Jacoby's main argument is that some of imprisonment sentences can be replaced to more

restorative incarceration. The original theory of restorative justice was based on simple human
behavior regulated by incentive instead of punishment, which instituted the concept of parole as a
means of reward for a prisoner for rehabilitation. Further studies in criminology proved that this idea
was too simplistic and married it to the positivist theory of criminology and instituted individual
assessment and treatment for each prisoner based on their specific needs for reformation.
As Rothman (1980) and many others have pointed out, this ideal system was never implemented as

Rehabilitation training is effective to minimize long–term effects in memory functions, but similar
to standardized testing therapies often possess limitations. In many cases we are unaware if the
patient continues to use what he or she learned throughout training after the rehabilitation treatment

until now, little research exists about the long term recovery of patients with acquired brain damage.
Results of an observation show that after 2–5 years post–traumatic–brain–injury patients report
functional gains after rehabilitative therapy, but still report cognitive, behavioral, and emotional
impairments (Olver et al. 1996). Although, patients show improvement in cognitive and emotional
functions up to 10 years port–traumatic–brain–injury (Sbordone et al. 1995). Yet, researchers found
that patients who had a stroke overall improved in cognitive functions, but patients with damage to
the right side and higher consciousness at admission revealed higher improvements (Hochstenbach

Section 504 of the Rehabilitation Act of 1973 is a civil rights statute which prohibits an otherwise
qualified individual with a disability from being discriminated against, excluded from participation
in or denied the benefits of any program or activity that receives federal financial assistance. Section
504 is enforced by the U.S. Department of Education, Office of Civil Rights (OCR), and the
Massachusetts Bureau of Special Education Appeals
(BSEA). Students who are eligible for Section 504 Plans are provided with appropriate educational
accommodations and/or services designed to meet their individual needs to the same extent as the
needs of students without disabilities.

Eligibility for accommodation plans and/or services under Section 504 is based upon a review of
documentation from multiple sources to determine whether a student has a physical or mental
impairment which substantially limits one or more major life activities, has a record of such an

self that the criminal has created is unfit for society and thus he needs to change. Humans have
