ital value, the law should fix the minimum rent a land- lord should get.. The case in-charge will also have to ensure that the necessary formali- ties are completed at the level of the Head of Of- fice, to remove the short- comings of the applica- tion, taking necessary action within a period of 15 days on receipt of the application from the Head of the Office. Along with this, in con- stant coordination with the nodal officer, the re- sponsibility of ensuring that the deficiencies in the application form are filled immediately . It is noteworthy that in the past also, a notification was issued on March 8, 2017, to provide exemption on documents related to transfer of immovable property of such units.
